Dear Commissioner Webster,
On March 11, 1992 a representative from the Weld County Department
of Engineering spoke with our Director of Public Works regarding
the piece of property we previously offered the County for
consideration of earthwork on Belmont.
When this was brought to my attention I suggested that any requests
regarding this property be made to me via the Commissioners' Office
so that the communications were clear and there was no
misunderstanding of our intended offer for the use of this
property.
You stated you were told to call me and strongly suggest the City
consider selling the property to Mr. Salazar, but you didn't know
why. You also indicated the County intended to purchase the right-
of-way necessary from Mr. Salazar and that we could make our own
deals with Mr. Salazar regarding the sale of our property to him.
I believe the reason you were requested to contact me on the
property issue is that Mr. Salazar would like the .845 acres to
replace the land he is losing for County right-of-way.
We informed Mr. Salazar on February 25, 1992 that our only interest
in releasing this property was for consideration of earthwork from
Weld County on our cooperative road project in the effort to
realign Brantner Road.

We never intended to sell the property to any private interest, but
believed we could justify deeding this land to Weld County so the
County could use it in trade for right-of-way easements needed from
Mr. Salazar.
Thus came our request for earthwork from Weld County for the
property deed. We believe this would have been most beneficial to
all taxpayers and the property owner (Mr. Salazar) . It seems
illogical to stop roadwork which is contiguous when there is
justification to present to the taxpayer that the earthwork was
being paid for by land. In addition, the road came into existence
when the County approached the City of Evans searching for a way
to place truck traffic from the County to Highway 85 at a safer
angle than was provided by Brantner Road.
Different alternatives were discussed and eventually the road and
agreement between the City of Evans and Weld County was made.
We believe this project makes much sense and is a benefit to the
County Community and the Evans Community alike. I have the
distinct impression the Commissioners believe this project is all
for the benefit of Evans. Please be reminded that the road was
conceived because we saw it as a benefit respectively.
Finally, I find it difficult to accept the reasoning that the
County Taxpayer outside City limits would object to this
cooperative effort and expense. The County Taxpayer inside the
City limits seems to have been given less consideration in your
concerns regarding this project.
Be that as it may, the City of Evans has arranged for the earthwork
discussed earlier. We remain committed to working cooperatively
with the County on this project and support it's successful
conclusion.
We are currently in the construction phase and would request the
$20, 000 placed in escrow received from Associated Natural Gas as
was previously agreed.

Dear Mr. Salazar,
On February 11, 1992 the Planning and Zoning Commission reviewed
your request concerning City owned property adjacent to your
property located at 1799 49th Street.
The consensus of the Planning and Zoning Commission was to retain
the 2. 078 acres of land due to the possibility of the property
being more conducive to development within the City of Evans. The
Commission also agreed the "swap" of the . 845 acres would be
acceptable, provided the County is willing to meet the conditions
of the agreement in regard to earth work along Belmont Avenue.
However, the County was not agreeable to trading the property for
the earthwork the City was requesting. Therefore, the City of
Evans has no interest in leasing or selling the property at this
time.
