RE: AMENDING RESOLUTION DATED NOVEMBER 18, 1992, GRANTING FINAL PUD - LIND
LAND COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution on November 18, 1992, the Board did grant Final
Planned Unit Development Plan and Site Specific Development Plan for Lind Land
Company, and
WHEREAS, the Board has been presented with a letter from Windsor School
District RE-4 waiving the impact fee to be paid for each lot, which was Condition
of Approval 3.o. (2) of said Resolution, and
WHEREAS, said Condition of Approval concerned notes to be placed on the
Final Plat, and
WHEREAS, the Department of Planning Services staff has recommended the
Board amend the Resolution of November 18, 1992, by deleting Condition of
Approval 3.o. (2) , and deleting said note from the Final Plat, and
WHEREAS, after review, the Board has deemed it advisable to follow staff
recommendation in this matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Resolution of November 18, 1992 be, and hereby is,
amended by deleting Condition of Approval 3.o. (2) .
BE IT FURTHER RESOLVED by the Board that said Department of Planning
Services staff be, and hereby is, directed to delete said note from the Final
Plat.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 14th day of April, A.D. , 1993.

Gentlemen:
In recent years, this school district has utilized your policy
which has permitted us to request cash in lieu of land from
developers of residential areas within our boundaries. We are
suspending all of those prior requests immediately because of our
inability to convince the Town of Windsor to enact a similar
requirement. Hopefully, in the future we will convince the Town
of Windsor to seek impact fees from developers just as Weld
County does. If that does occur, we will again seek your
cooperation in assessing impact fees as you have in the past.
We have only received impact fees from one developer or home
builder thus far and we have refunded his payment. You may issue
building permits to county developers in our school district from
now on without receipt of payment from us.

Re: Lind Land Company/Wind Song Ranch Development
Part of the NE 1/4 of Section 8, Township 5N,
Range 67 West of the 6th Principal Meridian in
Weld County, Colorado.
Dear Members of the Board:
The Little Thompson Water District will supply water to the
above referenced subdivision in accordance with our previous
commitment to do so. Since the District will not be involved in the
construction of the water lines, and will not assume ownership of
the water lines until all construction is complete and the lines
have passed the appropriate tests, there are no bonding
requirements of the developer by the District.
The developer has agreed to follow District procedures and to
install the water lines in accordance with District Specifications.
If you have any questions, or should you need additional
information, please contact our office.

Part of the NE 1/4, Section 8, Township 5 North,
Range 67 West of the 6th P.M. , Weld County, CO
Dear Members of the Board:
Public Service Company will be supplying the natural gas to
the Wind Song Ranch Development in Weld County, Colorado. Please
accept this letter on behalf of Public Service Company as its
waiver of any bonding requirements by the developer with Weld
County. Public Service Company will not be looking to the County,
for a bond of performance. Public Service Company has established
a satisfactory arrangement with the developer independent of any
bonding agreement between the developer and Weld County, to assure
the installation of the natural gas service to the development.

the electrical service to the Wind Song Ranch Development in Weld
County, Colorado . Please accept this letter on behalf of Poudre
Valley REA, as its waiver of any bonding requirements by the
developer with Weld County . Poudre Valley REA will not be looking
to the County, for a bond of performance. Poudre Valley REA has
established a satisfactory arrangement with the developer and Weld
County, to assure the installation of the electrical service to the
development .
