RE: ACTION OF BOARD CONCERNING TAX ABATEMENT PETITION FROM TEXAS-OHIO POWER,
INC. - 1993 VALUATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Tax Abatement Petition from
the Colorado Division of Property Taxation on behalf of Texas-Ohio Power, Inc. ,
800 Gessner, #1030, Houston, Texas 77024, for State-assessed property for 1993,
and
WHEREAS, a hearing before the Board was held on August 17, 1994, at which
time the Board deemed it advisable to continue said matter to August 24, 1994,
and
WHEREAS, at said hearing on August 24, 1994, the Board deemed it advisable
to continue said matter to September 7, 1994, at 9:00 a.m. , to allow time for
negotiation between Texas-Ohio Power, Inc. and the Colorado Division of Property
Taxation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that this matter be, and hereby is, continued to September 7,
1994, at 9:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 24th day of August, A.D. , 1994.

Request for continuance of Hearing on etition for
subjectAbatement or Refund of Taxes -- Texas-Ohio Power
Inc.
On Monday, August 22 , 1994 I received a telephone call from
Stephanie Tutthill, Attorney for Texas-Ohio Power, Inc. As you may
recall, the Petition for Abatement for Texas-Ohio Power was
continued from August 17, 1994 to August 24, 1994 . The continuance
was requested by Texas-Ohio Power so that the company and the
Division of Property Taxation could confer on the amount of the
abatement being requested.
Ms . Tutthill asked that the hearing be continued to September 7 for
two reasons :
1 . She does not have adequate child care for either
August 24 or August 31, 1994 . She believes that she
needs to be in Denver on those two mornings so that she
can be with her kids .
2 . Texas-Ohio Power and the Division of Property Taxation do
not have an agreement yet on the amount of the requested
abatement. Ms . Tutthill fully expects that they will
have some resolution to the request by September 7, 1994 .
I recommend that the Board continue the matter to September 7,
1994, at which time Richard Timberlake and Stephanie Tutthill will
be present.
