B 1393 . 02342591 07/23/93 144ts $0. 00 1/003 F 1252 MARY ANN FEUERSTEIN CLERK": RECORDER WELD CO, CO AH2342591 RESOLUTION RE: GRANT CHANGE OF ZONE FROM R-1 (LOW DENSITY RESIDENTIAL) TO E (ESTATE) FOR WELD COUNTY BOARD OF COMMISSIONERS (DOS RIOS SUBDIVISION) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 30th day of June, 1993, at 10:00 a.m. for the purpose of hearing the application of the Weld County Board of Commissioners, 915 10th Street, Greeley, Colorado 80631, requesting a Change of Zone from R-1 (Low Density Residential) to E (Estate) for a parcel of land located on the following described real estate, to-wit: Part of Section 3, Township 4 North, Range 66, and part of Section 34, Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, the applicant was represented by Greg Thompson, Weld County Planning Department, and WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 21. 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21.6 of the Weld County Zoning Ordinance as follows: a. The zoning in this area is faulty. This area was originally zoned Estate in 1972 and was subsequently changed to R-1 in 1981 when Estate Zoning was revoked by the County Commissioners. Estate Zoning was reinstated in October 1992. Residents of this area have subsequently petitioned the Commissioners to reestablish Estate Zoning. The Dos Rios Subdivision portion of this proposed rezone has lots which fit more closely with the guidelines of Estate Zoning. The balance of property in the proposed rezone is primarily in agricultural production. Development of an R-1 Area requires public water and sewer, whereas development in an Estate Zone only requires public water, which is provided on-site at the present time. The uses which would be allowed on the subject properties by granting the Change of Zone will be compatible with the surrounding land uses which include agricultural production, oil and gas production, a dairy, and rural residences. c. Adequate water and sewer service can be made available to serve the uses permitted within the proposed zone district. d. Existing street and highway facilities which provide access to the properties are adequate to meet the requirements of the uses which would be allowed in the Estate Zone District. e. A portion of the area proposed to be rezoned is located in the Flood Hazard Overlay District. No other overlay districts affect the site. All properties in the overlay district must comply with the overlay district requirements. f. The proposed rezoning will not permit the use of any area known to contain a commercial mineral deposit in a manner which would interfere with the present or future extraction of the deposit by an extractor to any greater extent than under the present zoning of the property. g. The application has shown that soil conditions on the site that present moderate or severe limitations to the construction of structures or facilities proposed for the site can be overcome prior to the development of the property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Weld County Board of Commissioners requesting a Change of Zone from R-1 (Low Density Residential) to E (Estate) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording, the following notes shall be placed on the Change of Zone plat: a. A Flood Hazard Development Permit will be required for any new construction or the substantial improvement of existing structures in the floodway or floodprone districts located on the property. b. Severe soil limitations exist at some sites for shallow excavations and septic tank absorption fields. The major concern of the board in all three of these cases is the potential for erosion and noxious weed problems. Maintenance of a healthy vegetative cover is the easiest way to avoid both problems. One possible method of avoiding these problems would be to require livestock confinement to a small corral area, and also require a grass cover at least 6" in height be maintained on pastures at all times. The property under consideration was originally zoned Estate on September 22, 1964. The property was subsequently changed to the present R-1 zoning classification on August 25, 1981, when the County established new zoning districts with Weld County Zoning Ordinance Number 89. Therefore, the property has faulty zoning. The character of the area is most similar to Estate Zoning. The uses allowed by the proposed rezoning will be compatible with surrounding land uses which include rural residences, agricultural production, the South Platte River, a mobile home park, and oil and gas production facilities. Uses by Right in the E (Estate) zone and the R-1 zone include allowing one single family residence, and farming, ranching, and gardening among other uses. As an accessory use, the Estate zone allows a maximum accessory structure of 3000 square feet. R-1 limits the size of accessory structures to 1500 square feet. A Use by Special Review permit in the E (Estate) zone does not allow preschools, but in addition to those Uses by Special Review in the R-1, does allow kennels, the keeping, raising and boarding of exotic animals, home businesses, and similar uses that comply with the general intent of the E (Estate) zone. The minimum lot size of the E (Estate) zone is 2.5 acres; R-1 is 6,000 square feet. Estate zone maximum building height is 40 feet, R-1 is 30 feet. Estate zoning has a minimum size for a single family home of 1,200 square feet. R-1 zoning allows 2 animal units per lot; Estate allows 1 animal unit per acre, with no more than 8 animal units per lot. Central Weld County Water District indicated they have 25 taps to the Dos Rios Subdivision, and are able to continue to provide service to the site. The lots in Dos Rios have septic sewage disposal systems. A soil survey and study of the site proposed for the change of zone is attached, and indicates the presence of a variety of soils, most of which provide fair to excellent potential for urban development. Shallow excavations and septic tank absorption fields should be adequate in all soils except those in the Flood Hazard Overlay District. However, there were two soil types which in places don' t filter the leachate from septic systems adequately. Engineer designed systems could adequately provide for the limitations. Road facilities providing access to the property are adequate to meet the requirements of the proposed zone district. Access to the property is from Weld County Road 52, a paved local county road, and Weld County Road 396, a gravel local county road. The site is underlain by terrace deposits of the Big Thompson and South Platte Rivers. These deposits are classified as the best quality source of gravel for concrete aggregate and road metal. No gravel was encountered within ten feet of the surface. Considering the depth of overburden (greater than 10 feet) , small area (about 29 acres) , and surrounding vicinity (Estate zone district) it is unlikely that gravel can be economically extracted from the site in the foreseeable future. The Laramie Formation dips gently to the west and underlies the surficial deposits at the site. The Laramie is gray claystone, shale, sandy shale and light-gray to light yellowish-gray sandstone with some ' coal beds. The Laramie was not 'encountered at the site. POTENTIALLY UNSTABLE SLOPES The slopes along Rehmer Lake drainage channel and Campo Road are potentially unstable. Slumping of soil on the downstream side of Campo Road has created traverse fractures on the road surface. Steep slopes will be especially ; 1/2 unstable if the soil is saturated or allowed to dry. Flowing water in the _ - channel could scour material from the base of the steep slopes and trigger landslides. No construction should be allowed where slopes exceed about `I '' 30 degrees unless artificial support such as retaining wall or cribbing is provided. Such structures should resist scour effects. 04 Cuts into the soil will be potentially unstable if slopes exceed about 30 •j degrees. This will be especially true if the soil is saturated or the soil `4 is allowed to dry on over-steepened slopes. Lateral support should be li v !se, != provided in all deep excavations where slopes exceed about 30 degrees. 11i I. Excavation below water table will require dewatering and shoring to prevent collapse of unstable cut slopes. Every precaution should be taken to prevent li, i " collapse of cut slopes and possible injuries or loss of lives and property. II H , Rehmer Lake Dam could be unstable and is discussed in the following section. REHMER LAKE DAM :it y ` The Rehmer Lake dam above the site is an earthen dam 30 to 40 feet high. II The crest is about 10 feet wide and the dam has about 6 feet of freeboard. i ii The dam has a 12-inch corrugated steel drain, a concrete weir on the west I 4 spillway which is unlined, and an unlined spillway on the east side of the dam. Erosion has cut vertical slopes on both spillways. The upstream face of the dam has some concrete riprap while the downstream face is earth, i grass and weeds. Slopes downstream approach 100 percent while upstream slopes are about 50 percent. There appears to be no maintenance of the dam. The author knows of no stability analysis performed on the dam. 4 s . 930566 , q : Failure of this dam would flood portions of the site. The stability of the dam should be evaluated by a competent professional engineer. Any recommendations concerning improvement and maintenance of the dam should be implemented. EXPANSIVE SOIL The sandy clay encountered at the site is moderately- to highly-swelling. Special foundation designs are generally required to prevent damage to structures. The soils in this area may be sufficiently high in sulfates to warrant use of Type II cement in foundation members. Soil test should be performed prior to construction of structures to determine consolidation-swell and strength characteristics of the soil for foundation design specifications. Foundation should be placed below the depth of frost action and seasonal moisture changes. FLOODING AND DRAINAGE The site is less than 20 feet above and 300 feet north of the 100-year flood plain of the South Platte and Big Thompson rivers. The limits of the flood plain are based on "unobstructed conditions of existing river channels and drainage structures. Alteration of the existing conditions by man or by debris accumulation can change the flood boundaries and cause damage to adjacent property." (McCain & Hotchkiss, 1975) Ponding of water is anticipated in the depressions on the east part of the site as well as the existing pond. The existing pond is formed above Campo Road where it crosses Rehmer Lake drainage channel . The pond has no outlet and water will rise until the road is overtopped south of Lot 3. Flooding will occur along Campo Road as shown on the attached preliminary plat. Failure of Rehmer Lake Dam would result in downstream flooding of an undetermined extent. The dam is discussed in a previous section. Storm runoff will be increased by urbanization and will tend to increase the frequency of flooding and the area affected. Floods peak sooner and more intensely after urbanization. Storm drainage must mitigate both 5 930566 t The preserving of natural processes, community amenity and recreation can ' I . all be achieved by effectively managing open space. Open space can be protected by purchase, zoning regulations and prohibition, tax-relief i and subdivision regulations. 5. GRAVEL PRODUCTION The site is underlain by terrace deposits of the Big Thompson and South Platte Rivers. These deposits are classified as the best quality source of gravel for concrete aggregate and road metal . No gravel was encountered within ten feet of the surface. Considering the depth of overburden (greater than 10 feet) , small area (about 29 acres) , and surrounding vicinity (zoned Estate District) it is unlikely that gravel can be economically extracted from the site in the foreseeable future. 4 CONCLUSIONS AND RECOMMENDATIONS A The geologic hazards and constraints categorized in this report must be mitigated by the land developer. Drainage studies, subsurface soil and water investigations, and dam stability analysis should be performed by competent professionals. The developer and community must work together to best react to the geologic constraints imposed by any specific site. This report is preliminary in that the magnitude of a constraint and additional constraints may become evident as further studies are performed and planning progresses.
