HomeMy WebLinkAbout940807.tiff 0 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1637 - DAVIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1637, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1637 was submitted by Durwood and Dorothy Davis, 26125 Weld County Road 44, Kersey, Colorado 80644, for property which is located in the SW! SW4 of Section 16, Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 10 acres and 30 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1637 submitted by Durwood and Dorothy Davis be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 3. The ISDS permit shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 4. Access to Lot B shall be from Weld County Road 44 across the existing access for Lot A, located on the west side of said Lot A. Prior to recording the plat, the applicant shall dedicate said access on the plat for the use as shown. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Dear Commissioners: This request for a recorded exemption is submitted by Durwood and Dorothy Davis. The parcel of land on which this request is being made is described as the SW4 SW4 of Section 16, T4N, R64W of the 6th P.M. , Weld County, Colorado. The property is located north of and adjacent to Weld County Road 44 and east of and adjacent to Weld County Road 53. This request is to divide a 40 acre parcel into two parcels of 10 acres and 30 acres, more or less. There is a residence on proposed Lot A and proposed Lot B is currently in pasture and corn production. Access to proposed Lot A is from Weld County Road 44 and access to Lot B is proposed from either Weld County Road 44 or Weld County Road 53. Central Weld Water District provides Lot A with water and is proposed for Lot B. A septic system provides sewage disposal on Lot A and is proposed for Lot B. The Weld County Environmental Protection Services and Weld County Public Works Department reviewed this request and recommend conditional approval. The Department of Planning Services' staff has concerns that the proposed division is inconsistent with efficient and orderly development and the Transportation Goals and Policies as stated in the Weld County Comprehensive Plan. There have been five (5) other recorded exemptions approved in Section 16, T4N, R64W of the 6th P.M. , Weld County, Colorado, since 1973, the most recent being approved in February of this year. The creation of an additional parcel in this area would contribute to residential sprawl, which is in conflict with the Weld County Comprehensive Plan. Residential sprawl destroys the rural lifestyle, which is maintained by supporting the agricultural industry and economy of the area. The addition of a buildable parcel would potentially further reduce the open space of the surrounding area. Open-space creates a buffer which helps to maintain a sense of rural identity and diversity. The Weld County Comprehensive Plan states: "Collectors serve a dual function between mobility and land access by connecting local roads to arterials. Access points on collectors should be kept to a minimum in order to maximize traffic flow and promote safety." This request, if approved, would allow for a residence on Lot B, intensifying; the residential uses on the property, further reduction of open space and the residential access to a County Collector. The Department of Planning Services' staff requests that the Board of County Commissioners consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have been met. The purpose of the proposed R.E. is to split off approximately 10+ acres of non-prime agricultural ground and single family residence (lot A) from the prime agricultural ground (lot B) . • Describe the location, size and present use of the area where each proposed new lot will be created. The proposed Recorded Exemption is approximately 40± acres in size ( the Southwest Quarter of the Southwest Quarter of Section 16, Township 4 North, Range 64 West of the Sixth P.M. ) . Lot A will access onto Weld County Road 44. Lot B may access either Weld County Road 44 or Weld County Road 53. Lot A is proposed to be approximately 10+ acres, and contains the existing residence. Lot B will be approximately 30+ acres and will continue to be used as agricultural farm ground. • Explain how the proposal is consistent with the Weld County comprehensive Plan and any adopted municipal plan, if applicable. The Weld County Comprehens i ve Plan specifically provides for a property owner to sell off agricultural land that is nonproductive as one single family dwelling home site. The proposed lot A is nonproductive due to the inability to irrigate said lot. • Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. The existing land uses of the proposed recorded exemption are fully compatible with surrounding agricultural and residential uses. Adjacent land uses as they exist today are comprised of agricultural farm ground with single family dwellings. • Explain how the proposal is consistent with the intent of the zoning district it is located within. The proposal is located within the Agricultural Zoning District. This district allows by right agricultural and residential use. The intent of the district is to preserve and protect agricultural uses. This proposal is consistent with intent of the district in that Lot A will Be used as a single family residential site and Lot B will remain agriculture and unchanged by the recorded exemption. • Explain how the proposal is consistent with efficient and orderly devel open t. The surrounding land uses consist of agriculture and large residential lots. Proposed Lot B will remain agricultural farm ground with access off both Weld County Roads 44 and 53. Lot A will be a large residential lot with access off of Weld County Road 44. RECORDED EXEMPTION STANDARDS: • The existing Central Weld County Water District water source will remain in use for the proposed recorded exemption. • Septic systems are currently in use for the residential structure on this site and is adequate to continue to service the proposed recorded exemption. • The proposed Recorded Exemption complies with the Zoning Code Overlay District regulations. Davis 26125 Weld County Road 44 Kersey, Colorado 80644 Dear Mr. Davis: On October 10, 1994, an evaluation of the existing individual septic disposal system at 26125 Weld County Road 44, Kersey, Colorado; Section 16, Township 04 North, Range 64 West, was conducted by Pam Smith. The existing individual septic disposal system is of sufficient size and capacity to adequately handle the proposed load. The Admini=strator's office in their letter of February 6 and February 22, 1978 quoted Section 6.1 (2) and 6.1 (7) III B.3 as justification for their disapproval. I have read this zoning resolution and would like to address the sections in question. In substance the sections state that "the mobile home will be occupied by persons principally employed on the agricultural unit"-- and-- "is necessary for the effective and economic operation". In reviewing my request (s) dated January 25, 1978 and February 8, 1978 I find nothing that could indicate that I would not be principally employed on the unit and can see no possible reason for that office to arrive at a conclusion that I was not "necessary to the --- operation". That is unless that office has the authority to decide that "the use of the 40 acre.tract does not require additional labor" as was stated in this letter of February 22. This however, I cannot believe to be a legitimate use of authority. If so it could be a precedent applicable to more than one landowner. Since the .. second residence is for myself, the question of necessity involves only me and not my son since I have already pointed out the conditions of the partnership arrangement. . Further, this request is in conformation with the intent of the resolution; the proposed structure is appurtenant (belonging) to the principal use and reasonably necessary; the structure is intended for a quarters for persons customarily (habitually or commonly) rengaged in the principal use--all per Section 3.3 A; 3.3 B.3; 3C and 3 G. In addition requirements of Section 12.2 (2) are met. While Section 3.3 D.4 (page 10 of the resolution) may or may not beapplicable I feel that possibly my original request stipulated a condition that could have been considered but �✓r � �q the Zoning Office did not address this.
