RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER REQUEST FOR
AMENDED SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT - ROGGEN FEEDLOT/RICHARD HESSEE
WHEREAS , the Roard of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the -Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 1Dth day of October, 1990 , at the hour of 10 : 00
a.m. , in the Chambers of the Toard for the purpose of considering
the request of Roggen Feedlot/Richard Hessee for an Amended Site
Specific Development Plan and Special Review Permit for expansion
of a commercial cattle feedlot (12 ,400 head) , and
WHEREAS, at said hearing, the Board deemed it advisable to
continue said hearing to December 12 , 1990 , at 30: 0-0 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of Roggen Feedlot/Richard Tessee for an
Amended Site Specific Development Plan and Special Review Permit
be, and hereby is, continued to December 12 , 19-90, at 1-0 :-O0 a.m.
-The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th -day of
October, A.D. , 199-0 .

RE: AMENDED SPECIAL USE PERMIT FOR EXPANSION OF COMMERCIAL CATTLE
FEEDLOT (12,400 HEAD) - ROGGEN FEEDLOT/RICHARD HESSEE
A public hearing was conducted on October 10, 1990, at 10:00 A.M. , with
the following present:
Commissioner Gene R. Brantner, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C.W. Kirby
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Shelly Miller
Assistant County Attorney, Lee Morrison
Planning Department representative, Lanell Curry
Health Department representative, Wes Potter
The following business was transacted:
I hereby certify that pursuant to a notice dated September 12, 7990,
and duly published September 27, 1990, in The New News, a public
hearing was conducted to consider an Amended Special Use Permit for the
expansion of a commercial cattle feedlot (12,400 head) requested by
Roggen Feedlot/Richard Hessee. Lee Morrison, Assistant County
Attorney, made this matter of record. Lanell Curry, Planning
Department representative, entered the unfavorable recommendation of
the Planning Commission into the record. Ms. Curry said the Planning
staff recommends the addition of one Condition of Approval and one
Development Standard if the Board approves the request. Mike Callahan,
Attorney representing the applicant, reviewed the Findings of the
Planning Commission. Tom Cope, from Total Engineering, explained the
water containment of the facility. Mr. Callahan then reviewed the
Special Review Permit standards. Mr. Cope explained the sprinkling
system which will be installed in all pens within three to five years
if the expansion is approved. Dean Settje, from Colorado Cattle
Feeders Association, made comments on the cleanliness of the existing
feedlot. Bruce Kauffman, Kristie Cuykendall, Fred Hubbs, surrounding
prposrty owners, and Steve Conner, _beef nutrionalist, spoke in favor of
this request. Richard Hessee, applicant, made comments at this time.
Mr. Hessee and Mr. Cope answered questions of the Board concerning the
present ponds, installation of the sprinkling system, and seepage and
drainage. Wes Potter, Health Department representative, stated the
existing pond may not be sufficient. There was further discussion
concerning some discharge from the pond. Mr. Hessee said he is willing
to meet the criteria o₹ the Health Department.
Let the record reflect that the Board recessed for lunch at this time
and reconvened at 12:30 p.m.
Steve Williamson, Attorney representing the Shoeneman family, spoke in
opposition to this request. He stated concerns about drainage, well
contamination, and high pressure gas lines. Joel Shoeneman; Linda
Shoeneman; Mike Shoeneman, on behalf of his father, M. A. Shoeneman;
Stan Buchholz, on behalf of his mother, Marie Buchholz; Gerald Sigg;
Jeanie Benson, on behalf of her husband, Steve Benson; Richard Parker;
Michelle Miller; Harold Eker; Charles Klausner; Kris Bell; Mag
Shoeneman; Pat Buchholz; and Joe Sigg, all surrounding property owners,
spoke in opposition to this request. Norman Moser -spoke in favor of
this request. Mr. Potter and Ms. Curry, in response to the Board,
explained how violations are handled in their departments.
Let the record -reflect that Chairman Brantner excused himself at this
time to attend a previous engagement.

CERTIFICATION - ROGGEN FEEDLOT/HESSEE
Mr. Potter recommended that samples be taken from the pond, the
continuous flow of drinking water be stopped, and that no dipping vat
be used. Ms. Curry said the continuous _flow of drinking water has been
stopped. Mr. Potter made comments on the evacuation of the pond. Mr.
Cope said they are willing to work with the Health Department's
approved Plan. Mr. Callahan made _comments on drainage and evacuation
of the pond; well contamination; adequacy of water; wind, dust, odor,
and flies; the easement for a surrounding gas company; manure handling
and removal; and the dipping vat. Keith Tempel, Attorney, presented
the closing rebuttal. Commissioner Kirby stated his xoncerns about the
size and density of the feedlot and how the runoff is to be maintained;
the size and adequacy of the liner of the pond; and the design work for
this facility. Mr. Potter said the ponds should be expanded in order
to maintain the runoff, and he said he is concerned about the method of
disposal. Commissioner Lacy questioned the total acreage owned by Mr.
Hessee. There was some discussion about continuing this hearing for
evidence of the handling and disposal of the runoff and/or the design
work. Commissioner Kirby moved to continue this matter to December 12,
199-0, at 10:00 a.m. Commissioner Lacy seconded the motion. After
further discussion, Commissioner Kirby amended his motion to include
that public testimony would be limited to new information only.
Commissioner Lacy agreed. The motion carried unanimously.
This Certification was approved on the 15th day of October, 1990.
