RE: ACTION OF BOARD CONCERNING ANNEXATION OF WELD COUNTY ROAD 13 BETWEEN WELD
COUNTY ROADS 2 AND 4 TO THE CITY OF NORTHGLENN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has previously submitted a
petition for annexation of Weld County Road 13 between Weld County Road 2 and 4
to the City of Northglenn, which is scheduled to be heard on May 16, 1991 by the
City Council of the City of Northglenn, and
WHEREAS, currently awaiting signature by the Governor, is SB 220 which
appears likely to allow a successful legal challenge to the proposed annexation,
and
WHEREAS, the attorney for the City of Northglenn has advised the Board,
through the County Attorney's office, that the City will support withdrawal of
the petition should SB 220 be signed by the Governor prior to the hearing of May
16, 1991.
NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Board of County
Commissioners is authorized to withdraw the annexation petition for Weld County
Road 13 if the Governor signs SB 220 prior to the hearing scheduled for the
Northglenn City Council meeting of May 16, 1991.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 15th day of May, A.D. , 1991.

RE: Annexation of Weld County Road 13
Dear Mayor and City Council Members:
The Board of County Commissioners, based upon the representation that SB
220 has been signed by the Governor, respectfully requests that the
remaining portion of :the annexation petition now pending before your
Council be withdrawn. The Board does not wish to pursue the annexation in
light of the significant changes in the annexation law represented by SB
220.
Thank you for your cooperation In this matter and your willingness to take
into consideration this Board' s concerns regarding County roads impacted
by municipal annexations.
