Property Tax Administrator, Mary E . Huddleston, Division of
Property Taxation, in a Memo to^ County Assessors Dated June
23, 1992, unlawfully advised the County Assessors in that
Memo that the effective date of SB 92-101 is June 2, 1992 .
To the contrary, that is not the effective date, it is the
approval date . Nowhere in SB 92-101 is there an effective
date . Therefore, in the absence of an effective date, to
comply with the Property Tax Administrator ' s "All changes
should he implemented for assessment years 1992 forward" is
unlawful and to do so would be tantamount to enforcing an ex
post facto law which is unconstitutional and unlawful .
The Weld County Board of Equalization exacerbated and
compounded the unconstitutional act of the Property Tax
Administrator of June 23, 1992, when, on August 10, 1992, it
passed a resolution requiring the revaluation of subdivision
lands affected by SB 92-101 .
The provisions of SB 92-101 should only be applied
prospectively, not retroactively, and therefore would only
be applicable, if at all, commencing with assessment year
1993 forward.
Therefore, we respectfully request that the valuations
for the subject property (s) be revised to reflect the
valuations that were established prior to receipt by the
County Assessor of the Memorandum from the Property Tax
Administrator of June 23, 1992, and the subsequent passage of
the Resolution by the Weld County Board of County
Commissioners implementing that Memorandum to the original
Real Property Notice (s) of Valuation for the subject property
which were received by Petitioner herein in late April or
early May of 1992 .

Feuer/Cersonsky Abatement Petitions to the
subject: Assessor
Feuer & Cersonsky have submitted Petitions arguing that the Weld
County Board of Equalization, by its Resolution of August 10, 1992,
acted unconstitutionally in revaluing subdivision lands affected by
SB92-101 . The Abatement Petitions themselves are somewhat lacking
in as much as they do not indicate for which years the Abatement is
sought. It would appear, however, that the Abatement is sought for
the year 1992 collectable in 1993 and therefore no taxes have yet
been paid on what Mr. Feuer claims to be erroneous assessments .
Nonetheless, the Board of County Commissioners could deal with the
Petition.
Mr. Feuer argues that the effective date of SB92-101 cannot be the
date of signature. However the Colorado Constitution expressly
provides, at Article 5, Section 19 that the effective date of a law
is on the date stated in the act or if no date is stated in the act
then upon its passage. However, it is also true that a statute is
presumed to be prospective in its operation pursuant to C.R. S .
Section 2-4-202 .
The issue then becomes is the effect of SB 101 retroactive where
individuals assert that they had a set valuation only to have that
valuation changed prior to the end of term for the County Board of
Equalization (CBOE) , which is August 10 of each year, pursuant to
39-8-107 .
The CBOE, in addition to hearing individual taxpayer appeals, also
reviews the valuations for assessment of all taxable property on
the assessment roll of the county and may correct any errors made
by the assessor to insure that all valuations within the County are
just and equalized pursuant to 39-8-102 ( 1) C .R. S . It is my view
that since the assessment roll was not yet set as of June 2, 1992
for the County, SB92-101 would act prospectively by being applied
on August 10, 1992 . Had the effective date of SB92-101 been after
August 10 when the assessment role is set, then Mr. Feuer ' s
argument would have greater merit .
My conclusion is that by Colorado Constitution, the signature date
( 6/2/92 ) is the effective date and the tatute was not applied
prospectively because the assessment 1 need not be -finalized
until August 10, 1992 .

MEMORANDUM
SB 92-101 CONCERNING PROPERTY TAXES
This bill 's effective date is June 2, 1992 and all changes should
be implemented for assessment years 1992 forward. The broad title
allowed for multiple statute revisions as detailed below:
39-1-103 Actual Value determined - when.
Changes section (14) (b) describing the method used to value vacant
land. It limits the costs of development used in the present worth
calculation to direct costs of development, and stipulates that
indirect costs such as costs relating to marketing, overhead or
profit shall not be considered or taken into account in the
discounting procedure.
The Division is working with the land developers to further define
direct and indirect costs of development. A procedure will be
published as soon as possible.
39-1-104.2 Legislative declaration - adjustment of residential rate
- role of state board of equalization.
Changes the date in section (7) (a) back to September 20. This is
the date the state board adjusts the residential rate in years when
the level of value changes.
39-1-102. Definitions.
The definition of "fixtures", section (4) is amended to exclude
security devices and systems, such as security doors, security
bars, and alarm systems, that are affixed to any residential
improvements.
