HomeMy WebLinkAbout930809.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS COMPRESSOR STATION) - SNYDER OIL CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Snyder Oil Corporation, 1625 Broadway, Denver, Colorado 80202, for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility (natural gas compressor station) on the following described real estate, to-wit: Part of the SW,' SW* of Section 22, Township 8 North, Range 58 West of the 6th P.M. , Weld County, Colorado WHEREAS, at said hearing on August 18, 1993, the Board deemed it advisable to continue said matter to September 8, 1993, at 10:00 a.m. , and WHEREAS, at said hearing on September 8, 1993, said applicant was represented by Paul Morris and Bill Delap, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. This proposal will not remove any prime agricultural land from production. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for in the Weld County Zoning Ordinance as a Use by Special Review. c. The permitted uses will be compatible with the future development of the surrounding area which is expected to remain agricultural. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility (natural gas compressor station) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. Kirkmey r 930809 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS SNYDER OIL CORPORATION USR #1019 1. The Site Specific Development Plan and Special Review Permit is for an oil and gas support and service facility (natural gas compressor station) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 7. Property shall be maintained in compliance with S.A.R.A. , Title III. 8. Fugitive dust shall be controlled on this site. 9. Fifteen-inch culverts shall be constructed at both accesses to the site to handle run-off water. 10. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 930809 DEVELOPMENT STANDARDS - SNYDER OIL CORPORATION (S22, T8N, R58W) PAGE 2 14. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 930809 HEARING CERTIFICATION DOCKET NO. 93-58 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS COMPRESSOR STATION) - SNYDER OIL CORPORATION A public hearing was conducted on September 8, 1993, at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated July 28, 1993, and duly published August 5, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Snyder Oil Corporation for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility (natural gas compressor station) . Lee Morrison, Assistant County Attorney, made this a matter of record and noted said matter had been continued from August 18, 1993, because the applicant had not met the sign posting requirements. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. He explained additional correspondence between Paul Morris, representing Snyder Oil Corporation, and Gloria Dunn, Planning Department, had occurred since the Planning Commission meeting, and staff recommends removing Development Standards #7 and #8 requiring an individual sewage disposal system and a water supply. Mr. Thompson also indicated John Pickle, Health Department, found these deletions reasonable and acceptable. Mr. Morris and Bill Delap represented the applicant, and Mr. Morris explained the proposal is for a natural gas compressor to process additional gas in the area. He said it will be a small site, with only 400 barrels of storage. Mr. Morris said the facility will be monitored daily by one person for up to one hour. Mr. Delap said the site is unattended, but there are signals if anything goes down. In response to a question from Commissioner Webster, Mr. Morris said all Conditions of Approval and Development Standards are agreeable. In response to a question from Commissioner Kirkmeyer, Mr. Thompson said Mr. Morris' letter indicates a person would be on site for one hour at the most and would bring his own water supply. Mr. Thompson confirmed for Chairman Harbert, concerning Development Standard #7, that there would be no septic system on site. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Snyder Oil Corporation for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility (natural gas compressor station) , based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, with the deletion of Development Standards #7 and #8. We have in place a protocol with the Fire Department in the form of our Emergency Response Plan. In addition, we have on site Fire extinguishers of suitable size and classification to fight potential fires. Animals No animals on use site. Waste and Storage Storage capacities for pressurized natural gas liquids is approximately 60 ,000 gallons. Storage for crude oil/ condensate is approximately 200 barrels. Storm Water Retention Facilities None necessary as soil should take all storm water (see soil report) . Removal and Disposal of Debris and Wastes Production water from oil wells is removed by truck on a weekly basis and disposed of in water disposal sites approved by the State of Colorado Oil and Gas Commission. Junk and debris is removed on and annual basis and disposed of in an approved landfill . Erosion Control Measures Approximately 40% of the site is rock, gravel , road base or power plant bottom ash. Remainder is occasionally cultivated to prevent wind erosion. Reclamation Procedures If no other alternative uses for the facility, we would disassemble equipment (including concrete foundations) and remove from site. Site would then be returned to its original conditions and grade. Construction and Start-up Timetable We would like to commence construction on or about July 1 , 1993 . We should have this facility operating within four months of commmencement. 930899 Weld County Comprehensive Plan The equipment addition to this gas processing facility will increase our ability to meet the high processing demands created by the large number of gas wells currently being completed and put on line in Weld County. This is consistent with Item 7 of the Agricultural Goals of the Weld County Comprehensive Plan: "develop policies and regulations to permit development of oil, gas, on agricultural lands" . The special review area is located in an area dominated by irrigated farming, dry land farming and grazing. Because of the relatively small size of the site to the grazing capacity of the area, the impact of the proposed use on agricultural development would be insignificant. Further the SRA is a compatible use of the land within the vicinity since the area has a number of producing oil and gas wells with associated production equipment which requires daily attention. In the short term, the approved amended SRA would increase the assessed value of the property, thereby increasing revenue to the county. More importantly, it will contribute to the present and future development of Weld County's mineral resources. This will, in turn increase the future tax revenues to the county. As mentioned previously, the development of the county's mineral resources is consistent with Goal 7 of the plan. This property is not in an incorporated area and is zoned agricultural (mainly farming operations) . No farming operations on the use area. This approximately . 34 acre parcel has been removed from livestock grazing. There is adequate protection of the inhabitants of the neighborhood and the county as we have an Emergency Response plan that complies with SARA Title III, Community's Right to Know. The permitted use will be compatible with adjacent land use of either farming or livestock grazing. The permitted use will be compatible with the future development of the surrounding area as oil and gas production is inherent and prevalent in this area of Weld County and this facility is in place to process gas from wells in Weld County. Geologic floodplain and airport overlay: The area subject to Special review is not located in a 930809 geological hazard, floodplain, or Weld County Airport overlay district area. Noise The SRA is to have a noise level measured twenty-five (25) feet from the property line of less than 80 decibels which will comply with the industrial standard. Soil Report largely, one variety of soil underlies the USR in the SWSW Sec. 22, Township 8N, Range 58W, Osgood sand 0-3% slope capability, subclass IVe irrigated, VIe nonirrigated. Permeability is moderately rapid. Available water capacity is moderate. Surface runoff is very slow, and the erosion hazard is low when properly controlled by limited cropping or graveling or natural mowed vegetation. See attached soil survey. KRAGER, WAYNE L. KRAGER, and JANET AIKENS, Individually and the as sole heirs of Alice Kroger, Deceased, New Raymer, Colorado 80742, Lessor, and Snyder Oil Corporation, Lessee. WITNESSETH: That in consideration of the payment of the rent and the performance of the covenants and agreements herein by Lessee, hereinafter set forth, Lessor does hereby let and lease and demise unto the Lessee the following described premises for the use and purpose herein set forth, in the County of Weld, State of Colorado, to-wit: Township $ North, Range 58 west, 6th P.M. To pay the rent for said premises as hereinabove provided, to keep the improvements upon said premises, in good repair at the expense of said Lessee, and at the expiration of this lease to surrender and deliver up said premises in as good order and condition as when the same were entered upon, to use said premises for the purposes of constructing, operating and maintaining gas collection, handling, treating, processing, and compression facilities, and all buildings, tanks, machinery, pipeline and other fixtures necessary for such usage, together with the right to lay, operate, repair, maintain, and remove pipelines for water, gas or oil , and their by-products thereon, together with the right of ingress and egress over and across existing roads for such utilization and purposes, and for no purposes prohibited by the laws of the united States of State of Colorado, or the ordinances of said Weld County, to neither hold nor attempt to hold the Lessor liable for any injury or damage; 2 . The Lessee covenants and agrees to fence the leased premises with a good and sufficient fence which will prohibit Lessor's livestock from getting on the lease premises, and on the termination of this Lease, Lessee, its assigns, or authorized agent, shall have the right to remove all machinery, buildings, tanks, pipe, and fixtures located on the premises, or connected therewith, at any time therefrom upon abandoning the premises and structures placed thereon and to reseed the grass that may have been destroyed during Lessee's occupance. It being Lessee's sole and exclusive responsibility to leave the leased premise at the expiration of this term in as good a condition as the same were at the being of this tenancy; 4. Lessee agrees to take reasonable effort to limit employee and business invitees access to the site and road way access thereto to compressor and pipeline related business only; 5. Lessee agrees to indemnify and hold Lessor harmless for any damages caused by Lessee's operations on the leased premises; 6. Lessee shall maintain the site free of weeds and litter 7. Lessee shall pay all damages from its operations, including without limitation, damages or injuries to livestock, persons, personal property and real property. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties aforesaid, that if the rent above reserved, or any part thereof, shall be in arrears, of if default shall be made in any of the covenants or agreements herein contained, to be kept by the said Lessee, it shall end may be lawful for the said Lessor to declare said term ended, and enter into the said premises, or any part thereof, either with or without process of law, to re-enter and the said Lessee or any other person or persons occupying the -same, to expel, remove, and put out, using such force as may be necessary in so doing, without being liable to prosecution or in damages therefor, and the said premises again to repossess and enjoy, as in the first and former estate of said Lessor with at lease sixty (60) day notice to vacate for purpose of right to remove. AND IT IS FURTHER UNDERSTOOD AND AGREED that this Lease may be assigned by either party and all the covenants and agreements in this Lease contained shall extend to and be binding upon, the heirs, personal representatives, legal representatives and assigns of the respective parties thereto, also Lessee is to inform Lessor, in writing, in the event an assignment or transfer of the Lease is made, with exception to any assignment, transfer or disposition of interest to a subsidiary or affiliate of Snyder oil Corporation.
