RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A SOLID WASTE DISPOSAL SITE AND FACILITY - WASTE SERVICES CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of June, 1990 , at the hour of 10 :00 a.m. in the Chambers of the Board for the purpose of hearing the application of Waste Services Corporation, c/o Brad Keirnes, 6037 77th Avenue, Greeley, CO 80634 , for a Site Specific Development Plan and Special Review Permit for a solid waste disposal site and facility located in the A (Agricultural) Zone District on the following described real estate , to-wit: The SW} of Section 7, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Brad Keirnes, president of Waste Services Corporation, and John Houtchens, Attorney, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant, the recommendations of the Weld County Planning Department and the Weld County Health Department and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 O£ the Wald County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has showy, compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposed use is located in an agricultural area and the 170-acre parcel is currently used for dryland farming. The soils located on this parcel are considered non-prime agricultural land. The operation of the proposed use will not interfere with agricultural activities in this area. For 900564 Page 2 RE: USR - WASTE SERVICES CORPORATION these reasons, the proposed use complies with the Comprehensive Plan ' s Agricultural Goals and Policies. b. The proposed use conforms to all applicable federal, state, and local regulations. The site design, facility operation plan, Conditions of Approval, and Development Standards will make the use compatible with the surrounding agricultural uses. For these reasons , the proposed use complies with the Comprehensive Plan' s Environmental Quality and Natural Resource Goals and Policies. c. The proposed use is located in the A (Agricultural) Zone District. The parcel is used for dryland farming, and prime farm land would not be removed from production. The proposed Conditions and Development Standards will make the use consistent with the intent of the A (Agricultural) Zone District. d. The proposed use will be compatible with the existing surrounding land uses. Surrounding land use activities include dryland and irrigated farming operations. e. The proposed use will be compatible with the future development of the surrounding area. The surrounding area is intended to remain agricultural and provide for the conduct of other uses by right, accessory uses, and uses by special review in the A (Agricultural) Zone District. f. The proposed use is not located in an Overlay District area. g. The applicant has selected a parcel used for dryland farming in the locational decision for the proposed use. h. The Conditions of Approval and Development Standards provide adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County. i. The submitted application materials demonstrate a need for the proposed solid waste disposal site and facility. The northern Weld County area does not have a long range, cost effective, solid waste 900564 Page 3 RE: USR - WASTE SERVICES CORPORATION disposal facility. The landfill located in the Town of Nunn has been closed. The Eaton landfill located two and one-half miles northeast of Eaton, which also serves a portion of northern Weld County, is scheduled for closure in April, 1991, or when it' s full, whichever comes first. The nearest regional landfill is the Central Weld Landfill. This 108-acre landfill is located two miles northeast of the Town of Milliken. The proposed site has a primary service area of approximately 339 square miles with a population of 20 ,000 people. The service area includes the Towns of Ault, Eaton, Nunn, Pierce, Severance, and Windsor. The service area also includes a portion of northern Greeley and inhabitants of unincorporated Weld County. j . The proposed site has been recommended for approval by the Colorado Department of Health and the Weld County Health Department. The site will provide a long range, cost effective facility capable of meeting the existing and future needs of the service area population. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a solid waste disposal site and facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat . The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within sixty (60) days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording the special review plat: a. The applicant shall submit a revised cover and revegetation plan approved by the Colorado 900564 Page 4 RE: USR - WASTE SERVICES CORPORATION Department of Health. The plan shall be reviewed by the Greeley Soil Conservation Office and its recommendation submitted to the Colorado Department of Health and Department of Planning Services. The plan shall consider the requests of the Colorado Division of Wildlife. The plan shall outline the design effect of a 25-year, 24-hour precipitation event on the crown and area created by the four to one sideslope. The integrity of the crown shall be addressed. The seeding of the sideslope shall include all sod forming species. The plan shall also consider the effects of wind erosion at the site. b. The applicant shall submit a revised leachate collection and removal system approved by the Colorado Department of Health. c. The applicant shall submit a performance agreement guaranteeing closure and post-closure monitoring of the solid waste disposal site and facility. The agreement shall outline the costs associated with closure and post closure monitoring. The Board of County Commissioners shall approve the agreement and the form of performance guarantees. The agreed upon guarantee shall be submitted to Weld County. d. The applicant shall submit a landscape plan for the 200-foot setback area along the south property line, and for the additional area on the parcel east and adjacent to the property as described in the June 22 letter from Mr. Brad Keirnes. The plan shall be referred to the Greeley Soil Conservation Service and Division of Wildlife for review recommendations. The plan shall be approved by the Department of Planning Services. e. The plat shall be amended to show: 1. A total of 75 feet of right-of-way reserved from the centerline on the north side of State Highway 14 . 2 . The boundaries of the four phases used for the waste filling. 3 . The boundaries of the approved landscaped plan. The type, size, and location of plant 900564 Page 5 RE: USR - WASTE SERVICES CORPORATION material within the landscaped area shall be identified. f. The applicant shall submit an agreement for the construction of right-turn deceleration and acceleration lanes and left turn deceleration and acceleration lanes approved by the Colorado Division of Highways. The plat shall be amended to show the right-turn and left-turn deceleration and acceleration lanes. g. The applicant shall submit a letter from the Colorado Division of Highways stating that the design of the surface runoff flow toward the highway drainage system has been reviewed, and it will not exceed the historical runoff rate. h. The applicant shall submit a road improvement and maintenance agreement for Weld County Road 25 . The agreement shall be approved by the Board of County Commissioners . The Site Specific Development Plan and Special Review Permit is for a solid waste disposal site and facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. Only 119 acres of the 170-acre parcel shall be used for phased waste filling. The maximum height of the final grade shall not exceed an elevation of 5, 210 feet above mean sea level. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Only household, industrial, and commercial solid waste shall be accepted. This includes only non-hazardous, non-radioactive waste. No liquid waste of any nature, including semi-solid sludges and septic tank pumpage, shall be accepted. All waste received at the facility shall be inspected by all practical means available to insure the appropriate wastes are being disposed at the facility. The hours of operation shall generally be between 7: 00 a.m. and 4 :30 p.m. , Monday through Saturday. The facility will be closed on major legal holidays. 4 . A manager, knowledgeable in operating a solid waste disposal facility, shall be on the site when the facility is receiving waste. 5. Each phase shall be constructed for waste filling by excavating, lining the active area, placing a leachate collection system, filling with waste, and cover. A letter from the Weld County Health Department and Colorado Department of Health authorizing the use of phases 2, 3 .a, and 3 .b shall be delivered to the Department of Planning Services before using these phases. 6 . The size of the working face shall not exceed 150 feet in width and 15 feet in depth. 7 . The clay liner and cap shall meet the following requirements: a. The construction of liners shall be supervised by a Colorado Registered Professional Engineer. The engineer shall submit a final evaluation report on the construction of each liner segment. The report shall certify the liner meets the required specifications. This report shall be reviewed for approval by the Weld County Health Department and Colorado Department of Health. 900564 Page 2 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION b. A two-foot thick clay liner with a maximum permeability of 1 .0 x 10 to the power of minus 7 centimeters per second shall be installed following excavation to final depth. The clay liner shall be placed in six (6) inch lifts and compacted with a sheepsfoot compactor until it reaches a compacted dry density equal to or greater than 95.0 percent of the standard protector density (ASTMD-698) . The moisture content o£ the material shall be maintained from zero to four percent of the optimum moisture content. The material used for the liner shall have a plasticity index greater than ten, and have greater than 50 percent of the material passing a number 200 sieve. c. Geotechnical testing shall be completed prior to material installation to ensure the liner meets the proper specifications . This shall include the collection of a representative sample from each 3 ,000 cubic yards of intended liner material and from each 6 ,000 cubic yards o£ cap material. Testing shall include a standard protector density test, a number 200 sieve wash, and plasticity index test. d. An independent soil and material testing firm shall observe and test materials placed for the liner and cap. This testing shall include the compaction density and moisture content at no less than a 100-foot spacing for each six-inch lift of liner material and 300-foot spacing for each six inches of cap material. e. The compacted cap material shall pass a minimum of 90 percent standard protector density test. f. The completed portion of each phase shall be covered with topsoils and revegetated as soon as practically possible. The cover will be a minimum of three and one-half feet thick with the bottom two feet consisting of compacted clay, one foot consisting of unspecified soil, and one-half foot of topsoil for reclamation. g. To ensure that adequate material is available for the liner, daily cover and cap, an annual material balance shall be made by a qualified engineer. 900564 Page 3 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION 8 . The facility shall be operated in a manner which protects against surface and groundwater contamination. A groundwater monitoring plan, including leachate detection and groundwater monitoring wells, periodic sampling, and monitoring shall be implemented by the facility operator. This plan shall be reviewed and approved by the Colorado Department of Health and the Weld County Health Department. The plan shall be reviewed at least once every two years by the State and County Health Departments. Changes and updates to the plan shall be facilitated by the operator as required by the reviewing agencies . 9 . The leachate collection system shall be placed above the clay liner in the bottom of each phase. This shall consist o£ a six-inch outside diameter schedule 80 , perforated PVC drain pipe installed in the bottom center of a 24-inch keyway. A 12-inch outside diameter steel riser pipe shall extend from the base of the sump to the surface beyond the filling area. 10 . Surface water run-on shall be controlled to ensure that it will not be allowed to enter the active working face. Also any surface water which falls on the working face will not be allowed to leave the site. 11 . The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall be accomplished in a manner that controls blowing debris. Any debris found outside the working face or adjacent to the facility will be picked up within 24 hours. The fence on the perimeter of the property, State Highway 14 , Weld County Road 25, and roads on the perimeter of the waste disposal facility, shall be patrolled daily by the facility staff to assure trash is picked up. The manager of the facility will respond to requests for picking up trash along these routes within 24 hours of notification by County Health Department personnel. The following operational measures shall also be employed to control blowing litter at the site: a. At the end o£ each day, application of six inches of soil cover shall be placed over the working face. Soil cover will be placed on waste as soon as possible on days when wind is a noticeable problem. 900564 Page 4 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION b. The working face shall be enclosed on three sides with a minimum 15-foot screen while accepting waste. A five-foot fence shall enclose the cell containing the working face. A six-foot fence shall be placed along the property lines of the 170-acre parcel. c. During windy periods not defined as high winds according to State Health Regulations , the size of the working face shall be reduced if trash is escaping the three- sided 15-foot screen around the working face. The working face shall be reduced to a size that eliminates trash escaping from the screen. d. Prior to accepting waste, a letter, approved by the Department of Planning Services ' staff, shall be mailed to all surrounding property owners within one-half mile of the landfill boundaries. The letter shall indicate the following information: i. The program that the landfill operators will use to pick up off-site windblown trash. ii. The name and telephone number of the person or persons to call for pick up of windblown trash. e. The operation shall cease during periods when high winds are present. High winds are defined in Section 1 . 2.31 of the Colorado Department of Health' s Solid Waste Disposal Site and Facilities Regulations. 12 . The site operator shall keep the following records on site to be available for County and State review: a. Quarterly inspection by an independent engineer. b. Litter policing reports. c. Volume and types of incoming waste. d. Results of wind, methane and water quality monitoring. e . Any special waste accepted at the facility. f. Construction quality assurance and control documentation. 900564 Page 5 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION In addition, the groundwater monitoring parameters shall be modified to include all parameters listed in the document submitted by the Colorado Department of Health titled, TABLE I, INITIAL BACKGROUND MONITORING. The first eight quarters of monitoring, or some portion of it, may be concurrent with landfilling. The applicant shall comply with Section 2 .2. 3 (b) and (c) of the Colorado Department of Health' s Solid Waste Disposal Site and Facilities Regulations in terms of the analytical method and statistical evaluation of groundwater monitoring data. Generally, if toxicity exceeds 300 parts per billion in any one sampling event, the operator shall include a volatile organic compounds analysis for all wells until further notice by the Colorado Department of Health. However, this requirement may be modified once background data is collected for the site. 13 . Operational inspections of the entire facility shall be made on a quarterly basis for the life of the landfill operation. The inspections shall be made by an independent contractor experienced with landfill operations. The inspections shall be made to ensure that the landfill operation is progressing in accordance with all aspects of the approved landfill plan. Inspection reports shall be prepared and submitted to both the Weld County Health Department and the Colorado Department of Health. 14 . A system of wet/dry monitoring wells shall be placed on 500-foot centers around the site and installed in a phased manner as landfilling occurs. These wells shall be tested for the presence of groundwater and methane gas. All wells shall be completed to a minimum of ten feet beneath the base of the landfill and with perforated intervals reaching to within ten feet of the surface of landfill. Construction of the wet/dry wells shall consist of a one-inch outside diameter, PVC casing, with glued joints placed in six-inch diameter borings . The casing shall be drilled or slotted. The annular space shall be gravel packed to approximately one foot above the slotted interval of the casing. The remaining annular space shall be backfilled with dry bentonite. Installation shall be as follows: 900564 Page 6 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION Phase 1 - - - wet/dry wells #15 to #22 . Phase 2 - - - wet/dry wells #6 to #14 . Phase 3a - - wet/dry wells #23 to #24 . Phase 3b - - wet/dry wells #3 to #5 . 15. The landfill owner shall notify the Colorado Department of Health and Weld County Health Department within five (5) working days if the following occurs: a. The leachate system shows the presence of liquids following the placement of the first lift. b. Groundwater monitoring results detect a greater than .01 variation from the background results, in accordance with Section 2 . 2. 3 (c) of the Colorado Department of Health's Solid Waste Disposal Sites and Facilities Regulations If determined by either department, confirmation testing will be required. If an environmental problem is confirmed, the operator will have an additional 30 days to evaluate the data and present a specific plan of action. 16 . A methane gas venting system shall be installed in the 12-inch outside diameter steel riser pipe. 17. The landfill operator shall maintain recycling bins at the landfill entrance to receive mixed glass, newspaper, aluminum, and recyclable plastic containers. 18 . Post-closure inspections shall include documentation of surface cracking, erosion, slope angles, drainage, and condition of vegetation. One o£ the inspections each year will be made in late spring, when damage would most likely occur due to thaw and run off. Any damage or other deficiencies shall be promptly repaired. 19. The facility shall be operated in a manner which controls odors. Odors detected off site shall not equal or exceed the level of 31-to-1 dilution threshold as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. 900564 Page 7 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION 20. Fugitive dust shall be controlled on site at all times. In the event that fugitive dust from the facility is determined to be a nuisance by the Weld County Health Department, a dust abatement plan shall be submitted within ten days to the Department for review and approval. Implementation of the approved dust abatement plan shall begin within 24 hours of approval by the County. 21 . The septic system for the proposed office shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 22. The maximum permissible noise level shall not exceed the industrial limit of 80db (A) , as measured according to 25-12-102 , Colorado Revised Statutes . 23 . In the A (Agricultural) Zone District, drilling for oil and gas is a use by right and mining requires approval of a Use by Special Review Permit. The landfill owner shall notify the Department of Planning Services prior to drilling for oil and gas. Prior to drilling, the Colorado Department of Health and the Weld County Health Department will review plans for drilling oil and gas on the 170-acre parcel. The review shall identify any impacts on the solid waste disposal facility and determine compliance with all applicable regulations . 24 . The office and maintenance buildings shall be painted and maintained in an earthtone color. 25 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 26 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 27. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 28 . Metal signs shall be posted at the customer entrance way. The signs shall be a minimum of three feet in width and four feet in length. 900564 Page 8 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION Sign #1 shall state: "ALL UNCOVERED LOADS SHALL BE CHARGED TWICE THE NORMAL FEE" Sign #2 shall state: "ABSOLUTELY NO HAZARDOUS OR TOXIC WASTES, SEPTIC OR LIQUID SEPTIC SLUDGE ACCEPTED" 29. During the life of the landfill, the applicant shall maintain advisory signs on State Highway 14 , if permitted by the Division of Highways. The signs shall advise landfill users the distance to the site and that all loads must be covered. 30. The property owner or operator shall be responsible for maintaining the approved landscape plan. 31 . The owner or operator shall comply with Weld County Ordinance 53 . 32. The Use by Special Review shall not be transferred to another operator or to any successors in interest or lessee of the described property for operation of the facility without written approval from the Board of County Commissioners. 33 . Personnel from the Weld County Health Department, Weld County Department of Planning Services , and Colorado Department of Health shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 34. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 900564 Page 9 RE: DEVELOPMENT STANDARDS - WASTE SERVICES CORPORATION 35. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 36 . The applicant shall construct right-turn deceleration and acceleration lanes and left-turn deceleration and acceleration lanes prior to accepting and disposing of any landfill waste. The engineering design shall be approved by the Colorado Division of Highways. 900564 HEARING CERTIFICATION DOCKET NO. 90-20 RE: SPECIAL REVIEW PERMIT AND CERTIFICATE OF DESIGNATION FOR SOLID WASTE DISPOSAL SITE AND FACILITY - WASTE SERVICES CORPORATION A public hearing was conducted on June 27, 1990, at 10:00 A.M. , with the following present: Commissioner Gene R. Brantner, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C.W. Kirby Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Rod Allison Health Department representative, Wes Potter The following business was transacted: I hereby certify that pursuant to a notice dated May 23, 1990, and duly published June 14, 1990, in The New News, a public hearing was conducted to consider a Special Review Permit and a Certificate of Designation for Waste Services Corporation, c/o Brad Keirnes. Lee Morrison, Assistant County Attorney, made this matter of record. Mr. Morrison said this request is for a solid waste disposal site and facility to be located in the Agricultural Zone District. Rod Allison, representing the Department of Planning Services, read the Planning Commission's recommendation for denial into the record. (Let the record reflect that during this hearing the Board was presented with Exhibits R through CC which were marked into the record by Mr. Morrison.) Brad Keirnes, president of Waste Services Corporation, came forward to make his presentation. Mr. Keirnes showed slides of his current landfill site and also the site for the proposed landfill. Mr. Keirnes introduced the following people who came forward and spoke in favor of this proposal: Gary Carsten; Jack Cazel; Kathy Schulte; Anita Comer; Bill Hedberg; Kevin Taylor; Mike Stewart; and John Houtchens, Attorney representing Waste Services. Let the record reflect that a lunch break was called at this time. Upon reconvening, Mr. Keirnes resumed his presentation. He addressed several concerns of the citizens, and explained how these concerns will be met. Rob Cassidy, architect, explained that trees will be planted to mitigate the visual impact of the landfill. Mr. Keirnes said a drip-water system will be installed at the site to water the trees and shrubbery. He proposed that the height of the landfill be reduced an additional 50 feet from that stated in the amended application. Mr. Keirnes addressed several issues, including the filling, which will be done in phases; how rodents and wind blown debris will be controlled; traffic impact, both on the highway and the school; fugitive dust, and the improbability of ground water leaks. Wes Potter, representing the Health Department, gave a brief overview of the proposed site. He said the proposed facility is designed to meet very stringent regulations. Tom Hellerich, Attorney representing the Town of Ault and various landowners in that area, came forward to make his presentation. Mr. Hellerich submitted additional petitions containing 1,215 signatures. He said there are now over 3,000 signatures of Weld County residents opposed to this facility. Mr. Hellerich said the Town of Ault has nine specific items of concern, and he commented on each item. (Tape Change #90-27 during Mr. Hellerich's presentation.) J.T. Mary Baiamonte came forward to make comments favoring this proposal. Mr. Hellerich made further comments at this time. Poul Poulsen, Engineer for the State Department of Health, commented on liners, saying they do not leak as much in Colorado because of the dry climate. He also said hazardous materials can be absorbed by the dry material. Mr. Poulson said if people are concerned about trash being brought into this landfill or any County landfill from out-of-state, there is a Bill before the Senate for restriction of this. He urged the audience to contact the State officials to voice any support of this Bill. Mr. Keirnes came forward to give his closing statements and answer questions of the Board. He addressed concerns about fire on the site, stating that this application has been reviewed by the Windsor-Severence Fire Protection District, and in addition there will be a water truck on site. Mr. Houtchens made further statements. He commented on the circulated petition, saying that a misconception was created by it, and he explained his reasons for stating this. Mr. Keirnes answered further questions of the Board. He said the final elevation of this proposal will be 50 feet above the maximum height at the site. At the conclusion of Mr. Keirnes' presentation, Commissioner Kennedy asked for a commitment stating that acceleration and deceleration turning lanes to be provided at the site. Mr. Keirnes said if the need exists, that capability would be provided. He said he has requested that the Division of Highways re-examine the site distance to the west for vehicles turning off the County Road onto the State Highway. Commissioner Kennedy asked if turning lanes are included as a Condition of Approval, would Mr. Keirnes accept this. Gary Wyatt, of Ault, made comments concerning the turning lanes, saying he spoke to the State Engineer who reviewed this application. Mr. Wyatt said the engineer stated that the turning lanes were not necessary at this time, but did not know who would be responsible for the lanes if they would be necessary in the future. He said he is not comfortable with this problem not being resolved at this time. Mr. Keirnes, after conferring with his attorney and engineer, agreed to install acceleration and deceleration lanes at the intersection with County Road 25. Mr. Allison read the recommended amended Conditions and Development Standards into the record as follows: 1. Condition D, on page 4 of the Planning Commission Resolution, the first sentence would read, "The applicant shall submit a landscape plan for the 200-foot setback area along the south property line, and for the additional area on the parcel east and adjacent to the property as described in the June 22 letter from Mr. Brad Keirnes." The remaining portion of this paragraph would remain as written. 2. Condition E(3) on page 4 of the Planning Commission Resolution would read, "The boundaries of the approved landscaped plan." The remaining portion of that paragraph would remain as written. 3. Condition F on page 4 of the Planning Commission Resolution would read, "The applicant shall submit an agreement for the construction of right-turn deceleration and acceleration lanes, and left turn deceleration and acceleration lanes approved by the Colorado Division of Highways." The remaining portion of the paragraph would remain as written. 4. Development Standard #1 would have the elevation of 5,260 feet changed to 5,210 feet. 5. Development Standard #30 would read as follows - "The property owner or operator shall be responsible for maintaining the approved landscape plan." 900564 Page 3 RE: HEARING CERTIFICATION - WASTE SERVICES CORPORATION 6. Add Development Standard #36 to read as follows - "The applicant shall construct right-turn deceleration and acceleration lanes and left-turn deceleration and acceleration lanes prior to accepting and disposing of any landfill waste. The engineering design shall be approved by the Colorado Division of Highways." Commissioner Kennedy made a motion, based upon the demonstrated need for a landfill in the northern part of Weld County; and based upon the traffic hazard problem being resolved, to approve this Special Review Permit for a solid waste disposal site and facility for Waste Services Corporation, subject to the amended Conditions and Development Standards. Commissioner Harbert seconded the motion. (Tape Change #90-28) Following discussion, the motion carried unanimously. Mr. Allison read the Planning staff's recommendation for approval of the request for the Certificate of Designation, subject to the following Condition: The property shall be maintained in compliance with Use by Special Review #895, all submitted application materials on file with the Department of Planning Services, and all requirements of the Weld County Health Department and Colorado Department of Health. Mr. Morrison said, because the Planning Commission recommended denial of the Use by Special Review, that motion was also a recommendation for denial of the Certificate of Designation, so Mr. Allison's recommendation for approval and recommended Condition are from the Department of Planning Services. Commissioner Kennedy moved to approve the Certificate of Designation for Waste Services Corporation, subject to the recommended Condition. Commissioner Harbert seconded the motion, and it carried unanimously. This Certification was approved on the 2nd day of July, 1990. Surrounding land use activities include dryland and irrigated farming operations. - The proposed use will be compatible with the future development of the surrounding area. The northern Weld County area does not have a long range, cost effective, solid waste disposal facility. The landfill located in the Town of Nunn has been closed. The Eaton landfill located two and one-half miles northeast of Eaton, which also serves a portion of northern Weld County, is scheduled for closure in April, 1991 , or when it's full, whichever comes first. The nearest regional landfill is the Central Weld Landfill. This 108 acre landfill is located two miles northeast of the Town of Milliken. The proposed site has a primary service area of approximately 339 square miles with a population of 20,000 people. The service area includes the Towns of Ault, Eaton, Nunn, Pierce, Severance, and Windsor. The service area also includes a portion of northern Greeley and inhabitants of unincorporated Weld County. 9( 0584 Waste Services Corporation USR-895 Page 3 The proposed site has been recommended for approval by the Colorado Department of Health and the Weld County Health Department. The site will provide a long range, cost effective facility capable of meeting the existing and future needs of the service area population. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. The attached development standards for the special review permit shall be adopted and placed on the special review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within sixty (60) days of approval by the Board of County Commissioners. 2. The special review activity shall not occur nor shall any building or electrical permits be issued on the property until the special review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the special review plat: A. The applicant shall submit a revised cover and revegetation plan approved by the Colorado Department of Health. The plan shall be reviewed by the Greeley Soil Conservation Office and its recommendation submitted to the Colorado Department of Health and Department of Planning Services. The plan shall consider the requests of the Colorado Division of Wildlife. The plan shall outline the design effect of a 25 year, 24 hour precipitation event on the crown and area created by the four to one sideslope. The integrity of the crown shall be addressed. The seeding of the sideslope shall include all sod forming species. The plan shall also consider the effects of wind erosion at the site. B. The applicant shall submit a revised leachate collection and removal system approved by the Colorado Department of Health. 9C 6 Waste Services Corporation USR-895 Page 4 C. The applicant shall submit a performance agreement guaranteeing closure and post closure monitoring of the solid waste disposal site and facility. The agreement shall outline the costs associated with closure and post closure monitoring. The Board of County Commissioners shall approve the agreement and the form of performance guarantees. The agreed upon guarantee shall be submitted to Weld County. D. The applicant shall submit a landscape plan for the 200 foot setback area along the south property line. The plan shall be referred to the Greeley Soil Conservation Service and Division of Wildlife for review recommendations. The plan shall be approved by the Department of Planning Services. E. The plat shall be amended to show: 1 . A total of 75 feet of right-of-way reserved from the centerline on the north side of Highway 14. 2. The boundaries of the four phases used for the waste filling. 3. The boundaries of the approved landscaped plan on the south side of the parcel. The type, size, and location of plant material within the landscaped area shall be identified. F. The applicant shall submit an agreement for the construction of a right-turn deceleration lane approved by the Colorado Division of Highways. The plat shall be amended to show the right-turn deceleration lane. G. The applicant shall submit a letter from the Colorado Division of Highways stating that the design of the surface runoff flow toward the highway drainage system has been reviewed and it will not exceed the historical runoff rate. H. The applicant shall submit a road improvement and maintenance agreement for Weld County Road 25. The agreement shall be approved by the Board of County Commissioners. The wind issue, the recycling alternatives, the traffic issues, the height of visual impact, and overall the compatibility of the neighborhood and the objections of the neighbors. He realizes that all the reviews from the State Department of Health and various County agencies are supportive, but those are of a technical nature that don't really reflect the impact on the neighbors. There must be other sites and technologies that would be more appropriate. Judy Yamaguchi - No. She goes along with what Bud Halldorson said plus the fact that she is concerned about the compatibility, the health, safety, and well-being, and the project at this given site. LeAnn Reid - No, for the reasons already stated. Rick Iverson - No. Bud Clemons - No. His concerns are for the location. He appreciates the amount of work the staff as well as the applicant have put into this, but it is clear to him that being located on a major State Highway is a number one concern from the citizens who have addressed the issue. It seems there ought to be an alternative location that would meet the criteria from a technical standpoint without interfering with the traffic flow and the perception that Colorado is trying to sell, i.e. , their magnificent beauty, etc. This project, at this site, would be a deterrent to that aspect. Jerry Kiefer - Thinks the plan is excellent and that is why, from a technical point of view, it has received high marks. The operator is trustworthy, and has done a good job in the present operation. We all agree landfills must be built and just because something is in ones backyard is no reason to deny it. He feels Ault, as well as any other community, needs its own waste taken care of, but along a major highway, in a most conspicuous place, does not seem appropriate to him. In the staff's recommendation, the reasons given for recommending approval said the closed use will be compatible and the proposed use will be compatible with the future development, and he does not think it is compatible in the location that it is being suggested. The State right now is working hard to eliminate problems from other parts of the State such as in the Colorado Springs area and the Ouray/Silverton area. Granted, those are almost permanent scars, but he thinks this might be one that exists for forty or fifty years, and to him, that is permanent enough. Ernie Ross - No. This is in the wrong location. It is in a beautiful spot. As long as we approve landfill operations there is no incentive to develop an alternative standard. 94 05'64 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS WASTE SERVICES CORPORATION USR-895 1 . The site specific development plan and special review permit is for a solid waste disposal site and facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. Only 119 acres of the 170 acre parcel shall be used for phased waste filling. The maximum height of the final grade shall not exceed an elevation of 5,260 feet above mean sea level. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Only household, industrial, and commercial solid waste shall be accepted. This includes only non-hazardous, non-radioactive waste. No liquid waste of any nature, including semi-solid sludges and septic tank pumpage, shall be accepted. All waste received at the facility shall be inspected by all practical means available to insure the appropriate wastes are being disposed at the facility. The hours of operation shall generally be between 7:00 a.m. and 4:30 p.m. , Monday through Saturday. The facility will be closed on major legal holidays. 4. A manager, knowledgeable in operating a solid waste disposal facility, shall be on the site when the facility is receiving waste. 5. Each phase shall be constructed for waste filling by excavating, lining the active area, placing a leachate collection system, filling with waste, and cover. A letter from the Weld County Health Department and Colorado Department of Health authorizing the use of phases 2, 3.a, and 3.b shall be delivered to the Department of Planning Services before using these phases. 6. The size of the working face shall not exceed 150 feet in width and 15 feet in depth. 7. The clay liner and cap shall meet the following requirements: A. The construction of liners shall be supervised by a Colorado Registered Professional Engineer. The engineer shall submit a final evaluation report on the construction of each liner segment. The report shall certify the liner meets the required specifications. This report shall be reviewed for approval by the Weld County Health Department and Colorado Department of Health. B. A two foot thick clay liner with a maximum permeability of 1.0 x 10 to the power of minus 7 centimeters per second shall be installed following excavation to final depth. 906564 Development Standards USR-895 Page 2 The clay liner shall be placed in six (6) inch lifts and compacted with a sheepsfoot compactor until it reaches a compacted dry density equal to or greater than 95.0 percent of the standard proctor density (ASTMD-698) . The moisture content of the material shall be maintained from zero to four percent of the optimum moisture content. The material used for the liner shall have a plasticity index greater than ten, and have greater than 50 percent of the material passing a number 200 sieve. C. Geotechnical testing shall be completed prior to material installation to ensure the liner meets the proper specifications. This shall include the collection of a representative sample from each 3,000 cubic yards of intended liner material and from each 6,000 cubic yards of cap material. Testing shall include a standard protector density test, a number 200 sieve wash and platicity index test. D. An independent soil and material testing firm shall observe and test materials placed for the liner and cap. This testing shall include the compaction density and moisture content at no less than a 100 foot spacing for each six inch lift of liner material and 300 foot spacing for each six inch of cap material. E. The compacted cap material shall pass a minimum of 90 percent standard protector density test. F. The completed portion of each phase shall be covered with topsoils and revegetated as soon as practically possible. The cover will be a minimum of three and one-half feet thick with the bottom two feet consisting of compacted clay, one foot consisting of unspecified soil and one-half foot of topsoil for reclamation. G. To ensure that adequate material is available for the liner, daily cover and cap, an annual material balance shall be made by a qualified engineer. 8. The facility shall be operated in a manner which protects against surface and groundwater contamination. A groundwater monitoring plan, including leachate detection and groundwater monitoring wells, periodic sampling, and monitoring shall be implemented by the facility operator. This plan shall be reviewed and approved by the Colorado Department of Health and the Weld County Health Department. The plan shall be reviewed at least once every two years by the State and County Health Departments. Changes and updates to the plan shall be facilitated by the operator as required by the reviewing agencies. Development Standards USR-895 Page 3 9. The leachate collection system shall be placed above the clay liner in the bottom of each phase. This shall consist of a six inch outside diameter schedule 80, perforated PVC drain pipe installed in the bottom center of a 24 inch keyway. A 12 inch outside diameter steel riser pipe shall extend from the base of the sump to the surface beyond the filling area. 10. Surface water run-on shall be controlled to ensure that it will not be allowed to enter the active working face. Also any surface water which falls on the working face will not be allowed to leave the site. 11 . The facility shall be operated in a manner to control blowing debris at all times. Operation during windy periods shall be accomplished in a manner that controls blowing debris. Any debris found outside the working face or adjacent to the facility will be picked up within 24 hours. The fence on the perimeter of the property, State Highway 14, Weld County Road 25, and roads on the perimeter of the waste disposal facility shall be patrolled daily by the facility staff to assure trash is picked up. The manager of the facility will respond to requests for picking up trash along these routes within 24 hours of notification by County Health Department personnel. The following operational measures shall also be employed to control blowing litter at the site: A. At the end of each day application of six inches of soil cover shall be placed over the working face. Soil cover will be placed on waste as soon as possible on days when wind is a noticeable problem. B. The working face shall be enclosed on three sides with a minimum 15 foot screen while accepting waste. A five foot fence shall enclose the cell containing the working face. A six foot fence shall be placed along the property lines of the 170 acre parcel. C. During windy periods not defined as high winds according to State Health Regulations, the size of the working face shall be reduced if trash is escaping the three sided 15 foot screen around the working face. The working face shall be reduced to a size that eliminates trash escaping from the screen. D. Prior to accepting waste, a letter, approved by the Department of Planning Services' staff, shall be mailed to all surrounding property owners within one-half mile of the landfill boundaries. The letter shall indicate the following information: 9CC5.641 Development Standards USR-895 Page 4 a. The program that the landfill operators will use to pick up off-site windblown trash. b. The name and telephone number of the person or persons to call for pick up of windblown trash. E. The operation shall cease during periods when high winds are present. High winds are defined in Section 1 .2.31 of the Colorado Department of Health's Solid Waste Disposal Site and Facilities Regulations. 12. The site operator shall keep the following records on site to be available for county and state review: A. Quarterly inspection by an independent engineer. B. Litter policing reports. C. Volume and types of incoming waste. D. Results of wind, methane and water quality monitoring. E. Any special waste accepted at the facility. F. Construction quality assurance and control documentation. In addition, the groundwater monitoring parameters shall be modified to include all parameters listed in the document submitted by the Colorado Department of Health titled, TABLE I, INITIAL BACKGROUND MONITORING. The first eight quarters of monitoring or some portion of it may be concurrent with landfilling. The applicant shall comply with Section 2.2.3 (b) and (c) of the Colorado Department of Health Solid Waste Disposal Site and Facilities regulations in terms of the analytical method and statistical evaluation of groundwater monitoring data. Generally, if toxicity exceeds 300 parts per billion in any one sampling event the operator shall include a volatile organic compounds analysis for all wells until further notice by the Colorado Department of Health. However, this requirement may be modified once background data is collected for the site. .9 \ 564 Development Standards USR-895 Page 5 13. Operational inspections of the entire facility shall be made on a quarterly basis for the life of the landfill operation. The inspections shall be made by an independent contractor experienced with landfill operations. The inspections shall be made to ensure that the landfill operation is progressing in accordance with all aspects of the approved landfill plan. Inspection reports shall be prepared and submitted to both Weld County Health Department and the Colorado Department of Health. 14. A system of wet/dry monitoring wells shall be placed on 500 foot centers around the site and installed in a phased manner as landfilling occurs. These wells shall be tested for the presence of groundwater and methane gas. All wells shall be completed to a minimum of ten feet beneath the base of the landfill and with perforated intervals reaching to within ten feet of the surface of landfill. Construction of the wet/dry wells shall consist of one inch outside diameter, PVC casing, with glued joints placed in six inch diameter borings. The casing shall be drilled or slotted. The annular space shall be gravel packed to approximately one foot above the slotted interval of the casing. The remaining annular space shall be backfilled with dry bentonite. Installation shall be as follows: A. Phase 1 - - - wet/dry wells 1115 to 1122. B. Phase 2 - - - wet/dry wells 116 to #14. C. Phase 3a - - wet/dry wells 1123 to 1124. D. Phase 3b - - wet/dry wells 113 to 115. 15. The landfill owner shall notify the Colorado Department of Health and Weld County Health Department within five (5) working days if the following occurs: A. The leachate system shows the presence of liquids following the placement of the first lift. B. Groundwater monitoring results detect a greater than .01 variation from the background results, in accordance with Section 2.2.3 (c) of the Colorado Department of Health's Solid Waste Disposal Sites and Facilities Regulations. If determined by either department, confirmation testing will be required. If an environmental problem is confirmed, the operator will have an additional 30 days to evaluate the data and present a specific plan of action. ng)t -`+ Development Standards USR-895 Page 6 16. A methane gas venting system shall be installed in the 12 inch outside diameter steel riser pipe. 17. The landfill operator shall maintain recycling bins at the landfill entrance to receive mixed glass, newspaper, aluminum, and recyclable plastic containers. 18. Post-closure inspections shall include documentation of surface cracking, erosion, slope angles, drainage, and condition of vegetation. One of the inspections each year will be made in late spring, when damage would most likely occur due to thaw and run off. Any damage or other deficiencies shall be promptly repaired. 19. The facility shall be operated in a manner which controls odors. Odors detected off site shall not equal or exceed the level of 31-to-1 dilution threshold as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. 20. Fugitive dust shall be controlled on site at all times. In the event that fugitive dust from the facility is determined to be a nuisance by the Weld County Health Department, a dust abatement plan shall be submitted within ten days to the Department for review and approval. Implementation of the approved dust abatement plan shall begin within 24 hours of approval by the County. 21. The septic system for the proposed office shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 22. The maximum permissible noise level shall not exceed the industrial limit of 80db(A) , as measured according to 25-12-102, Colorado Revised Statutes. 23. In the A (Agricultural) district, drilling for oil and gas is a use by right and mining requires approval of a use by special review permit. The landfill owner shall notify the Department of Planning Services prior to drilling for oil and gas. Prior to drilling, the Colorado Department of Health and the Weld County Health Department will review plans for drilling oil and gas on the 170 acre parcel. The review shall identify any impacts on the solid waste disposal facility and determine compliance with all applicable regulations. 24. The office and maintenance buildings shall be painted and maintained in an earthtone color. 9CW-6 Development Standards USR-895 Page 7 25. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 26. The property owner or operator shall be responsible for complying with the Design Standards of Section 24. 5 of the Weld County Zoning Ordinance. 27. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 28. Metal signs shall be posted at the customer entrance way. The signs shall be a minimum of three feet in width and four feet in length. Sign #1 shall state: "ALL UNCOVERED LOADS SHALL BE CHARGED TWICE THE NORMAL FEE" Sign #2 shall state: "ABSOLUTELY NO HAZARDOUS OR TOXIC WASTES, SEPTIC OR LIQUID SEPTIC SLUDGE ACCEPTED" 29. During the life of the landfill, the applicant shall maintain advisory signs on State Highway 14, if permitted by the Division of Highways. The signs shall advise landfill users the distance to the site and that all loads must be covered. 30. The property owner or operator shall be responsible for maintaining the approved landscape plan on the southern boundary of the property. 31. The owner or operator shall comply with Weld County Ordinance 53. 32. The Use by Special Review shall not be transferred to another operator or to any successors in interest or lease of the described property for operation of the facility without written approval from the Board of County Commissioners. 33. Personnel from the Weld County Health Department, Weld County Department of Planning Services, and Colorado Department of Health shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 9C 2 Development Standards USR-895 Page 8 34. Construction of the landfill to prevent infiltration and the importance of monitoring reports sent routinely to the Colorado State Department of Health and the Weld County Health Department. Leachata and methane monitoring must be done for ten years after the landfill closes. John Houtchens, Attorney at Law, reviewed the precautions taken to assure _ proper closure and monitoring. Names and phone numbers of a contact parson will be posted at the site. Concerns expressed by the Colorado Department of Highways will be worked out. An agreement will also be worked out between the company and the mineral owners. Lae Morrison stated the Planning Commission, Chuck Cunliffe, Hod Allison, and himself did a field check of the site. At that time no testimony was taken. The site was merely reviewed. The Chairman called for discussion from the members of the audience. Tom Hollerith, Attorney at Law, Dinner, Hellerith, and Lazar, represented a number of area landowners and the Town of Ault. Petitions of people opposed to this site were submitted. There were 1,794 signatures. He submitted letters from the Town of Ault and School District RE-9 regarding traffic hazards and other possible. hazards and safety concerns. Tapa 375 J. T. Thompson, area resident, showed slides of the existing and the . proposed sites. Ha feels the applicant has done a good job and runs a clean operation at the existing site. While we certainly need landfills, he does not feel the proposed site is the best site available because of the scenic beauty and traffic and safety hazards posed by a busy highway. Ray Danielson. area resident, is opposed to the landfill going into this site. The area is very windy and there is a very real possibility of trash _ blowing into irrigation ditches. Larry Ross, surrounding property owner, stated he will be one of the closest residents to the site. Thera are a lot o£ traffic accidents in this area already, and he is very concerned about further accidents. Therefore, he is against this request. 05641 Summary of tha [,field County Planning Commission June 5, 1990 Page 8 Cindy Sidwell, area property owner, spoke against this request. She urged a two year wind study of the area be done. She also felt greater effort should be made to recycle some of our trash. There are 80 residences in a two mile area surrounding the landfill sits. Doug Fred, area resident. is against this request. Ha feels landfill locations should be chosen with future development in mind. Wiralso need to practice recycling as an alternative to landfills. Glenn Scott, area resident, opposed this request because of pollutants delivered in trash and possible groundwater contamination. Nancy Crom represented Mr. Cordova. Weld County School District 9. The school is opposed to this request because they are concerned with the safe transportation of school children and the historical significance of the area. There are teepee rings many places in this area. Alternatives, such as recycling trash should be considered. Bill Score spoke in opposition to this request. J. Moody, area resident, opposes this request because of the beauty of the site, the wind blowing trash, and possible trash in the irrigation ditches. He felt trash should be made expensida to haul and maybe we will begin to recycle. Tracy Eichhaim, area resident. spoke against this request. He feels Ft. Collins and Ault are moving together, and the dump is really for the benefit of Fort Collins. • Morton Baker, Planning Consultant. The Baker Group, Urban Planning, stated there will be a resource recovery station recycling plant on Second Avenue in Greeley. It will be able to recycle about 95Z of all trash and will employee 25 to 30 people. All trash will be dumped inside the building for recycling. Walt Sidwell spoke against this request. Ha felt recycling is more important than dumps. Brad Estrus stated the top soil will only be removed from the land while they are filling that particular call. They have triad to be expressive and responsive to the residents concerns. A traffic study has shown increased traffic into and from the landfill will cause a one-half of one percent increase. Landfill issues are sensitive, but referral entities and the Planning staff feel this request meets or exceeds all requirements. Bud Halldorson - No, for a variety of reasons. the biggest being there are too many alternatives in the presence of all the people who are most directly impacted. The wind issue. the recycling alternatives, the traffic issues, the height of visual impact, and overall the compatibility of the neighborhood and the objections of the neighbors. Ho realizes that all the reviews from the State Department of Health and various County agencies are supportive, but those are of a technical nature that don't really reflect the impact on the neighbors. There must be other sites and technologies that would be more appropriate. Judy Yamaguchi - No. She goes along with what Bud Halldorson said plus the fact that she is concerned about the compatibility, the health, safety, and well-being. and the project at this given site. LeAnn Reid - No, for the reasons already stated. Rick Iverson - No. Bud Clemons - No. His concerns are for the location. He appreciates the amount of work the staff as well as the applicant have put into this, but 1t 1s clear to him that being located on a major State Highway is a number one concern from the citizens who have addressed the issue. It seems there ought to be an alternative location that would meat the criteria from a technical standpoint without interfering with the traffic flow and the perception that Colorado is trying to sell, i.e., their magnificent beauty, etc. This project. at this site, would be a deterrent to that aspect. 9f G561 Summary of the Weld County Planning Commission June 5, 1990 Page 10 Jerry .Kiefer — Thinks the plan is excellent and that is why, from a technical it received high trustworthy, has done,a goohas job in chee presentmopiration.e operator is We all agree landfills must be built and just because something is in ones backyard is no reason co deny it. He feels Ault, as well as any ocher community, needs its own waste taken care of, but along a major highway.. in a most conspicuous place, does not seem appropriate to him. In ' the staff's recommendation, the reasons given for recommending approval said the closed use will be compatible and the proposed use will be compatible with the future development, and he does not think it is compatible in the location that it is being suggested. The State right now is working hard to eliminate problems from other parts of the State such as in the Colorado Springs area and the Ouray/Silverton area. Granted, those are almost permanent scars, but he thinks this might be one that exists for forty or fifty years, and to him, that is permanent enough. Ernie Ross - No. This is in the wrong location. It is in a beautiful spot. As long as we approve landfill operations there is no incentive to develop an alternative standard. Motion was unanimously denied. Lee Morrison reviewed the need to still act on the Certificate of Designation. The Planning Commission members should consider incorporating the decision made on the Use by Special Review permit when making a decision an this. Windsor feels that a location of less impact on people and property could be found in Weld County, perhaps further north. The need for landfills undoubtedly exists in all of Colorado, but we hope that Weld County will take a more stringent approach to their location, particularly when in concerns waste from other counties . Boulder County seems to resist attempts to establish landfills but has no problem hauling waste to other counties . We in Weld should make it considerably expensive for outside county residents, businesses and industries using Weld county as a landfill area. We realize it is a difficult problem and will require a hard decision, but there is no question that a landfill location of lesser impact on people and property could be found within Weld County. Ha explained the studies that must go into choosing a site. He also shoved slides of the proposed site, a 170 acre, sparsely populated area, and the amenities of this site. He addressed some of the public concerns and presented a drawing of proposed landscaping of the area. The life of this site is estimated to be between 25 and 50 years. I am writing to urge you to deny the permit for Waste Services Corpora- tiods proposed landfill west of Ault. The main access roads will be U.S. High way 85 and State Highway 14. As you can see on the attached map, both the highways are main streets in Ault. 85 serves businesses and residences and with 14 provides access to the two railroad crossings -fOr the east side of Ault. Highway 14 serves the main business district, an active senior center, the library, the park, some residences, and is the only access to the schools. The Highland District (RE 9) schools in Ault are the Middle, Jr. high and Sr. high levels as well as a busy day care center in the Middle school. Children from Carr, Nunn, Pierce and Ault are bused to and from these schools. Mr. Brad Keirnes of Waste Services Corporation has told us he expects as many as 50 trucks a day to be using the landfill when it opens and that he expects the number to increase. That amounts to 100 trash hauling vehi- cles counting the return trips. Another concern I have is the placement of a landfill on any highway in the front range area which has traditionally been dedicated to growth. Highway 14 is a gateway to the mountains and the Poudre Canyon. The site chosen for the landfill has a particularly beautiful vista of the mountains. The wind is a big factor! ! The wind blows across this ridge many, many days when it doesn't blow in surrounding areas (AND at a high velocity! ) Even with a proposed berm and fence, the dust and any escaping trash would be a hazard to traffic on Highway 14. 2. Road 25 (at Highway 14) is a HAD intersection. It will be an EXTREME hazard with trash trucks turning. 3. ail221.1u2 route along Highwa 14 is a MAJOR CONCERN. 4. The proposed site is on a high hill visible from all directions. The berm will aid only the view from the road on the South, and even that will be of no help from further South. The road curves at the site, and the dump would be very obvious from all directions. 5. This is a beautiful area, which gives travelers from the East a great view of the Colorado Rockies. With the landfill in this area, a COMPLETELY different feeling for Colorado, and the Rockies would be made! 6. Alternative: RECYCLE. . .and choose a site in a more remote area for what is left! Highland Day Care Center is a child care center located in Ault. The center serves families from Ault, Pierce, Nunn, Eaton, and the surrounding rural areas . Fifty to sixty children, ages 21- 12 years of age, attend daily. As the Director of Highland Day Care Center, I am concerned about the potential health and safety problems for children which may arise from the location of the landfill on the proposed site. The increased truck traffic through town is a safety hazard , as is the spilled debris along the roads . Leakage from the site is a health problem which could affect the population of these communities many years in the future. High winds are the norm in this area and blowing trash is a serious health problem. For the above reasons , I oppose the site of the proposed landfill on Highway 14 west of Ault. We are writing this letter in opposition to the proposed location and would urge that you vote NO on the request of Waste Services Corporation for a Use By Special Review Permit. The proposed location of the facility is four miles west of Ault directly adJacent to Highway 14. This highway is well traveled by commuters as well as tourists who come to our state on their way to the mountains and the front range. As other Colorado cities and counties with economic woes are cleaning up their business and residential sectors to promote needed tourism, let's not create an eyesore that detracts from the Image we want to proJect for our County and the state of Colorado. The view from this location is one of the most spectacular views of the mountains and the cities of Greeley, Windsor, and Fort Collins. As the front range continues to grow, people will seek out this type of location to build their homes so that they may enjoy the views which this area provides. This residential development would increase the assessed valuation and tax revenue for Weld County and the surrounding school, fire, and library districts. We feel that this is very significant financially to our county as there is the potential for less tax revenue when the City of Thornton dries up the irrigated farms and sells the land back as dryland. This area has the potential of generating far greater tax revenues as residential property than a landfill, which could be located in a less prime area without significantly affecting the tax revenue. The operating plan indicates that the trash will be piled 170 feet ABOVE the present elevation. The power poles for the new electric line which was installed on land adJacent to this property this past year, are approximately 90 feet high. This means that the final elevation of this dump will be 1.75 times as high as the power line. From the town of Ault, the view of the mountains in line with the landfill will be blocked out by the proposed landfill visible from many miles away and from all directions. This stretch of Highway 14 is extremely treacherous in winter weather due to high winds, ice, and drifting snow. A 170 foot ridge will only compound the drifting conditions and hazards created by cross winds. Another major concern we have is the potential for this facility to be increased in size some time in the future. The present request is for the facility to be 170 acres, however, Mr. Keirnes of Waste Services Corporation has admitted to negotiating the possibility of obtaining an option on an additional half section of ground with an adJacent landowner. We feel that expansion is already being planned. Mr. Keirnes stated that it �k (25,91 is doubtful that Larlmer County or other states would bring their trash to this site. We feel only the naive would believe that statement. As other cities and states are having problems finding places to dispose of their trash, shipping it across the country for disposal becomes a reality. To the best of our knowledge there are no regulations in place to restrict this. What prevents Weld County from becoming the primary garbage dump for the surrounding counties and/or states? We understand that landfills are necessary and that new ones are needed as many of the old ones are being closed as they reach capacity. With all of the concerns and the unknowns regarding our @nVlronment and the toxic residues which normal household trash can create, what better time to explore the alternatives of recycling along with locating new landfills away from existing housing and future growth areas. We understand that the costs of trash disposal could increase if the landfill is located in a more remote area but in today's throwaway society the consumer Will have to bear that cost or consider recycling as an alternative. In selecting a site the engineers for Waste Services Corporation indicated that this location has good geological and hydraulic characteristics for a landfill. They indicated that these same characteristics are located south of this location as well as north along the Cheyenne Ridge all the way into Wyoming. How many other locations would be suitable for this landfill? It doesn't appear that Waste Services Corporation has explored other possible locations which would also be suitable without Impacting the number of people and creating the eyesore which this location will. The decision of selecting a location for a landfill Is one which will impact the area for the next 50 plus years. In considering Waste Services Corporation's request for this location, keep in mind that the proposed location will impact many people today as well as stopping any potential growth which this area will experience in the next 50 years if there is not a landfill located there. This location benefits only one entity- that of the developer who would not have to build or maintain roads to the facility. Please consider the lack of benefits to present landowners, taxpayers, communities, public schools, as well as prospective residents and tourists if the landfill is located at the proposed site. ( Waste Services Corporation doesn't even suggest significant additional Jobs.) North Weld County is a beautiful place to live, work, raise our families, or visit. Positive growth will happen here if not squelched. Lets capitalize on the benefits we all will receive by planning for that growth wisely. No one, other than the developer would choose the proposed site as an appropriate location for a landfill. It has been stated in the Special Review Application that a traffic flow of a minimum of 50 and maximum of 100 vehicles per day is to be anticipated. This would include private cars , pick-ups and trucks , as well as commercial collection vehicles and roll-off trucks . In recent months , I have been working with a group of local parents and the State Highway Department over a problem we are experiencing with traffic not observing posted speed limits and student crossing right-of-ways in town. A gap study conducted by the Highway Department at State Highway 14 and Graefe Avenue acknowledged the current volume of traffic does pose a problem to students attempting to cross the roadway. We also have an established school bus route that has several student pick-ups and drop-offs along S .H. 14 to the west of Ault . Should the landfill be established and the traffic flow in- crease occur, I would be very concerned for the welfare of students who cross S.H. 14 each day, both walking to and from school, and those who must enter and exit from the bus stopped on the roadway. Despite all the reduced speed limits, pavement markings , flashing signs and lights on the buses , numbers of motorists continue to ignore the fact that school children are present and young lives are at stake . As one who is in charge of the safety and welfare of hundreds of our district student ' s lives on roadways each day, the establishment of the proposed landfill project and the accompanying additional traffic load most definitely would be C 564 an added risk to a situation that is already an urgent problem. They are as follows : Expansion of Colorado Highway 14 Landscaped Visual Buffer We originally proposed the installation of 5-10 foot seeded earthen berms and extensive tree plantings to create a complete visual shield of our facility, including the originally proposed maximum final elevation of 5 , 310 feet, for the full 1/2 mile boundary of our property with Colorado Highway 14 . Architectural drawings we submitted clearly illustrated the effectiveness of this landscape buffer in screening the existence and operations of our facility from view along that portion of the state highway directly abutting our property. However, due to the configuration of our site boundary in relation to the state highway this extensive visual buffer could not shield our facility from view for westbound vehicles for a distance of approximately 1/2 to 5/8 of a mile to the east of our site. This meant that based on a vehicle traveling at the posted maximum speed of 55 miles per hour our facility would have been visible for 30 to 35 seconds to operators and passengers in vehicles traveling westbound on Highway 14 until they passed behind our visual buffer. Due to continued public concern about this matter , we recently sought and obtained control of adjacent property to extend our landscaped visual buffer eastward (parallel to Highway 14) for a distance of approximately 1 , 300 feet , or O2 6037 SEVENTY-SEVENTH AVENUE • GREELEY, COLORADO 80634 • (303) 330-2641 }J Ex/r/$rT f"V 1/4 mile , and then northward (along the Pierce Lateral Ditch) for a distance of approximately 900 feet. This proposed extension of our landscaping and berming will not only completely shield the existence and operations of our facility from view at any point along the state highway, but will also completely shield it from view from the Dennis Drake and Larry Huwa residences , located 1/4 mile and 5/8 of a mile east of our proposed site , respectively. Proposed Additional Reduction of Final Elevation As indicated in our applications , we originally proposed fully maximizing the economic efficiency and utility of the North Weld Sanitary Landfill through filling to a maximum final elevation of 5 , 310 feet . This would have meant filling above average existing grades an average of approximately 175 feet. Disregarding the functional effectiveness of the proposed landscaped visual buffer as described above, due to public sensitivity to this aspect of our proposal we amended our applications on June 5 , 1990 by agreeing to reduce the average increase in elevation above average existing site grades by 50 feet , or 30% , to a final elevation of 5 , 260 feet . This resulted in a forfeiture of capacity, i. e. efficiency and utility, of approximately 10% . Due to continued public input concerning this aspect of our proposal , we wish to inform you that we will agree to further reduce the final elevation up to an additional 50 feet for a total reduction of 100 feet , or a 60% reduction in the final elevation originally proposed. We will agree to such further reduction even though the extended buffer proposed above will totally shield the final elevation without any reduction. A full reduction of an additional 50 feet would result in an average increase in elevation above average existing site grades of 75 feet to a maximum final elevation of 5 , 210 feet. This additional 30% height reduction would result in a total forfeiture of site efficiency and utility of approximately 35% . Obviously, the final elevation reduced by 60% will likewise be totally screened from view from any point along Highway 14 and from any residences within at least 3/4 of a mile of the site . While we believe there would be a substantial long-term north Weld regional planning and economic benefit from fully maximizing the efficiency and utility of the North Weld Sanitary Landfill , we will agree to a height reduction up to a total of 100 feet if it is determined to make our proposed facility more compatible with surrounding land uses and properties . ,e `4-.0 s We request that the foregoing supplemental information be immediately made part of our applications prior to the Board of Weld County Coumdssioners hearing scheduled for June 27 , 1990 . Tourism and agricultural are Colorado's number 1 and ?_ industries and we feel this landfill is in direct conflict with the proper stewardship of both industries. The asthetics of placing a business which is such an eyesore on such a prominent location on a major public highway is simply foolish and unacceptable to the citizens of Weld County. The trend of residental building growth has always been to ':.;uild on high scenic locations with a mountain view. This site offers the best view of the Rocky Mountains by westbound travelers on Highway 14. Certainly a far €*reater concern is the usuage of prime agricultural land for a ,purpose that forever wastes the land for future generations and for future productivity of cropland. Land is not recyclable after it has 1.)no : contaminated with trashfilling and while the initial cost of landfi llintg o ora.cions may be lower than other methods of resource recovery, recycling ad processing, the long term cost: of monitoring and insurance and perhaps e:/:ten-iv e:/:ten-ive cleanup costs exceed the temporary benefit gained. Lastly we have many technical concerns about the proposed landfill. They are listed below and supporting data is enclosed substartuating our concerns;; for you as stewards of Weld County do have a mandate to protect noth the people and the enviornment from misuse. 1 ) No wind study has been done on this site, there is no data available concerning wind gusting on a high ridge tho we all realize this is a high wind area. 2) The direction of surface drainage and prevailing winds are separated from the Pierce Lateral Irrigation Canal by only a few hundrer eec Surface erosion problems from blowing dirt, trash, and hard rains would be directly in line with this point. . (?) 3) Shallow ground water levels of 36 and 41 feet were discloed by the plan, these levels probably flucuate with seasonal conditions during irrigation! season. Animals crops and food are raised with Pierce Lateral water which so easily could be polluted by surface erosion. 4) Proposed landscaping plans calling for berming, fencing and three rows of trees would perhaps be an assett in another location, but to place such a natural barrier t^ the north side of a highway in a wind zone would cause a significant increase in blowing and drifting snow during; winter storm conditions. 5) Approximately 30+ families live downwind and below the Pierce Lateral within a two mile radius. Though these homes are not clearly visable from Highway 14, this simply is too large of a population density for such an operation. These peoples lives are directly impacted and the burden of policing their unwanted neighbor falls upon them. �) All landfills leak. There are no secure landfills. Please note the highlighted sections of enclosed data concerning landfill safety. EPA allows "small generators" to dump toxics in municipal landfills. Large quantities of hazardous waste materials are not regulated and can be disposed of in any landfill including toxics found in normal household waste. Resource recovery centers offea better chance to properly sort and contain such materials. In conclusion we find that other solutions do exist. Common sense calls for such measures as composting (185 of municipal waste is lawn and garden refuse and leaves) these materials conserving a valuable resource: and lessening the publics dependancy upon chemical fertilizer:. Burning is not nece^sarily a poor solution for disposal of nor-tonic burnables. They offer an attractive solution, burning cleaner than foovil fuels for light industry comsumption. We urge you to vote no on .Taste Services Corporation apnlIcation for a landfill permit at this location an urge further study before allowing future operations of this nature to proceed. Our desire is to limit landfills in size, couple them with a recycling falcility andmost of all to locate them at least 1 mile off any major highway and on land unsuitable for crop production. The location is subject to gusts of wind made more hazardous by the exposed lie of the land, which makes the debris likely to be scattered up and down the highway and into the irrigation ditch . The progressive build up of trash would be visible for miles in all directions save directly south, making the highway to the Poudre Canyon an undesirable scene . The lack of accleration-deceleration lanes to allow landfill traffic to exit the highway, will provide more potential for accidents as vehicles try to get around turning trucks on the top of the hill which is essentially blind to oncoming traffic . I was unable to attend today ' s hearing because of a conflicting business meeting. That is why I am instead writing this letter that Mr . Kirby has so kindly agreed to read for me . I would like to begin with one of Mr . Kerns ' statements at the last hearing before the county committee. He said that Waste Services Corporation was attempting to be a good neighbor and had personally contacted some of the closest residents to discuss the proposed site. My property is located at the intersection of WCR 23 and Highway 14 . That is only one mile west of this site and I have not heard one word from anyone. My next concern is of course, blowing trash. I realize that extra precautions are being taken, but this corporation is planning to create a dump on top of a windy hill , and then pile the trash even higher . I don ' t feel that there is any way humanly possible to control the spreading of debris . Waste Services Corporation has also planned a screening berm along Highway 14 to supposedly hide this dump site . This is a good idea if you are always directly south of the site . Unfortunately, that is not the case and no screening has been proposed for the east or west sides . I can ' t imagine any worse view for nearby residents or for Highway 14 commuters . I realize the need for a solid waste disposal , but I am also sure that there are more logical locations . This should be located out of site and off Highway 14. It is our understanding that the current Eaton site is very close to capacity, and that its closing is imminent. This would result in a serious unmet need for solid waste disposal if another site is not designated. Monfort endorses your designation of a long-term, environmentally round, cost-effective solid waste disposal site in Northern Weld County. Lack of such a site would result in a significant cost increase to Monfort for solid waste disposal. Although we have not reviewed the application of Waste Services Corporation for a certificate of designation, we urge you to carefully consider it, in order that Northern Weld County can have a proper site for solid waste disposal. The facility they have utilized to handle our waste disposal is the Central Weld Sanitary Landfill , located approximately eleven miles southeast of Windsor. It is our understanding that this facility has an estimated remaining life of fifteen years. While the Kodak Colorado Division is currently working on a number of programs to either minimize or recycle much of our waste, such as aluminum, computer/corrugated papers, and plastics, we see a need for an additional landfill to replace the Central facility when it closes. Therefore, we support the proposal submitted to the Weld County Commissioners for the North Weld Sanitary Landfill to be located ten miles northeast of our plant on Colorado Highway 14 . I would also like to mention that Waste Services Corporation has agreed to work with the Kodak Colorado Division to find ways to minimize the amount of waste being sent to the landfill by recycling . In addition , we are committed to continue our research in identifying ways to reduce the waste we generate. (the Keirnes Family) have a well managed operation and an excellent record of compliance with regulations. The county has experience with them because of their current operation near Milliken. 2) There is definitely a need for a landfill in the northern portion of the county, and the existence of adequate waste disposal facilities is important to economic development and the growth of industry in our area. 3) Waste Service is a private, for profit, tax paying business. We believe it is appropriate for the private sector to provide services such as this, as opposed to some communities where it is paid for via taxation or use fees by government. While we cannot comment on the specifics of the particular site, or the proposed regulations being considered by the commissioners, we nevertheless wanted the above views to be considered and positive conclusion to the waste disposal issue reached. The analysis is presented on a per mile basis. The data upon which this analysis is prepared has been obtained from Drew Scheltinaa, Weld County Engineer. Summary of Assumptions: COST ASSUMPTIONS (Per Mile) : Direct cost of upgrade from gravel to asphalt: $ 250, 000 Direct cost of minor repair/maintenance, including 1-1/2 inch overlay 50, 000 Direct cost of major repair/maintenance, including three inch overlay 100, 000 FREQUENCY ASSUMPTIONS (over expected fifty-year life of landfill) : Upgrade from gravel to asphalt: Performed once in the first year. Minor repair/maintenance: Performed once every ten years, commencing in fifth year from when road was first improved. Major repair/maintenance: Performed once every ten years, commencing in tenth year from when road was first improved. INTEREST FACTOR ASSUMPTION: The analysis contains an interest factor of 8% per annum. Conclusion: Based on the above assumptions, the aggregate per mile cost of improving a connecting county road from gravel to asphalt to access the North Weld Sanitary Landfill over its fifty-year life would approximate: $ 18,595,898 per mile.
