Subject: SUP-366, Property located in part of the NWY4 of section 6, Township 6 North, of the
6th P.M., Weld County, Colorado
Dear Mr. and Mrs. Hunter:
Thank you for your letter of September 9. Planning staff have reviewed your request to divide
off an area of approximately 10 acres to be sold off. This property is part of a special use
permit SUP-366 for a hog farrowing operation. The staff has determined that applying for a
recorded exemption on :he property to divide off 10 acres would not be a material deviation
from the approved plans. However, to sell off the 10 acres a Recorded Exemption would need
to be submitted, reviewed and approved, and all conditions met and the plat recorded. A copy
of the Recorded Exemption procedural guide is being sent to you along with this letter.
To divide the property further, you would need to apply for a Change of Zone and then apply for
the subdivision. This would require a more detailed application and public hearings. Please
call to setup an appointment with me should you choose to proceed with this process.

Dear Mr. Schuett:
Per our phone conversation, please find a copy of the letter you sent us and a
"rough" sketch of the layout of our farm.
I would like to restate our intentions and perhaps clarify a few things from
our last letter. We chose to put 10 or so acres with the house because of some
natural boundries that exist. We are unsure of the exact acerage in this area
but would estimate it to be around 10 acres (see map).
Also if you will notice, the hog barns and the building we would remodel
are east and south of the existing house. The hill and curve of the road
keep the-barns out of sight from the house and act as a barrier to most of the
smell. By remodeling one of the existing bulidings, the cosmetics of the way
the farm looks from the road would be kept to a minimum and with the exception
of some minor landscaping things would remain much the same.
I would like to also state again thbt, our hog numbers are much under the amount
allowed in the Special Use Permit. Our total number of hogs is around 800 and
could go even lower depending on the market futures.
If dividing off the extra 10 acres (indicated byL(x) would involve more applications
public hearings and basically more time, we would drop this option. Our first
priority is to section off the house and the plus or minus 10 acres
In closing, I would like to restate that our reason for desiring this sub-
dividing is not one for making a large profit but for keeping our hog business
going. We thank you for your consideration on this matter and anxiously await
your reply.

Back in the Spring of 1993 we requested an application for a Recorded Exemption �
on our property. That request was reviewed and it was found that the application .t
would not be considered a major change to our Special Use Permit. That request
involved a 10 acre parcel.
At this time we would like aniapplication for sectioning off the (A) house we
live in along with 10 to 12 acres and (B) the original 10 acre parcel , ' leaving
the hog facility and 28 to 30 acres .in our possession.
Over the past 2 years our hog business has had some set backs and because of
that we are in a position that in order to salvage anything, we need to lighten
our debt load or lose everything.
Should our request for application be approved and the actual application be
approved, it is our intent to take an existing building on the remaining acres
and remodel it for a house for our family. There is already existing electricity
and a well for water sepenate from the-house considered in (A). We have scaled
down our hog numbers and are far below the amount that we are cleared for in
the Special Use Permit. It is our intent to keep the numbers down with a
possibility of going even smaller.
We are aware that Weld County does not want subdivisions popping up all over
and it is not our intent to turn this into one. As you probably know, our
50 acres doesn't have any water rights and so is unsuitable for raising crops
even on a small scale and could only graze a very small number of livestock.
So it's "not as tho.>we are taking prime farm land and trying to make money off
the person wanting to escape city life. Our request is out of necessity not
greed or profit.

The Department of Planning Services' staff has considered your request to apply
for a Recorded Exemption on your property and has determined that the application
for a Recorded Exemption will not be considered a major change to your Special
Use permit as approved. It is not the intent of this letter to imply that the
recorded exemption will be approved. The application must meet the approval
criteria set forth in the Weld County Subdivision Ordinance.
