APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

Dear Mr. Turner:
Your recorded exemption application is complete and in order and will be processed
on or before January 23, 1992. If it is determined that the application meets the
approval criteria of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations, you will be notified that the recorded exemption is
approved. If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date prior
to the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the City of Longmont Planning Commission for its review and comments.

time, and place of this meeting. It is recommended that you and/or a representative
be in attendance at the Longmont Planning Commission meeting to answer any questions

RE: Request for a recorded exemption on Pietrzak Farm '
( see attached legals and map) .
The purpose of this letter is to provide the statements required
in the Procedural Guide, under application requirements , four
thru 11 inclusite , therefore in regards to :
#4 . The purpose of dividing this parcel is to allow the
building of a second home on this land. The
purchasers have some specific age and health requirements
for a home that the existing home does not address .
#5 . The property is designated as Low Density Residential
in the I-25 Mixed Use Development Area; the current
economic climate dictates that this remain a "Gentleman
Farm" until a full PUD makes financial sense . This
division is a logical transition from a farm to a
subdivision.
#6 . The zoning could be described as "in transition" .
This proposal is consistent with either zoning
allowed on this parcel , (A or P.U.D. )
#7 . Existing Ag uses , existing oil and gas production uses ,
if any, and the existing residential uses , will be allowed ,
plus one additional residential use. These uses are
identical to, and compatible with, surrounding land uses ,
#8 . There is no conflict between the residential uses
allowed in our proposed Recorded Exemption , and
any uses allowed thru Weld County or any municipality
as they would all be residential .
#9 . This proposal will not be inconsistent with efficient and
orderly development because the density requested is so
much smaller than that which could be allowed that the
impacts are negligible , only one additional access is
proposed.
#10 . The existing home has private septic system, installed
when the property was built , (1976) , and met , or exceeded ,
all applicable codes . The new dwelling , Cwhen a new
building permit is applied for) , will meet , or exceed,
health codes . Water is provided by Longs Peak Water
District , as stated on the attached letter. The existing
house will comply with their requirements, as will the
new home .

Dear Brian:
Thank you very much for sending the application from the Pietrzaks for a recorded exemption
to the City of Longmont for our review and comment. The proposed exemption is located
southeast of Union Reservoir, south of WCR 26 and west of WCR 3 1/2.
The applicant proposes to split a 62 acre±parcel (Parcel 1 of Subdivision Exemption 392) into
a 60 acre±parcel and a 2 acre± parcel. The existing home will be on the smaller parcel. The
applicant's intent is to sell the larger parcel for a home site/"gentleman farm."
The City of Longmont has no comments on this proposed subdivision exemption. However, we
would like to clarify one point. The map submitted with the application indicates that an
adjacent parcel (Parcel 2 of Subdivision Exemption 392) was "taken by Longmont under threat
of condemnation." The City of Longmont purchased the property at the appraised value through
negotiations with the Pietrzaks and a purchase agreement. We did advise the Pietrzaks that the
City would use its power of eminent domain if necessary.

Dear Arnold:
As you know, we represent Longs Peak Water Association. The Association's Board of
Directors requested me to write to you regarding the status of the Pietrzak water taps.
As you may recall , on August 8, 1985, the Association entered into that certain
Agreement Re Water Tap with Susan R. Pietrzak and Harry Amen, a copy of which is
enclosed with this letter. Pursuant to that Agreement, Mrs. Pietrzak agreed, among
other things, to install and maintain at her expense a cistern with a capacity of at
least 500 gallons for the storage of water to be used by Tap B15 at 1476 Weld County
Road 26. It is my understanding that the cistern was never installed.
It is my understanding that, because of insufficient water pressure in the
Association's water line serving that area, no additional tap will be granted until the
Agreement dated August 8, 1985 is fully performed by the Pietrzaks and further that the
new tap will be issued only pursuant to a similar, recorded Agreement and the
installation of a cistern for the new tap.
Will you please check with the Pietrzaks and advise me of their plans for compliance
with the terms of the August 8, 1985 Agreement.

AGREEMENT RE WATER TAP
1. PARTIES. The parties to this Agreement are LONGS PEAK WATER
ASSOCIATION (Association) , a Colorado not-for-profit corporation, SUSAN
R. PIETRZAK (Member) and HARRY AMEN (Tenant) .
2. RECITALS AND PURPOSE. Member is the owner of real property which is
more fully described on the attached Exhibit A. Member currently owns
one water tap which is located on said property at 1476 Weld County Road
26 and which is identified in the Association' s records as Tap B15.
Member has leased a portion of such property to Tenant with an address of
11566 Weld County Road 3-1/2. Tenant plans to put a mobile home on the
property and desires that the Association provide domestic water service
to such mobile home. Initially, the Association denied service on the
grounds that there was insufficient water pressure in the Association' s
water lines serving such area and that the Association could not provide
an adequate level of service. Notwithstanding such situation, the Member
and the Tenant still desire service. Accordingly, the Association has
agreed to provide service on the terms and conditions set forth in this
Agreement.
3. CONDITIONS FOR SERVICE. Member has submitted the Association' s
standard form of Membership Application dated December 17, 1984, along
with Member' s check in the amount of $3,500.00 for the tap fee, the
receipt of which is hereby acknowledged by the Association. In addition
to the requirements set forth in the Application that the Member is
subject to all rules, regulations, and bylaws or policies of the Associa-
tion as they may now or hereafter exist, the Member and the Tenant
understand and agree that they will be required to install and maintain
the following as conditions to the Association providing water service to
them:

3.2 All water used by the Owner for Tap B15 will be piped from such
cistern and will not be taken directly from the Association's water
line feeding such cistern under any circumstances ;
3.3 That a float-type shut-off valve and a pressure regulating
valve whose respective specifications are previously approved in
writing by the Association' s engineer will be installed at Owner's
expense on the water line feeding the cistern and maintained at all
times at Owner' s expense in a manner acceptable to the Association.
The parties agree that this Agreement supersedes and replaces in all
respects that certain Agreement Re Water Tap dated January 10, 1985.

4. ASSIGNMENT. This Agreement shall not be assigned without the prior
written consent of the parties.
5. NOTICES. Any notice required or permitted by this Agreement shall
be in writing and shall be deemed to have been sufficiently given for all
purposes if sent by certified or registered mail , postage and fees pre-
paid, addressed to the party to whom such notice is intended to be given
at the address set forth on the signature page below, or at such other
address as has been previously furnished in writing, to the other party
or parties. Such notice shall be deemed to have been given when deposi-
ted in the U. S. Mail .
6. EXHIBITS. All exhibits referred to in this Agreement are, by
reference, incorporated herein for all purposes.
7. DELAYS. Any delays in, or failure of, performance by any party of
his or its obligations under this Agreement shall be excused if such
delays or failure are a result of acts of God, fires, floods, strikes,
labor disputes, accidents, regulations or orders of civil or military
authorities, shortages of labor or materials, or other causes, similar or
dissimilar, which are beyond the control of such party.
8. PARAGRAPH CAPTIONS. The captions of the paragraphs are set forth
only for convenience and reference, and are not intended in any way to
define, limit, or describe the scope or intent of this Agreement.
9. ADDITIONAL DOCUMENTS OR ACTION. The parties agree to execute any
additional documents and to take any additional action necessary to carry
out this Agreement.
10. INTEGRATION AND AMENDMENT. This Agreement represents the entire
agreement between the parties and there are no oral or collateral agree-
ments or understandings. This Agreement may be amended only by an
instrument in writing signed by the parties. If any provision of this
Agreement is held invalid or unenforceable, no other provision shall be
affected by such holding, and all of the remaining provisions of this
Agreement shall continue in full force and effect.
11. ARBITRATION. Pursuant to Rule 109 of the Colorado Rules of Civil
Procedure, all controversies, claims, or disputes arising out of or re-
lating to this Agreement, or any alleged breach thereof, shall be deter-
mined by arbitration in Longmont, Colorado in accordance with the rules
then obtaining of the American Arbitration Association. The arbitration
award shall be binding upon the parties. The prevailing party may file
such award with the Clerk of the District Court of Boulder County who
shall enter judgment thereon. And if such award requires the payment of
money, execution shall issue on such judgment. The expenses of witnesses
for either side shall be paid by the party producing such witnesses. The
cost of the stenographic record, if any is made, and all transcripts
thereof, shall be prorated equally among all parties ordering copies
thereof unless they agree otherwise, and shall be paid for by such par-

tration, including the expenses of the arbitrator, and the expenses of

12. DEFAULT. Time is of the essence, and if payment or any other condi—

either party, then this Agreement, at the option of the party who is not

the nondefaulting party may recover such damages as may be proper. If
the nondefaulting party elects to treat this Agreement as being in full
force and effect, the nondefaulting party shall have the right to an
action for specific performance or damages or both.
13. WAIVER OF BREACH. The waiver by any party to this Agreement of a
breach of any term or provision of this Agreement shall not operate or be
construed as a waiver of any subsequent breach by any party.

15. GOVERNING LAW. This Agreement shall be governed by the laws of
