MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding ( "Memorandum" ) is between Weld.
County ("Grantee") and the Weld County Housing Authority ("PHA")_ This
Memorandum sets forth the understanding's of the parties concerning the
Grantee's Rental Rehabilitation Program ( "Program" ) approved by the
U.S. Department of Housing and Urban Development ( "HUD") pursuant to
Section 17 of the United States Housing Act of 1937 (42 USC 1437o).
The grantee has received fiords in Federal Fiscal Year 1989 for its
Program to finance the rehabilitation of rental properties for the
benefit of lower-income families. HUD has approved the PHA's
application for housing assistance funds under the Section 8 Existing
Certificate/Housing Voucher Program, ("Certificate/Voucher Program").
The Grantee's Weld County Housing Authority is responsible for the
daily administration of the Program and for carrying out the terms of
this Memorandum. The Weld County Housing Authority is responsible for
managing the provision of Section 8 assistance to tenants occupying
projects assisted with Program funds and for carrying out the terms of
this Memorandum.
The Grantee and the PHA hereby agree as follows:
1. The Grantee will carry out its Rental Rehabilitation Program
in. accordance with;
a.. Section 1.7 and other applicable Federal laws; and.
b_ the regulations of 24 CFR Part 511 and Part 887.
2. The PHA will administer the Section 8 Existing Certificate/
Housing Voucher Program funding provided by HUD for the
Grantee's Program in accordance with:
a_ Section 8 and other applicable Federal laws;
b. the regulations in 24 CFR Part 882;
c. the regulations in 24 CFR Part 887;
d. other HUD regulations and requirements including; the
Grantee's program description and Tenant Assistance
Policy, and the ACC between HUD and the PHA, and the
PHA's Administrative Plan and Equal Opportunity Housing
Plan and Equal Opportunity Housing Plan approved by HUD.

3. The Grantee and the PHA agree to the following schedule of
meetings to discuss program progress, and any problems that
may, or have, developed with the provision of Section 8
assistance, or the completion of an assisted project:
'Meeting of the Weld County Housing Authority Board; Fourth
Tuesday of each month. )
4. The Grantee agrees to carry out. its Rental Rehabilitation
Program in accordance with the schedule in its Program
Description submitted to and approved by HUD.
. The Grantee will notify the PHA when a property has been
selected for assistance, and will request that the PHA
inspect the property to identify Section 8 Housing
Quality Standards (HQS) deficiencies that must; be
e+;rreoted by the rehabilitation. The Grantee and the FHA
will provide a written list of defioiencie ; to the

be prepared and submitted to HUD.

For eligible families residing in the projects to be
rehabilitated, whether or not they stay in the projects after
rehabilitation or move. the PHA shall issue Certificates/
Housing Vouchers sufficiently in advance of the time housing
assistance payments will begin to give families time to locate
.Mother unit (when they are required to move). The Grantee
will give the WCHA 30 days notice of the actual need for
issuance of Section 8 Certificates/Housing Vouchers (or if
less than this, the maximum feasible notice for a given Rental
Rehabilitation project). The notice will state the number of
Certificates/Vouchers needed and the approximate bedroom
sizes.
6. The PHA agrees to use the 10 percent discretionary Portion of
its annual allocation of Certificates/Housing vouchers to
assist tenants in a project whose monthly rent payments is
between 30 and 50 percent of income.
7. The PHA will assist tenants in a Rental Rehabilitation project
who qualify for a Federal preference before other preference
holders.
Eh The grantee will notify the PHA and HUD when its Rental
Rehabilitation funds have been expended and. housing assistance
funding is no longer needed for the grantee's program. •
9. The PHA shall provide the Grantee, upon request, with any
information concerning characteristics of families initially
assisted by the Certificate/Housing Vouchers (i.e. , family
income, size, ethnicity, etc. ) which might be required by the
Grantee for reporting purposes.
10. The PHA understands that certain persons not usually assisted
under the Section 8 Existing Housing Program may be eligible
to receive rental assistance under the Grantee's Program.
These include:
a. Non-elderly/non-handicapped. single persons; and.
b_ persons or families whose income falls between 51% and.
80% of the median income for the area.
11. The PHA agrees to provide information on available vacant
units in projects assisted with Rental Rehabilitation funds to
tenants on the waiting list who receive a Certificate/Voucher.

12. Before HULA and the PHA execute an ACC for the housing:
assistance funding provided for Section 8 Housing Vouchers in
support of the Grantee's Program, the PHA shall certify to HUD
that the PHA and the Grantee have entered into a Memorandum
of Understanding, and that the Memorandum of. Understanding is
consistent with the PHA"s HUD approved. Administrative and.
Equal Opportunity Housing Plans. The parties understand that
if there is an inconsistency between the PHA's Administrative
Plan (including any HUD approved amendments of the plan) and.
the Memorandum, the Administrative Plan shall prevail.

Program
The attached Memorandum of Understanding relating to the Rental Rehabilitation
program was approved by the Weld County Housing Authority Board on this date.The
Memorandum formalizes the relationship between the County and the Housing
Authority in the administration of the Rental Rehabilitation program. HUB now
requires State grantees to enter into such an agreement even though the Housing
Authority is administering both the rehabilitation component of the program
and the housing assistance which is available to certain tenants bf specific
projects.
We now need County Board approval of the M 0 U. Request that the item be placed
on the agenda for consideration.
