RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN ACCESSORY STRUCTURE LARGER THAN 1500 SQUARE FEET (4608 SQUARE FEET) IN A PLATTED SUBDIVISION IN THE A (AGRICULTURAL) ZONE DISTRICT - JOSEPH A. AND ALLANA M. REIDER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of November, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Joseph A. and Allana M. Reider, 3313 Lowell Lane, Erie, Colorado 80516, for a Site Specific Development Plan and Special Review Permit for an accessory structure larger than 1500 square feet (4608 square feet) in a platted subdivision in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot 7, Block 4, Ranch Eggs Subdivision, Weld County, Colorado WHEREAS, Joe Reider, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: PL0887 921099 SPECIAL REVIEW PERMIT - ABIDER PAGE 2 a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The Urban Growth Boundary Area section provides for the County to encourage land-use development proposals as long as they conform to the desires of affected municipalities. This land use is located within the Urban Growth Boundary Area of four municipalities. All municipalities involved have reviewed this request and expressed no objections. b. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land-uses which include agricultural production, pasture, rural residences, and egg production facilities. The uses will be compatible with the future development of the surrounding area as permitted by the A (Agricultural) Zone District. d. No overlay districts affect the site. e. The Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an accessory structure larger than 1500 square feet (4608 square feet) in a platted subdivision in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Site Specific Development Plan and Special Review Permit is for a structure larger than 1500 square feet (4608 square feet) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. Manure from the livestock area shall be removed and handled in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. No permanent disposal of wastes shall be permitted at this site. 5. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. The Special Review Permit area shall be for the private use only of the property owners and shall not be used for any commercial activity. 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 9. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 10. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 921099 DEVELOPMENT STANDARDS - REIDER PAGE 2 11. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 12. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Joe Reider, applicant, was present and stated the building is for an indoor riding arena for pleasure, hay storage, and livestock shelter. In response to a question from Commissioner Lacy, Mr. Schuett said the building was started before any permits were issued. Commissioner Lacy questioned whether this building is strictly for personal use. Mr. Reider confirmed it was. At the request of Commissioner Lacy, Mr. Schuett read suggested language for a new Development Standard #6, with the following numbers to follow consecutively, into the record as follows: "The Special Review Permit area shall be for the private use only of the property owners and shall not be used for any commercial activity." Mr. Reider said he is agreeable to the addition. On behalf of Commissioner Kirby, Mr. Morrison confirmed said language. Mr. Schuett confirmed that the State Engineer had no problems with the stormwater plan, and the home is in place and meets all requirements. Commissioner Kirby moved to approve the request of Joseph A. and Allana M. Reider for a Site Specific Development Plan and Special Review Permit for an accessory structure larger than 1500 square feet (4608 square feet) in a platted subdivision in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Webster, and there was no public testimony offered. Commissioner Lacy recommended including the additional Development Standard in the motion. Reider have requested a special permit to build a structure larger than 1500 square feet in a platted subdivision in the A(Agricultural) zone district. More specifically, the structure is 4588.8 square feet. This is a follow up to the 10/27/92 telephone conversation between Mr. George Kennedy, Weld County Commissioner, and me. I understand that construction of the building in question was initiated and continued without permit until challenged by Weld County officials, who happened to be inspecting another building in the area. Only then was a building permit application even submitted. Construction continues on the building, even though the County Commissioners have not ruled on this special permit. To me, this indicates a complete disregard for the County Commissioners' authority. As I told Mr. Reider, I am not adamantly opposed to the building in question. Upon reflection, however, I feel compelled to state that I am opposed to the total disregard for county rules that construction of the building seems to indicate. Mr. Reider built his own home on the property, and I understand that he is a contractor by trade. In light of this, I feel certain that Mr. Reider was aware of building code restrictions, regardless of any allegations to the contrary. In my opinion, the Planning Commission members failed to meet their obligation in dealing with this issue. Why it is up to the public (in this case, me) to defend laws that are already on the books? Neighbors are now in the position of defending legal requirements that should be enforced by the legal system. Of what purpose are the restrictions if there is no enforcement? 921099 Ey,14it' IT L. cc. /°I. My concern is that the Planning Commission is allowing a precedent to be set in allowing this structure to remain. Such a precedent could nullify the building code restrictions. Mr. Reider's statement to me that he will be doing additional construction within this subdivision adds to that concern. I'm looking to you to insure that the zoning restrictions governing Ranch Eggs Subdivision are upheld.
