HomeMy WebLinkAbout940166.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1575 - SIDWELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-111(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1575, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1575 was submitted by Katherine A. Si-dwell for property which is located in part of the Ez NE of Section 22, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, a hearing before the Board was held on January 26, 1994, at which time the Board deemed it advisable to continue said matter to February 9, 1994, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 2 acres and 75 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home. It shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Individual Sewage Disposal Systems shall be located at least 100 feet from any well, surface water or irrigation ditches . 3. An ISDS permit must be finalized and approved by an Environmental Protection Specialist within one year of the application date. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The parcel of land on which this application is being made is described as part of the E2 of the NE4 of Section 22, T7N, R66W of the 6th P.M. , Weld County, Colorado, or Lot B of RE-1035. No dwellings currently exist on the site. The property is located within the Urban Growth Boundary of the Town of Ault. The Ault Planning Commission reviewed this application and found no conflicts with its interests. The Department of Planning Services recommends that this application be withdrawn by the applicant, and followed by an application for a subdivision exemption. If the applicant chooses not to accept this course of action the Department of Planning Services recommends this request for a recorded exemption be denied based on lack of adherence with the agricultural zone district, and the inability of the application to satisfy the intent of the recorded exemption process. This request is to divide the total contiguous land holdings of the applicant into two lots, cne which is 2 acres more or less, and the other 75 acres, more or less. The applicant has demonstrated the need to split this land because she wants to build a rural residence on the small parcel, and to continue to farm the remaining irrigated parcel, as it has historically been farmed. Staff believes the applicant can establish this intended desire without creating an additional lot by utilizing the subdivision process . There have been five recorded exemptions in this area; however, this is the first request to further subdivide a recorded exemption lot. Staff does not see the benefits to the A (Agricultural) zone district for establishing the potential for increased development. The intent of the recorded exemption cannot be achieved by this request. The applicant is requesting a recorded exemption so she can receive financing for a home. This meets the criteria for a subdivision exemption not a recorded exemption. Staff has explained these concerns to the applicant, but the applicant has chosen to proceed with this recorded exemption application. The Department of Planning Services acknowledges that this application is not consistent with the A (Agricultural) zone district, is not efficient and orderly development, and does not meet the intent of the recorded exemption process. The Department of Planning Services asks the Board of County Commissioners to determine if the standards of 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met, and if the proposed division adheres to the goals and policies of the Weld County Comprehensive Plan. Pipelines shall be located along the access roads to the actual well site and storage site. The location of pipelines at any other location or locations shall be created only after the surface owner grants a written pipeline easement and upon payment to surface owner of the then normal going rates. 5 . In addition to payment of the $5, 000 minimum per drill site and the $1, 000 annual usage fee per completed well, the surface owner will be compensated for all crop damage and all other general and special damages caused the surface owner. The payment of the $5 , 000 per drill site as provided in paragraph 1 and the payment of $1, 000 per year per well as provided in paragraph 2 , covers only ordinary damage and not extraordinary damage, such as but not limited to environmental damage.
