HomeMy WebLinkAbout920571.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1424 - GENE DRAKE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1424, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1424 was submitted by Gene Drake for property which is located in part of the SW* of Section 14, Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 134 acres and 1 acre. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. Prior to recording the plat, the applicant shall submit a complete mobile home zoning permit application for a principal dwelling to the Department of Planning Services for review and approval. 2. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall show a 30-foot access easement for the benefit of Lot A. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The parcel of land is described as part of the SW4 of Section 14, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property is located approximately one mile southwest of the Town of Ault; east of Weld County Road 33 and approximately 1/2 mile south of Highway 14. This request is to divide a 135 acre tract into two parcels of 134 acres and 1 acre, more or less. The property is currently served by North Weld County Water District and individual septic systems. This proposal is to split off a one acre tract with an existing mobile home on it. The mobile home is permitted for accessory to farm use. There is an existing stick-frame house on proposed Lot B. This parcel is the total contiguous land owned by the applicant. The Department of Planning Services' staff has concerns about the level of development and the potential for continued divisions in this area. This application represents the second split of this parcel. There are several other parcels in the area as illustrated in the attached maps. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, police and fire protection and school busing. The service demands increase as the density is increased. It is the opinion of the staff that further divisions of this property may evade the purpose of the Weld County Subdivision Regulations. The staff requests that the Board consider this application and determine if the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. Sincerely. Frain, Second Party, WITNESSETH: WHEREAS, First Party owns a portion of the Southwest Quarter (SW1/4) of Section Fourteen (14) , Township Seven (7) North, Range Sixty-six (66) West of the 6th P .M. , Weld County, Colorado, which is to be split pursuant to a Recorded Exemption procedure through the Weld County Planning Department regulations and rulings; and WHEREAS, the portion of said land to be acquired by Second Party is isolated from the County and public Roads, requiring availability of an adequate easement for a driveway for access of ingress and egress, not only of the Second Party and those under him, but also by control vehicles, fire, and other emergency services; and WHEREAS , the First Party and his farming tenants will require use of the same driveway in properly operating the farming lands of First Party. NOW, THEREFORE, in consideration of the foregoing and other valuable considerations mutually acknowledged, the First Party does agree to grant to Second Party a thirty foot (30 ' ) wide right-of-way and easement for joint use by parties needing use thereof through either First or Second Parties, including emergency service vehicles. IT IS FURTHER AGREED, that both parties shall share equally the costs of maintenance of the joint driveway. IT IS FURTHER AGREED that the attached diagram shoes the approximate location of the joint driveway, and that, when a survey has been obtained that the parties will execute an instru- ment showing and conveying the exact location and extent of said joint driveway.
