HomeMy WebLinkAbout900385.tiff RESOLUTION RE: APPROVE WAIVING TIME LIMIT REGARDING RENEWAL OF TAVERN LIQUOR LICENSE, WITH EXTENDED HOURS - LUCKY STAR CORPORATION, DBA LUCKY STAR BAR AND GRILL, AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 18th day of April, 1990, the Board did approve the request of Lucky Star Corporation, dba Lucky Star Bar and Grill, for renewal of a Tavern Liquor License, with extended hours, and WHEREAS, said application was submitted to the Board less than 45 days prior to the date of expiration, as required in Section 12-46-103 (13) , CRS, as amended, and WHEREAS, the Board determined that there was good cause to waive the time requirement as set forth in said Section, and WHEREAS , the Board deems it appropriate to authorize the Chairman to sign a letter authorizing the applicant to continue the sale of malt, vinous, and spirituous liquor until the State-approved license is received. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the time requirement as set forth in Section 12-46-106 (13) , CRS, as amended be, and hereby is, waived concerning the renewal request of Lucky Star Corporation, dba Lucky Star Bar and Grill, for renewal of a Tavern Liquor License, with extended hours. The previous license did expire on April 18, 1990; therefore, the Board did formally waive the 45-day time limit, said waiver being effective as of April 18, 1990. The required documents have been submitted to the State Department of Revenue for its approval. Until notification has been received from the State advising whether this renewal request has been approved or disapproved, the Board hereby authorizes the continued sale of Malt, Vinous, and Spirituous Liquor at this establishment which is located at 33131 Highway 85, Lucerne. Colorado. The Lucky Star Corporation sent their application to the State rather than to our office; therefore, they are requesting the Board to consider waiving the 45-day time limit required by the State. Also, if the Board deems it appropriate, we can prepare a document, which would be signed by the Chairman, stating that Lucky Star may continue to sell liquor until the license is returned from the State.
