RE: ASSESSMENT OF COST OF IMPROVEMENTS FOR WELD COUNTY ROAD 38 LOCAL
IMPROVEMENT DISTRICT NO. 1992-4
A public hearing was conducted on November 3, 1993, at 9:00 A.M. , with the
following present:
Commissioner Constance L. Harbert, Chairman
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Carol Harding
County Attorney, Bruce Barker
County Engineer, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a notice dated September 27, 1993, and
duly published September 30, 1993, in the Windsor Beacon, a public hearing
was conducted to consider the assessment of costs for the Weld County Road
38 Local Improvement District No. 1992-4. Bruce Barker, County Attorney,
made this a matter of record and stated the only objection received is
from Gil Olson, who is in attendance at today's hearing. Mr. Barker noted
the Notice of Hearing was mailed to the affected property owners on
September 29, 1993. Drew Scheltinga, County Engineer, stated the project
was to pave Weld County Road 38 between Highway I-25 and Weld County
Road 7. He also stated the project has been completed to his satisfaction
at a total cost of $60, 493.65; however, the petition for the district
established a maximum cost of $55,000.00 to be assessed to the district.
Therefore, Mr. Scheltinga recommended the Board assess each of the twenty-
six lots and two parcels at $1, 964.29. Gil Olson, property owner, spoke
briefly about his reasons for requesting relief from a separate assessment
on each of his two parcels and explained he has both parcels planted in
wheat at present. He reminded the Board there are no improvements on his
parcels, and he has been in favor of the district all along. Since Mr.
Olson feels the nearby subdivision received the most benefit from the
project, he feels it inappropriate to assess his two parcels in the same
manner. Mr. Scheltinga explained, in response to Commissioner Webster,
the County normally absorbs the cost overrun for a Local Improvement
District when a County road is paved; however, the district usually
assesses the full cost when the roads in a subdivision are paved. There
was no other public testimony offered concerning this matter.
Commissioner Baxter moved to find the assessment of Weld County Road 38
Local Improvement District No. 1992-4 to be just and equitable, and to
apportion equally among twenty-six lots and one parcel an assessment of
$1,964.29, thus forgiving Mr. Olson's assessment on PIN #4703586.
Seconded by Commissioner Webster, the motion carried unanimously.
