Everist Carr pit diversion structure project which will impact approximately 0.48 acres of Lone Tree Creek located in Section 26, T-11-N, R-67-W, Weld co. , Colo. , has been reviewed by this office. Based on the information provided, this office has de- termined that the proposed work is authorized by the Depart- ment of the Army Nationwide Permit found at 33 CFR Part 330.5( a) (26) . Enclosed is a fact sheet which fully describes this Nationwide Permit and lists the Special Conditions which must be adhered to for this authorization to remain valid. Although an Individual Department of the Army Permit will not be required for the project, this does not eliminate the requirement that other applicable Federal, State, or Lo- cal Permits be obtained as required. Please note that de- viations from the original plans and specifications of the project could require additional authorization from this of- fice. Should at any time it becomes evident that either an en- dangered species or its critical habitat exist within the project area, this office must be immediately notified. This verification will be valid until the nationwide permit is modified, reissued, or revoked. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 13 January 1992. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Fur- thermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation to complete the activ- ity under the present terms and conditions of this nationwide permit. (26) Discharges of dredged or fill material into man-tidal rivers, streams, and their lakes and impoundments, including adjacent we t1 ds, that are 'neared above the headwaters; and other non-tidal raters of the IInited States, 3.11::1:: adjacent vet].ands. that are not part of a surface tributary system to interstate waters or navigable waters o£ the United State° (i.e., isolated -waters), ezeapt those discharges which cause the loss of subatantital adverse modification of l0 acres or more of mach waters of the United States. For discharges which cause the lose or substantial adverse modification of 1 to 10 acres of such raters, including wetlands, notification to the district engineer is required in accordance with 33 CPR Section 330.7. (h) Conditions. The following apeeial conditions where applicable mast be complied vitt for the Nationwide Permit authorization to remain valid: (1) That any discharge of dredged or fill material will not occur in the proximity of a public water supply intake. (2) That any discharge of dredged or fill material will not occur in areas of concentrated shellfish production unless the discharge is directly related to a shellfish harvesting activity authorized by 33 CPR Part 330.5(a)(4). (3) That the activity will not jeopardize a threatened or endangered species as identified under the Endangered Species Act (ESA), or destroy or adversely modify the critical habitat of such species. (4) That the activity shall not significantly disrupt the movement of those species of aquatic life indigenous to the watetbody (unless the primary purpose of the fill is to impound vater). (5) That any discharge o£ dredged or fill material shall consist of suitable material free from tone pollutants (see Section 307 of the Clean Water Act) in toxic amounts. (6) That any structure far fill authorized nhall be properly maintained. (7) That the activity mill not occur in a component of the National Wild and Scenic River System; nor in a river official') designated by Coagresa an a "study river" for possible inclusion in the system, while the river is in an official study status. • (10) That the construction or operation of the activity will not impair reserved tribal rights, included, but not limited to, reserved water rights and treaty fishing and hunting rights. 33 CFR Section 330.6 Management Practices (a) In addition to the conditions specified above, the following management practices shall be followed, to the maximum extent practicable, in order to minimize the adverse effect of these discharges as the aquatic environment. Failure to comely with these practices may be cause for the district engineer to recommend, or the division engineer to take, discretionary authority to regulate the activity au an individual or regional basis pursuant to 33 CPR 330.8. (1) Diar4.nrgea or dredged or fill material into waters of the United States shall be avoided or minimized through the use of other practical alternatives. (2) Discharges in spawning areas during spawning season shall be avoided. (3) Discharges shall mot restrict or impede the movement of aquatic epee= indigene to the waters or the passage of normal or expected high flaws or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). (4) If the discharge creates an isq+oumdment of water, adverse impacts on the aquatic system canoed by the accelerated passage of water and/or the restriction of its flow shall be minimized. Since the proposed well will be an infiltration gallery, different from standard well construction, a variance must be obtained prior to the approval of a well permit. Rule 17 of the Revised and Amended Rules and Regulations of the Board of Examiners of Water Well- Construction and Pump Installation Contractors states that a request for a variance shall be submitted in writing and shall be signed by the well owner or agent. The request shall specify the nature and reason for seeking the variance, the proposed construction details, and special precautions that will be taken to protect the well from contamination. Everist Aggregate Operation Dear Bruce: This letter is to request a variance for the proposed infiltration gallery for the L.G. Everist aggregate operation near Carr, Colorado and is being submitted in response to your letter to Melvin Sabey dated September 11, 1990 (re: Issuance of Well Permit - L.G. Everist, Inc.). The proposed well is to supply water for the wash plant and for dust con- trol for the aggregate operation. An infiltration gallery is proposed: (I) to enable pumping of water to the storage ponds, and (2) to ensure an ade- quate supply. • Attached is a general drawing of the proposed infiltration gallery. The characteristics of the well are as follows: o Maximum capacity = 560 gpm; o Capacity limitations: 35 gpm during times of valid call from 5/15-9/1.5; o Gallery consists of 6-inch stainless steel pipe; and o Total elevation head +15 feet. The well will be used for industrial uses and storage and not for domestic or livestock watering. Therefore, contamination is not a concern. However, • , if requested, a berm could be constructed to reduce the possibility of well contamination from surface runoff. We trust this information meets your needs. The pumping must not exceed 12 hours per day when the maximum flow of Lone Tree Creek Is less than .33 cis. 4) The average annual amount of ground water to be appropriated shall not exceed 40 acre-feet (requested by the applicant). 5) The use of ground water from this well is restricted to Industrial use,including storage,primarily for dust control and gravel washing. 6) A totalizing flow meter must be installed on the well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner(recorded daily between May 15 and September 15,and weekly the rest of the year) and submitted to the Division Engineer and Water Commissioner. 7) The owner shall mark the well to a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. He shall take necessary means and precautions to preserve these markings. 8) This well shall be constructed at least 800 feet from any existing well. 9) The well shall be constructed to accordance with the variance granted by the Board of Examiners of Water Well Construction and Pump Installation Contractors on September 28, 1990.
