The Board of County Commissioners of Weld County, Colorado, met
in regular session in full conformity with the law and bylaws of
said Board at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, March 20, 1991, at the
hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call
the following members were present, constituting a quorum of the
members thereof:

MINUTES: Commissioner Kennedy moved to approve the minutes of the Board
of County Commissioners meeting of March 18, 1991, as printed.
Commissioner Webster seconded the motion, and it carried
unanimously.
ADDITIONS: Lee Morrison, Assistant County Attorney, added as Item $2 under
New Business: Consider Acceptance of Petition for Annexation
for Weld County Road 2 - City of Northglenn.
CONSENT AGENDA: Commissioner Kennedy moved to approve the consent agenda as
printed. Commissioner Harbert seconded the motion, and it
carried unanimously.
DEPARTMENT HEADS AND
ELECTED OFFICIALS: Walt Speckman, Director of Human Resources, gave a brief report
on the status of several divisions within his department.
Let the record reflect that Commissioner Kirby is now present.
Warren Lasell, Assessor, reported that since taking office in
January he has found the people in the office to have a positive
attitude, and he believes the budget to be reasonable. He
reviewed the status of the audit and also of establishing
guidelines on how to appraise oil and gas equipment, since that
accounts for approximately $19 million in Weld County.
WARRANTS: Claud Hanes presented the following warrants for approval by the
Board:

Commissioner Kennedy moved to approve the warrants as presented
by Mr. Hanes. Commissioner Harbert seconded the motion which
carried unanimously.
Let the record reflect that a recess was taken at this time to
allow the Board to convene as the Board of Social Services.
BIDS: PRESENT OIL AND GAS LEASES - 57 PARCELS: Chairman Lacy reviewed
the procedure for opening the sealed, written bids. $10.00 per
acre is the minimum bid that will be accepted, and the top two
bidders plus anyone within 10% of the high bid will be allowed
to participate in an oral bid if they desire. As each parcel
was opened, Pat Persichino, Director of General Services, read
the legal description into the record, as well as the bid
amounts.

Lee Morrison, Assistant County Attorney, explained that this
parcel, along with parcel numbers 13, 14, 15, 18 and 19 are all
the subject of litigation being brought by Dean Cummins, and the
lease may be in jeopardy depending on the finding of the Court.
Wilbanks & Associates, Inc. was the sole bidder on each of these
parcels. Mr. Morrison suggested the Board open the bids and
then delay the approval of the parcels in question until March
27, 1991, in order to give Wilbanks & Associates, Inc. an
opportunity to withdraw their bid if they so desire. Margaret
Leiser, representative of Wilbanks & Associates, Inc. , was
present and stated that this is acceptable to her. The bid is
in the amount of $25.00 per acre, for a total of $4,000.00.
Commissioner Webster moved to delay the approval of said bid to
March 27, 1991 in order to give the bidder sufficient time to
withdraw their bid. Commissioner Harbert seconded the motion,
which carried unanimously.

unanimously.

PRESENT OFFICE SUPPLIES - PRINT SHOP: Mr. Persichino presented
this bid to be considered for approval on April 3, 1991. The
Office Place, in the amount of $16,625.08 was the apparent low
bidder. Scott Rice bid $19,488.02.
PRESENT BASSWOOD AVENUE LOCAL IMPROVEMENT DISTRICT #1990-2 -
ENGINEERING DEPARTMENT: Mr. Persichino read the bids received
from Western-Mobile Northern, Inc. in the amount of $11,777.80
and Best-Way Paving Company in the amount of $12,961.15. This
bid will be considered for approval on April 3, 1991.
APPROVE SHOT ROCK - ROAD AND BRIDGE DEPARTMENT: This is for
2,000 ton of Shot Rock. The sole bidder was Andesite Rock
Company in the amount of $11.40 per ton if using their loader
and their trucks; $5.90 if using their loader and our trucks;
and no bid using the County's loader and trucks. Dave Becker,
Assistant Director of Road and Bridge, was present and
recommended accepting their bid of $5.90 per ton, using
Andesite's loader and County trucks. The total will be
$11,800.00. Commissioner Kennedy moved to approve staff
recommendation. Commissioner Harbert seconded the motion, which
carried unanimously.
APPROVE PROSPECT VALLEY GRAVEL HAULING - ROAD AND BRIDGE
DEPARTMENT: Mr. Persichino read the memo from Donald Carroll,
Administrative Manager, recommending the acceptance of the low
bid from Bucklen Equipment in the amount of $106,000.00.
Commissioner Kennedy moved to approve staff recommendation.
Commissioner Webster seconded the motion, which carried
unanimously.

OLD: CONSIDER RESOLUTION RE: DELAY PUBLICATION OF SALE OF TAX
CERTIFICATE - R.A.S. AND ASSOCIATES, INC. (3-13-91) : Bruce
Barker, Assistant County Attorney, explained that although staff
had been instructed to publish notice of the sale of Tax
Certificate on March 21, 1991, he has not finished negotiating
the terms of the sale with R.A.S. and Waste Services, Inc. He
recommends delaying publication until such time as the terms and
conditions are certain. Commissioner Harbert moved to approve
said Resolution. Commissioner Webster seconded the motion,
which carried unanimously.
NEW: CONSIDER RESOLUTION RE: TEMPORARY CLOSURE OF WELD COUNTY ROAD 80
BETWEEN WELD COUNTY ROADS 39 AND 41: Commissioner Kennedy moved
to approve said Resolution, per staff recommendation.
Commissioner Harbert seconded the motion, which carried
unanimously.
CONSIDER ACCEPTANCE OF PETITION FOR ANNEXATION OF WELD COUNTY
ROAD 2 - CITY OF NORTHGLENN: Commissioner Kennedy moved to
accept said petition. Commissioner Harbert seconded the motion,
which carried unanimously.
PLANNING: CONSIDER RESOLUTION RE: VIOLATIONS OF THE ZONING AND BUILDING
CODE ORDINANCES - COOK, CITY OF GREELEY, PAPPAS, AND LEMAY:
Commissioner Kennedy moved to approve this Resolution
authorizing the County Attorney to proceed with legal action
against Shiela Cook, The City of Greeley, Rocky M. and Terri J.
Pappas, and Victoria LeMay for violations of the Weld County
Zoning and Building Code Ordinances. Commissioner Harbert
seconded the motion, and it carried unanimously.
RESOLUTIONS AND
ORDINANCES: The Resolutions were presented and signed as listed on the
consent agenda. There were no Ordinances.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
10:00 A.M.

The Board of County Commissioners of Weld County, Colorado, met
in regular session as the Board of Social Services in full
conformity with the law and bylaws of said Board at the regular
place of meeting in the Weld County Centennial Center, Greeley,
Colorado, March 20, 1991, at the hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call
the following members were present, constituting a quorum of the
members thereof:
Commissioner Gordon E. Lacy, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C. W. Kirby
Commissioner W. H. Webster
Also present:
Assistant Weld County Attorney, Lee Morrison
Acting Clerk to the Board, Carol Harding
Comptroller, Claud Hanes
MINUTES: Commissioner Kirby moved to approve the minutes of the Board of
Social Services meeting of March 18, 1991, as printed.
Commissioner Kennedy seconded the motion, and it carried
unanimously.
WARRANTS: Claud Hanes presented the warrants for approval by the Board in
the amount of $95,499.66. Commissioner Kennedy moved to approve
the warrants as presented by Mr. Hanes. Commissioner Webster
seconded the motion which carried unanimously.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
9:05 A.M.
