RE: APPROVAL OF RECORDED EXEMPTION NO. 1575 - SIDWELL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-111(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1575, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1575 was submitted by
Katherine A. Si-dwell for property which is located in part of the Ez NE of
Section 22, Township 7 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, a hearing before the Board was held on January 26, 1994, at which
time the Board deemed it advisable to continue said matter to February 9, 1994,
and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 2 acres and 75 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home. It
shall be installed according to the Weld County Individual Sewage
Disposal System (ISDS) regulations.
2. Individual Sewage Disposal Systems shall be located at least 100
feet from any well, surface water or irrigation ditches .
3. An ISDS permit must be finalized and approved by an Environmental
Protection Specialist within one year of the application date.
4. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording, fees.

The Eaton Bank is appreciative of your request for a construction
loan to baild a residence upon the farm you own. Based upon my initial
evaluation of your project, our bank will be unable to participate.
Due to the unique situation that permitted you to purchase the
property with basically 100 % financing, there is no lendable equity in
the farm. Even though you have enough outside income to qualify for a
$50,000.0) loan, there is an apparent lack of collateral either from
the farm or other sources.
However, if your lender released some acreage and the bank could
obtain a first Deed of Trust on it, the land value would be sufficient
to obtain the requested loan.

Dear Commissioners:
This request for a recorded exemption is submitted by Katherine A. Sidwell. The
parcel of land on which this application is being made is described as part of
the E2 of the NE4 of Section 22, T7N, R66W of the 6th P.M. , Weld County,
Colorado, or Lot B of RE-1035. No dwellings currently exist on the site. The
property is located within the Urban Growth Boundary of the Town of Ault. The
Ault Planning Commission reviewed this application and found no conflicts with
its interests.
The Department of Planning Services recommends that this application be withdrawn
by the applicant, and followed by an application for a subdivision exemption.
If the applicant chooses not to accept this course of action the Department of
Planning Services recommends this request for a recorded exemption be denied
based on lack of adherence with the agricultural zone district, and the inability
of the application to satisfy the intent of the recorded exemption process.
This request is to divide the total contiguous land holdings of the applicant
into two lots, cne which is 2 acres more or less, and the other 75 acres, more
or less. The applicant has demonstrated the need to split this land because she
wants to build a rural residence on the small parcel, and to continue to farm the
remaining irrigated parcel, as it has historically been farmed. Staff believes
the applicant can establish this intended desire without creating an additional
lot by utilizing the subdivision process . The subdivision exemption process has
been established to allow a land holder to finance a portion of land without
creating a legal. lot.

By right the Zoning Ordinance allows the applicant to build a rural residence on
her 77 acre parcel. Staff believes the addition of another buildable lot to this
area does not represent efficient and orderly development. The surrounding
properties are generally large farms composed of 80 acres, more or less. There
have been five recorded exemptions in this area; however, this is the first
request to further subdivide a recorded exemption lot. Staff does not see the
benefits to the A (Agricultural) zone district for establishing the potential for
increased development.
The intent of the recorded exemption cannot be achieved by this request. The
applicant is requesting a recorded exemption so she can receive financing for a
home. This meets the criteria for a subdivision exemption not a recorded
exemption. Staff has explained these concerns to the applicant, but the
applicant has chosen to proceed with this recorded exemption application.
The Department of Planning Services acknowledges that this application is not
consistent with the A (Agricultural) zone district, is not efficient and orderly
development, and does not meet the intent of the recorded exemption process. The
Department of Planning Services asks the Board of County Commissioners to
determine if the standards of 11.5.1 through 11.5.6 of the Weld County
Subdivision Ordinance have been met, and if the proposed division adheres to the
goals and policies of the Weld County Comprehensive Plan.

COVENANTS CONCERNING MINERALS
Grantors, in consideration of the oil and gas reservation by
them contained in the deed herein, individually and jointly
warrant, represent, covenant and agree that any oil and gas lease
that Grantors or their assigns, heirs or personal representatives
enter into shall contain the following provisions:
1. The surface owner will be paid a minimum of $5, 000 per
drill site prior to any drilling.
2 . If drilling results in the completion of a well, the
surface owner shall be paid $1, 000 per year per well site as an
annual surface usage fee, with the first payment due upon
completion of each well . This annual payment shall continue until
the well is plugged and the surface restored to its original
condition as provided in paragraph 7.
3 . The drill site shall not exceed 2; acres unless surface
owner consents in writing to a larger area. The term "drill site"
shall include the actual place where the well is drilled and all
accessory uses. Accessory uses include, but are not limited to,
roads, tank site, storage site, sludge pit, and all other uses
connected with the site preparation, drilling, production, storage,
pipelines, utilities and other processing activity.
4 . Pipelines shall be located along the access roads to the
actual well site and storage site. The location of pipelines at
any other location or locations shall be created only after the
surface owner grants a written pipeline easement and upon payment
to surface owner of the then normal going rates.
5 . In addition to payment of the $5, 000 minimum per drill site
and the $1, 000 annual usage fee per completed well, the surface
owner will be compensated for all crop damage and all other general
and special damages caused the surface owner. The payment of the
$5 , 000 per drill site as provided in paragraph 1 and the payment of
$1, 000 per year per well as provided in paragraph 2 , covers only
ordinary damage and not extraordinary damage, such as but not
limited to environmental damage. In the event of environmental
damage or other extraordinary damage, the surface owner will also
be fully compensated for such damage.
6 . This is a covenant running with the land.
7 . When any well is plugged or abandoned, the surface shall be
restored to its original good condition suitable for agricultural
purposes.
8 . In the event of any mineral exploration, testing or

production other than oil or gas, the surface owner will be
compensated for all general and special damages caused to the
property of whatever kind or nature.
9 . The surface equipment for any well will be situated so as
not to interfere with surface owner' s pivotal sprinkler or any
other irrigation system.
10. In the event of a breach of any of the warranties,
representations, covenants and agreements contained herein, the
surface owner shall have all legal and equitable remedies
available, including damages, specific performance, and injunctive
relief.

Sidwell: The East half (E1/2) Northwest Quarter (NE1/4) of Section 22,
Township 7 North, Range 66 West of the 6th P.M., EXCEPTING
THEREFROM Lot "A" of Recorded Exemption No. 0707-22-1-RE1035
according to the map thereof recorded July 24, 1987 in Book 1164 at

portion conveyed to Weld County by instrument recorded June 15, 1953
in Book 1358 at Page 510, County of Weld, State of Colorado.
b) Enclosed is a copy of the deed on the subject property.
c) Attached is a letter of intent from North Weld County Water District.
d) Following .are the answers for the Recorded Exemption Questionnaire:
1) Subject Application is submitted for the purpose and reason of :
a) Applicant wishes to build a home (main dwelling) on said
property.
b) The size of the parcels after all is completed would be (subject to
survey):
Proposed Homestead and other improvements = 2 acres more or less
Existing Farmland = 73.28 acres more or less
Total = 75.28 acres more or less

c) This division is based upon the historical flow of irrigation water around
subject yard; proposed building does not affect the access or drainage of
irrigation water.
d) An access to proposed building will be along from the Southeast corner of
the proposed Homestead lot.
2) The uses of the proposed parcels will be to build a rural residence on
the smaller 2 acre parcel, on the Northeast corner of the farm. The use
of the larger parcel 73 acres will remain the same (irrigated farmland)
and both are consistent and compatible with existing surrounding
land uses.
3) This proposal is consistent with the policies of the Weld County
Comprehensive Plan for the following reasons:
a) The farmland of the existing farm will remain as farmland. The
land will be farmed by the applicant.
b) This change does not promote business or industries in the existing
Agricultural Zone.
c) This split will not reduce the productivity capability of the existing
farm (larger parcel), and in fact will increase management of the farm
to better the productivity of the farm.
4) This proposal is consistent with the Agricultural Zone District
because the larger parcel will remain as farmland. The uses of the
proposed new larger and smaller parcels will neither interfere with
nor be incompatible with the neighboring Agricultural Zone for the
above reasons.
5) The uses permitted in the proposed change will be compatible with
future development of the surrounding area as permitted by the
existing Agricultural Zone and with future development as projected
by the Comprehensive Plan of Weld County. Smaller parcel with rural
dwelling and the larger parcel as farmland same as to the North, South,
East and West of the Property.
6) The proposed split is consistent with the efficient and orderly
development of the immediate surrounding properties. This does not
interfere with any of the neighbors of their farm operation.

7) The proposed smaller lot qualifies for a domestic well, septic system
or North Weld water tap. Attached is a letter of Intent from North
Weld County Water District. The proposed larger lot has a registered
irrigation well. Subject property is not located in a flood plain,
geologic hazard, nor the Weld County Airport overlay district.
e) The Sketch Plan Map is attached to this application.
2. A Certificate of Conveyance is enclosed from United Title of Greeley.
3. Enclosed a check in the amount of $825.00 payable to the Department of
Planning Services to cover the cost of processing the Application. The
recording fees will be paid at the time of filing the approved exemption plat.
When this Recorded Exemption is approved, a plat as described in your Recorded
Exemption Procedural Guide will be submitted to the Department of Planning
Services for recording by the Weld County Clerk and Recorder.

approval criteria of the Weld County Subdivision Ordinance, you will he notified
that the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners
will then consider your application and make a final decision on the recorded
exemption.
It is the policy or Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Ault Planning Commission for its review and comments. It
is recommended that you and/or a representative be in attendance at the Ault Planning
Commission meeting to answer any questions the Commission members may have with
