RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 1386 - GARY D. AND EILEEN M. HLADKY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1386, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1386 was submitted by Gary
D. and Eileen M. Hladky, for property which is located in part of the N2 SW; of
Section 21, Township 2 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 76 acres and 1 acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
2. Prior to recording, the following note shall be placed on the
recorded exemption mylar plat:
The domestic well on Lot A of Recorded Exemption
1386 is to be used for household purposes inside
one single family dwelling and the watering of
domestic animals only. No outside use for
irrigation of lawn or garden will be permitted.
3. Prior to recording the recorded exemption plat, the applicants shall
submit an agreement providing a permanent source of irrigation water
to Lot A of this recorded exmeption. The agreement shall be
approved by the Weld County Attorney's Office and shall be recorded
with the recorded exemption plat.

Subject: Recorded Exemption 1386
This request for a recorded exemption is submitted by Gary D. and Eileen M.
Hladky. The parcel of land on which this request is being made is described as
part of the N2 SW4 of Section 21, T2N, R66W of the 6th P.M. , Weld County,
Colorado. The property is located south of Weld County Road 18 1/2,
approximately .25 miles west of Weld County Road 29 1/2. The applicants also own
a parcel of land approximately one acre in size, which has already been divided
from the parcel in question. This request is to divide a 77 acre parcel into
parcels of 76 acres and 1 acre, more or less. The applicants plan to create a
building site for their daughter and son-in-law.
The Weld County Health Department has reviewed the application materials and had
no objections to the request. The City of Fort Lupton Planning Commission has
reviewed the application materials and has recommended approval subject to
certain conditions. The concerns of the City of Fort Lupton are addressed in
additional comments. The Division of Water Resources has also reviewed the
application and has stated that an in-house use well permit can be issued for the
one acre parcel, if the recorded exemption is approved.
The staff has concerns whether adequate water will be available for the potential
uses of this property since the well permit which could be issued will allow no
outside uses for irrigation of lawn or garden. The applicant has proposed
selling water from a lake on his property for the purpose of lawn watering only
to the owners of the one acre parcel. An agreement which would ensure that
irrigation water would always be available to the one acre parcel would be
required.
The staff also has concerns about the level of development and the potential for
continued divisions occurring in this section. Two recorded exemptions have been
approved in the southeast quarter of this section since 1987. As shown on the
attached aerial photograph, two small parcels have been previously excepted from
the parcel in question. These parcels were divided prior to the effective date
of the Weld County Subdivision Regulations. The staff wants the Board to be

aware of the development pattern that has occurred in this area and to consider
whether it wishes to allow this type of piecemeal development to continue.
Continued divisions may evade the intent and purpose of the Weld County
Subdivision Regulations. Residential development in rural areas necessitates an
increased demand for urban-type services such as road maintenance, police and
fire protection, school busing, snow removal, and utilities. Service demands
increase as density increases.
The staff recommends that the Board of County Commissioners consider this request
and determine if the standards of Section 9-2 E. (1) (a) through (m) of the Weld
County Subdivision Regulations have been met.

The City of Fort Lupton Planning Commission reviewed this request and recommended
approval with the condition that the applicants submit to the County and City an
overall plan for green belt and landscaping and that irrigation only be permitted
by utilizing irrigation water from the Fulton Ditch or other source. The staff
also has concerns about the availability of irrigation water for the proposed
smaller lot.
The Division of Water Resources has requested that if the recorded exemption is
approved, plat notes should reflect limitations on well use.

On February 5, 1992, the Board of County Commissioners approved a recorded
exemption for the Hladkys. Condition of Approval 3 provided that:
"Prior to recording the Recorded Exemption plat, the applicants

The reason for dividing this parcel into two lots is to allow for a
building site for our daughter and son—in—law.

Dear Ms. Swanson:
We have reviewed the above referenced application to split a one acre lot for a single family
residential dwelling from a 77 acre parcel. The proposed water supply is to be individual on lot
wells. The applicant has provided information indicating that no previous exemptions which
required an exempt well permit have been effected from this parcel since 1972. Therefore we can
issue one inhouse use well permit for the one acre lot after the County approves the split. The
inhouse permit will limit well use for household purposes inside one single family dwelling and the
watering of domestic animals only. No outside use for irrigation of lawn or garden will be
permitted. Plat notes should reflect these limitations on well use.
A well permit will also be available for the larger tract the same as for any parcel of 35 acres
or more.

The Fort Lupton Planning Commission has reviewed and made
recommendations to the following county referrals :
Gary D. and Eileen M. Hladky request for a recorded
exemption from subdivision regulations located on WCR 18
1/2, Sec 21, T2N R66W for one ( 1) acre.
The Fort Lupton Planning Commission reviewed this request
and moved to recommend approval subject to the following
condition:
That the petitioners submit to the County and City an
overall plan for green belt and landscaping and that
irrigation shall only be permitted by utilizing irrigation
water from the Fulton Ditch or other source. The motion
passed unanimously.

O'Gorman have instituted a proceeding in the District Court of Weld County,
Colorado, affecting the title to the following described property situate in

Weld County, Colorado
That the purpose of said suit is to quiet the title to said lands in the
plaintiffs, including, but not limited to all minerals (except coal) and all

reforming certain agreements and deeds relating to the sale of said lands to
