RE: VIOLATIONS OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES
A public hearing was conducted on October 11, 1994, at 10:00 a.m. , with
the following present:
Commissioner W. H. Webster, Chairman
Commissioner Dale K. Hall, Pro-Tem
Commissioner George E. Baxter
Commissioner Constance L. Harbert
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Lin Dodge
County Attorney, Bruce Barker
Planning Department representative, Barry Kramer
Planning Department representative, Chuck Cunliffe
The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether
to authorize the County Attorney to proceed with legal action against the
individuals named for violations of the Weld County Building Code and
Zoning Ordinances. Cases heard were as follows:
VI #2120 - Rex and Sharon Hiner/R.M. Hiner Construction Co. , Inc. : Barry
Kramer, Department of Planning Services, requested a continuance of this
case to allow property owners time to submit a Use by Special Review
application. He indicated he met with the property owners' representative
on October 10, 1994, and was confident the application would be the most
reasonable method of correcting the violation. Bruce Barker, County
Attorney, recommended the continuance pending action on the USR
application. In response to Commissioner Harbert, Mr. Kramer verified
that sixty days would be sufficient time for an application to be
submitted. The property owners were neither present nor represented. No
public testimony was offered. Commissioner Harbert moved to continue VI
#2120 against Rex and Sharon Hiner/R.M. Hiner Construction Co. , Inc. to
December 13, 1994, to allow the property owners time to submit a Use by
Special Review application to the Department of Planning Services. The
motion was seconded by Commissioner Hall and carried unanimously.
VI #2122 - Joanna M. Autobee: Mr. Kramer reported this case closed.
BCV #2128 - Country Estates/Mary Weymouth, Tenant: Mr. Kramer reported
this case closed.
VI #2131 - Basil D. Garcia: Mr. Kramer presented the case report,
including a video of the property made October 10, 1994, for the record.
He indicated the noncommercial junkyard on this property located in
Aristocrat Ranchettes consists of derelict vehicles, junk, piles of wood
and a large pile of recycled asphalt and is a violation of Sections 31.2
and 31.3.9 of the Weld County Zoning Ordinance. To correct the
violations, the property owner must submit a screening plan to the
Planning Department for approval and install said plan after approval, or
remove the junk from the property. The property owner was not present or
represented. No public comment was offered. Commissioner Hall moved to
refer VI #2131 against Basil D. Garcia to the County Attorney for legal
action. The motion was seconded by Commissioners Kirkmeyer and carried
unanimously.

The Department of Planning Services has scheduled the following violations to be considered at
the October 11, 1994 hearing beginning at 10:00 a.m. The Department of Planning Services is
requesting that the Board review the individual violation cases and determine weather or not to
authorize legal action to remedy the violations.
