RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW
PERMIT #737 FOR A TRUCKING OPERATION TO SERVICE THE AGRICULTURAL
INDUSTRY - MICHAEL WILLITS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of
November, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Michael Willits, 18132 State Highway 392, Greeley, Colorado 80631, for a Site
Specific Development Plan and Amended Special Review Permit#737 for a trucking operation to
service the agricultural industry on the following described real estate, to-wit:
Part of the W 1/2 NW 1/4 of Section 19, Township 6
North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, Michael Willits, said applicant, was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for
review of said Special Review Permit, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24.4,2 of the Weld County Zoning Ordinance as follows:
a. The use is located within the Urban Growth Boundary of the Town of Eaton
and City of Greeley. The location of the use and the attached Conditions
and Development Standards make the proposed use consistent with the
goals of the Urban Growth Boundary section of the Weld County
Comprehensive Plan. The Town of Eaton has indicated it has no objection
to this request. The City of Greeley recommends conditional approval of the
request.

b. The Use by Special Review is consistent with the intent of the
A (Agricultural) Zone District. The proposed additions to the trucking
operation are allowed as a Use by Special Review in the A (Agricultural)
Zone District.
c. The use is compatible with existing surrounding land uses. This business
is existing and other agricultural businesses are located with close proximity
of the site.
d. No overlay districts affect the site.
e. Special Review Permit Development Standards will provide adequate
protection of the health, safety, and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Michael Willits for a Site Specific Development Plan and
Amended Special Review Permit#737 for a trucking operation to service the agricultural industry
on the hereinabove described parcel of land be, and hereby is, granted subject to the following
conditions:
1. The attached Development Standards for the Amended Special Review Permit shall
be adopted and placed on the Special Review plat prior to recording the plat. The
plat shall be delivered to the Department of Planning Services and be ready for
recording in the Weld County Clerk and Recorder's Office within 15 days of
approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical
permits be issued on the property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.
3. Prior to operation of the truck-trailer wash facility, an odor abatement and response
plan shall be submitted to and approved by the Weld County Health Department.
A copy of the approved plan shall be provided to the Department of Planning
Services.

1. The Site Specific Development Plan and Amended Special Review Permit is for a trucking
operation to service the agricultural industry in the A (Agricultural) Zone District as
submitted in the application materials on file and subject to the Development Standards
stated herein. The expansion of the operation is limited to the addition of a 6,960 square
foot maintenance, dispatch and service building for company-owned vehicles and a
truck-trailer washout facility.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. The Use by Special Review Permit shall not be transferable to any successors in interest
to the subject property.
4. The truck and trailer washout facility shall be for private use only for vehicles owned and
operated by Willie's Grain, Inc.
5. The truck and trailer washout facility shall only wash trailers which have contained boxed
food goods and bulk produce. No trailers may be washed which have hauled live animals
or manure. If, in the future, the applicant wishes to transport live animals and include the
washout of animal waste in the operation, the approval of an amendment to this Amended
Special Review Permit shall be required.
6. The truck and trailer washout facility shall be limited to the number of tractors and trailers
that may be washed in accordance with the engineer-designed I.S.D.S. The total number
of washed tractor and trailer units shall not exceed thirty (30) per week.
7. A quarter-inch wire mesh grate shall be installed in all floor drains in the truck and trailer
wash facility in order to prevent large organic material from entering into the septic system
and to minimize odors.
8. The sand in the truck wash sand filter shall be disposed in an approved sanitary landfill on
an as-needed basis.

9. The odor abatement and response plan shall be implemented at the request of the Weld
County Health Department in the event that odor levels detected off site of the facility meet
or exceed the residential odor limit (7:1 dilution threshold), as specified by the Colorado
Revised Statutes. The plan shall also be implemented in the event that the Health
Department receives a significant number of odor complaints and, in the judgment of the
Director of Public Health, there exists an odor condition requiring abatement.
10. An individual sewage disposal system is required for the proposed truck and trailer wash
facility and office. Each system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County I.S.D.S. regulations.
11. Any existing septic system(s) which is not currently permitted through the Weld County
Health Department will require an I.S.D.S. evaluation prior to issuance of the required septic
permit(s). In the event the system(s) is found to be inadequate, the system(s) must be
brought into compliance with current I.S.D.S. regulations.
12. All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
13. No permanent disposal of wastes shall be permitted at this site.
14. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
15. Fugitive dust shall be controlled on this site.
16. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as
measured according to 25-12-102, CRS.
17. All construction on the property shall be in accordance with the requirements of the Weld
County Building Code Ordinance.
18. The property owner or operator shall be responsible for complying with the Design
Standards of Section 24.5 of the Weld County Zoning Ordinance.
19. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 24.6 of the Weld County Zoning Ordinance.

20. Personnel from the Weld County Health Department and Weld County Department of
Planning Services shall be granted access onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Development
Standards stated herein and all applicable Weld County regulations.
21. The Special Review area shall be limited to the plans shown herein and governed by the
foregoing Standards and all applicable Weld County regulations. Major changes from the
plans or Development Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the Board of
County Commissioner before such changes from the plans or Development Standards are
permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
22. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.

A public hearing was conducted on November 16, 1994, at 10:00 a.m., with the following

The following business was transacted:
Let the record reflect that Commissioner Constance L. Harbert is the Acting Chairman for
all scheduled meetings and hearings on this date.
I hereby certify that pursuant to a notice dated October 26, 1994, and duly published
November 3, 1994, in the Windsor Beacon, a public hearing was conducted to consider the
request of Michael Willits for a Site Specific Development Plan and Amended Special
Review Permit for a trucking operation to service the agricultural industry. Acting Chairman
Harbert notified the applicant that only three Board members are present and explained,
pursuant to the Home Rule Charter, three affirmative votes are required for approval of any
matter; therefore, the applicant has the option to continue said matter. Gloria Dunn,
Planning Department representative, consulted with said applicant and indicated he desires
the Board to proceed today. Lee Morrison, Assistant County Attorney, made this a matter
of record. Ms. Dunn entered the favorable recommendation of the Planning Commission
into the record as written and submitted the applicant's odor abatement and response plan,
Exhibit E, to the Board. She stated the Greeley City Council recommended approval for
expansion of the trucking use, but it recommended denial for the truck washout facility. In
the event the truck wash facility is approved, the Council recommended four Conditions of
Approval. Mike Willits, applicant, stated he operates Willie's Grain, which is an inter/intra-
state trucking company with refrigerated trailers hauling meat to California and produce
back into Colorado. He said the company has been operating for 15 years and also hauls
locally during harvest. He explained more shop space is needed for on-going maintenance
and to allow the mechanics to work indoors. Responding to questions from the Board, Mr.
Willits stated the company has 35 tractors, and the refrigerated trailers are washed inside
and out before hauling boxed meat. He confirmed all Conditions of Approval and
Development Standard are acceptable and will be complied with. He also noted he had
started the odor abatement plan prior to it being requested, and Ms. Dunn confirmed said
plan had been approved by the Health Department. No public testimony was offered
concerning this matter. Commissioner Kirkmeyer moved to approve the request of Michael
Willits for a Site Specific Development Plan and Amended Special Review Permit for a
trucking operation to service the agricultural industry, based on the recommendations of the
Planning staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record. The motion was seconded by
Commissioner Baxter, and it carried unanimously.

Mike Willits, applicant, explained he resides on the property where he plans to locate the business. The
trucking operation consists of two fleets, one local and one that runs to the west coast. He needs a larger
shop and washing facility.
Ron Sommer was concerned about the wording of Development Standard #5, regarding boxed food
goods only. Mike agreed and used the local run (beets, onions, etc.), as an example. Gloria Dunn said
the Department of Planning Services' staff had no problem rewording the development standard to include
bulk produce. Gloria also stated they would need to amend Development Standard#1 to 6,900 square
feet for the size of the building.
The Chairman asked if there was anyone in the audience who wished to speak for or against this
application. No one wished to speak.
Jack Epple moved Case Number Amended USR-737, with the changes to Development Standards#1
and 5, be forwarded to the Board of County Commissioners with the Planning Commission's
recommendation for approval. Judy Yamaguchi seconded the motion.

1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3
of the Weld County Zoning Ordinance as follows:
The use is located within the Urban Growth Boundary of the Town of Eaton and City of Greeley.
The location of the use and the attached conditions and development standards make the
proposed use consistent with the goals of the Urban Growth Boundary section of the Weld
County Comprehensive Plan. The Town of Eaton has indicated it has no objection to this
request. The City of Greeley recommends conditional approval of the request.
The Use by Special Review is consistent with the intent of the A(Agricultural)zone district. The

No overlay districts affect the site.
Special Review Permit Development Standards will provide adequate protection of the health,
safety, and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be adopted and placed on
the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of
Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within
15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and

1. The Site Specific Development Plan and Special Review permit is for an amendment to a trucking
operation to service the Agricultural industry in the A (Agricultural) zone district as submitted in the
application materials on file in the Department of Planning Services and subject to the Development
Standards stated hereon. The expansion of the operation is limited to the addition of a 6,960 square
foot maintenance, dispatch and service building for company-owned vehicles and a truck-trailer
washout facility.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance.
3. The Use by Special Review permit shall not be transferable to any successors in interest to the subject
property.
4. The truck and trailer washout facility shall be for private use only for vehicles owned and operated by
Willies's Grain, Inc.
5. The truck and trailer washout facility shall only wash trailers which have contained boxed food goods
and bulk produce. No trailers may be washed which have hauled live animals or manure. If, in the
future, the applicant wishes to transport live animals and include the washout of animal waste in the
operation, the approval of an amendment to this Special Review permit shall be required.
6. The truck and trailer washout facility shall be limited to the number of tractors and trailers that may be
washed in accordance with the engineer-designed I.S.D.S. The total number of washed tractor and
trailer units shall not exceed thirty (30) per week.
7. A quarter-inch wire mesh grate shall be installed in all floor drains in the truck and trailer wash facility
in order to prevent large organic material from entering into the septic system and to minimize odors.
8. The sand in the truck wash sand filter shall be disposed in an approved sanitary landfill on an as-
needed basis.
9. The odor abatement and response plan shall be implemented at the request of the Weld County Health
Department in the event that odor levels detected off site of the facility meet or exceed the residential
odor limit(7:1 dilution threshold), as specified by the Colorado Revised Statutes. The plan shall also
be implemented in the event that the Health Department receives a significant number of odor
complaints and, in the judgment of the Director of Public Health, there exists an odor condition
requiring abatement.

10. An individual sewage disposal system is required for the proposed truck and trailer wash facility and
office. Each system is required to be de-signed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations.
11. Any existing septic system(s) which is not currently permitted through the Weld County Health
Department will require an I.S.D.S. evaluation prior to issuance of the required septic permit(s). In the
event the system(s) is found to be inadequate, the system(s) must be brought into compliance with
current I.S.D.S. regulatations.
12. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
13. No permanent disposal of wastes shall be permitted at this site.
14. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
15. Fugitive dust shall be controlled on this site.
16. The maximun permissible noise level shall not exceed the commercial limit of 60 db(A), as measured
according to 25-12-102, Colorado Revised Statutes.
17. All construction on the property shall be in accordance with the requirements of the Weld County
Building Code Ordinance.
18. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
19. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance.
20. Personnel from the Weld County Health Department and Weld County Department of Planning
Services shall be granted access onto the property at any reasonable time in order to ensure the
activities carried out on the property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
21. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
Standards and all applicable Weld County Regulations. Major changes from the plans or Development
Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld
County Planning Commission and the Board of County Commissioners before such changes from the
plans or Development Standards are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.

Subject : Amended USR-737, Michael Willits
The Greeley City Council, Planning Commission, and Planning staff
appreciate the opportunity to review land use applications in the
county in close proximity to the City.
The Greeley City Council reviewed this case at last evening' s council
meeting. The City Council concurred with the Greeley Planning
Commission findings, which indicated a recommendation of approval for
the expansion of the trucking use currently operating on-site and
recommending denial of the truck washout portion of the application.
If the Board of County Commissioners decides to approve the truck
washout portion of the application, the Greeley City Council. suggested
the following conditions be included:
1 . The truck washout portion of the site shall be utilized for
company vehicles only as indicated in the application
materials, and the facility shall not become a commercial
truck washout facility.
2 . The site shall meet all Weld County Health Department
standards relating to odor.
3 . Hook-up to municipal sewer service shall be required once
such service is reasonably proximate to the site .
4 . Under no circumstances shall animal waste washout be added
without additional review by the governing body.
Should this or a future applicant wish to add animal waste functions
to the truck washout, the City would like such a change in the washout
to go through the referral process, rather than this additional,
unreviewed use added to the site as an administrative review. I have
included a copy of the City Council summary of minutes for the portion
of the October 4 , 1994 meeting which addressed this case . Should any

THE CITY OF GREELEY, COLORADO, TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH WELD COUNTY,
COLORADO, FOR THE WIDENING OF 11TH AVENUE AND OF "O" STREET
Bill Sterling reported that as an incentive to the recent development in the northeast corner of
the Weld Business Park, the City of Greeley agreed to construct the required widening at 11th
Avenue and "O" Street. These improvements must be completed by November 1, 1994.
Design and construction must begin almost immediately. The estimated cost of improvements
are: "O" Street/11th Avenue, $36,380; traffic striping/signage, $2,000; and engineering design
$5,000; total of $43,380.
Staff recommended that Council approve the total appropriation and expenditure of $45,000
by ordinance and approve the intergovernmental agreement with Weld County.
Councilmembers Kinnick and Selders ask about the funding source for this project. Tim Nash,
Finance Director, noted that the funds would come from the General Fund in 1994, specifically
from sales tax revenues generated in excess of estimates.
Councilmember Kinnick moved, seconded by Councilmember Selders, to adopt the resolution,
approve the agreement, and approve the total appropriation of $45,000, and it carried: 6-0
(Brigden absent). (Resolution No. 72, 1994)
18. CONSIDERATION OF A WELD COUNTY REFERRAL FOR AN AMENDED
SPECIAL REVIEW PERMIT FOR A TRUCKING OPERATION TO SERVICE
THE AGRICULTURAL INDUSTRY
Rebecca Safarik explained that Weld County refers land use proposals to area jurisdictions for
comment when the proposed use falls within a three-mile urban planning boundary or other
agreed-upon referral area. Typically, such referrals are handled by the Planning Commission.
Occasionally, referrals may be of interest to City Council such as this proposal by applicant
Michael Willits.
Ms. Safarik reviewed the Weld County use by special review permit request to add a 5,800-
square foot building to dispatch, service, and maintain company-owned trucks and trailers, and
add an above-ground septic and truck washout system. She noted that although the site is
outside the City's mid-range expected service area and the long-range expected growth area,
it is within the City's requested referral area and therefore is evaluated in conjunction with the
City's Comprehensive Plan.
The purpose in bringing this referral to Council was because of concerns in the community
with odor and odor-related complaints which have been made about an existing truck washout
in the City. Ms. Safarik offered a comparison of the proposed facility and the existing one.
She noted that the proposed truck washout would deal only with vegetable matter but cautioned
that the addition of animal waste washout was possible.

The Planning Commission found that the proposed expansion of the trucking use complies with
the Greeley Comprehensive Plan and recommends approval of that portion of the application
with the condition that the site meet all Weld County industrial development guidelines
including parking, landscaping, setbacks, and health department standards relating to
environmental issues including surface runoff and noise. Also, the Planning Commission found
that the septic and truck washout component of the application does not comply with the
Greeley Comprehensive Plan and recommends denial of that portion of the application.
Mayor Morton noted that there are problems with commercial truck washout uses but felt it
was unfair to not allow a company to wash their own trucks.
Ms. Safarik noted that the Planning Commission recommended a list of caveats in the event
the truck washout portion was approved. If desired, a caveat relative to restricting animal
waste washout could be added.
Councilmember Kinnick moved, seconded by Councilmember Archibeque, to approve the
recommendation of the Planning Commission, however, if the truck washout component is
approved by Weld County, the following is recommended: A) The truck washout portion of
the site shall be utilized for company vehicles only as indicated in the application materials and
the facility shall not become a commercial truck washout facility; B) The site shall meet all
health department standards relating to odor; C) Hook-up to municipal sewer service shall be
required once such service is reasonably proximate to the site; and D) under no circumstances
shall animal waste washout be added without additional review by the governing body. The
motion carried 5-1 (Slomer dissenting, Brigden absent).
19. CONSIDERATION OF A RESOLUTION DECLARING GREELEY CITY
COUNCIL OPPOSITION TO AMENDMENT 12, WHICH WILL APPEAR ON
• THE NOVEMBER 8, 1994 GENERAL ELECTION BALLOT
Mr. Grattet reported that the Colorado Municipal League (CML) has reviewed the ballot
measures and analyzed how they will affect municipalities. CML is asking governing bodies
to oppose Amendment 12 and express that opposition to communities.
Amendment 12 would open the initiative, referendum, and recall petition process to widespread
fraud by making signature validation on such petitions virtually unworkable and taxpayers
would be forced to pay for printing of petitions and provision of other services to private
petitioners. Mr. Grattet added that it was important to indicate to the voters of the community
that Amendment 12 would substantially weaken home rule.
Rick Brady suggested that the resolution title also reflect Referendum A which is mentioned
in the test of the resolution.
Councilmember Faulkner noted that she generally resists having Council present a position on
a ballot measure. However, Amendment 12 would severely impact local government.

Thank you for the opportunity to review and comment on the Willits proposed
trucking expansion and truck washout facility.
The City of Greeley Planning Commission reviewed this case at yesterday's meeting.
The Planning Commission found that the proposed expansion of the trucking use
complies with the Greeley Comprehensive Plan and recommended approval of this
portion of the application with the condition that the site meet all Weld County
industrial development guidelines, including parking, landscaping, setbacks, and
health department standards relating to environmental issues, including surface runoff
and noise.
However, the Planning Commission found that the truck washout component of the
application does not comply with the Greeley Comprehensive Plan and recommended
denial of this portion of the application. The Planning Commission denial noted
odors associated with the Duggan Truck washout are a major concern in east
Greeley. The addition of a similar land use only two miles north of the Weld County
Business Park, where prevailing winds come from the north, would provide an odor
producer in an area which the City of Greeley is currently trying to limit odors.
Furthermore, the borders of the city are likely to expand north toward this facility.
Greeley sewer lines currently extend within one mile of this site. The addition of an
undesirable land use in the proposed location could hinder the expansion and
development of the city to the north.
Monfort feedlots were located only one mile south of the site. Those facilities were
moved to a location which would not conflict with urban land uses. A truck washout
facility used to be located west of the Weld County Business Park and was the source
of odor complaints and zoning violations in the county. This facility has si

The City of Greeley Planning Commission supports the expansion of the trucking
facility but cannot support a truck washout facility this close to the city. Should any
questions arise about the Planning Commission response, please contact me.
Planning staff does not ordinarily take Weld County referrals to City Council;
however, with the potential impact and land use conflict associated with this case, the
Greeley City Council will review this case at its October 4, 1994, meeting.. After the
meeting, Planning staff will forward the City Council recommendation to you.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the commercial limit
of 60 db(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s) . In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
7. An individual sewage disposal system, is required for the proposed truck
wash and office. Each system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
8. The Division requires that an odor abatement and response plan be
submitted prior to operation of the facility. This plan shall be
implemented at the request of the health department in the event that odor
levels detected off site of the facility meet or exceed the residential
odor limit (7: 1) dilution threshold) as specified by the Colorado Revised
Statues. The plan shall also be implemented in the event that the Health?
Department receives a significant number of odor complaints and •
judgement of the Director of Public Health, there exists an odor o

9. In order to prevent large organic material from entering into the septic
system and to minimize odors, a quarter inch wire mesh grate shall be
installed in all floor drains in the truck wash.
10. The facility shall be limited to the number of tractors and trailers that
may be washed in accordance with the engineer designed I.S.D. S. The total
number of washed tractor and trailer units shall not exceed thirty (30)
per week.
11. The facility shall only wash trailers which have contained boxed food
goods. No trailers may be washed which have hauled live animals or
manure.
12. When necessary the sand in the sand filter shall be disposed in an
approved sanitary landfill.

To Whom It May Concern:
Please find herein, supporting written material describing our
proposal for a Use by Special Review (USR) . The following
written material will follow the USR procedural guide.
Application Requirements :
1 )See attached application
2 )The purpose of this proposal is to allow for the construction
of an approximately 5800 sq. ft. building to be utilized to
dispatch, service and maintain the trucks and trailers which
are company owned. Also, with this submittal we are proposing
an above ground septic and truck washout system. The engineered
plans are currently at the Health Dept . for their review and
approval . The use of the property will not be altered in any
way as it exists today, other than allowing the company to expand
with the growing industry.
-Additional building space is needed to create more indoor space
for company personnel to perform maintenance on company owned
equipment . In addition, it would allow a safe and productive
environment for mechanics during inclement weather. The septic
and washout system wi11 allow the company to maintain their
trucks on site making a more convenient and productive operation.
-One half mile to the East of the proposed site and adjacent
to Hwy. 85 is a trucking firm, Booth Trucking. One mile due
South is Monfort Transportation. Both of these companies are
engaged in similar operations to our clients business . The
neighbors are farmers. The surrounding property is crop land
The proposed USR would not affect the prevention of the crop
land cultivation of it nor the harvesting.
-A residential structure is located approximately 500 feet to
the East .
-Due to the nature of the trucking business, there is a minimal
number of buyers or patrons that actually visit the site . Most
of the daily business is done over the phone.
-There are currently 45 people employed at Willies Grain, which
reside in and near the Greeley area. The hours of operation
are from 7 :00 am to 5 : 00 pm, Monday through Friday and 7 : 00
am to 1 :00 pm on Saturday.

-The water source for the proposed site is currently being
supplied by North Weld County Water District . ( see attached
water supply letter) .
-The proposed site utilizes an existing and safe access to Hwy.
392 . Once on Hwy. 392 they are able to access State Hwy. 85
and I-25 . This feature is the main criteria that enables the
business to utilize the property to its potential .
-In regard to the amount of traffic, 10-13 trucks will leave
the site on a Saturday anytime from 7 : 00 am to 7 : 00 pm and be
back the following Wednesday or Thursday. Then 2-3 trucks will
leave the yard on Sunday and return on Thursday or Friday.
During an average week from Monday through Friday, there are
usually 2-3 outbound trucks per day which would normally return
in approximately six days . Periods of the highest traffic are
Wednesday 9 :00 pm to Thursday 6 : 00 pm. Normally, on this day,
10-13 trucks return to the site. The next highest day regarding
traffic volume is Saturday from noon to 6 : 00 pm, when 10 to
13 trucks normally leave the site. Some of the trailers are
parked at the location of the shippers, both loaded and empty.
The tractors are stored at the proposed site; usually only over
night to receive maintenance. The tractors and/or trailers
which are parked at the site, are parked South of the office
building and West of the shop building, which keeps them over
400 feet away from Hwy. 392 , and obstructed to view from the
Highway. Usually there are only 10-12 personnel vehicles parked
at the site during the week.
-An existing septic system will be utilized for sewage disposal .
-The proposed site is located in the Eaton Fire Protection
District. Fire extinguishers are present on site .
-There will be no animals present on site.
-The oil that is changed out of the tractors will be used in
boilers to heat the proposed and existing buildings . There
are no other unusual debris or waste associated with the
operation.
-Storm water will continue to drain as in the past . There will
be no alteration in water run-off courses which have worked
fine over the years, therefore, no storm water retention
facilities are proposed for the site.
-There is no disposal method for debris or junk other than weekly
trash pick up by the local refuse collection agencies. As for
the proposed above ground septic and washout system, waste will
be hauled away and disposed of at an approved site as needed.

-Due to the nature of this proposal , all landscaping and erosion
control measures are existing. Numerous trees are existing
and gravel, asphalt and concrete have been placed for erosion
control purposes .
-There will be no need for reclamation procedures due to the
fact that the activities that do or would take place with this
proposal would not require any.
-Approximate start up time: End of Sept. 1994
-Approximate length of construction: 30-45 days .
3 )We feel that this proposal is consistent with the Weld County
Comprehensive plan for the following reasons:
a) It is an existing commercial use currently and by adding the
proposed building it would expand the commercial economic base
by allowing this company to grow.
b)The proposal has demonstrated in the past that it is compatible
with the surrounding agricultural uses. This company provides
transportation services throughout Weld County for dairy
products, producers and farmers .
c) It has existing and adequate public services and facilities
which have been demonstrated in the past.
-The proposal lies within the agricultural zone district. Once
again, this proposal is an existing commercial operation and
we are requesting to add a shop to the existing improvements .
This company provides many services such as transportation of
harvested produce . It is also consistent with the agricultural
goals in that it is located within the Greeley Urban Growth
Boundary. The site is adjacent to State Highway 392 with an
existing and safe access . Once on Hwy. 392 , they have access
to both State Highway 392 and Interstate 25 .
-This statement in non-applicable in that this is an existing
commercial site.
-There has not been a problem with provision for the protection
of the health, safety and welfare of the inhabitants of the
neighborhood and the County in the past. This will continue
as in the past .
-We feel this proposal is compatible with the surrounding
agricultural uses . Farm ground is adjacent to the site in all
directions . The site has had no problems in the past with
compatibility primarily due to the natural buffers surrounding
the proposal . There is a large irrigation ditch to the South

and West, Hwy. 392 to the North and a row of large trees to
the East . We believe this separates activities between the
two uses creating no problems. Once again, this company provides
a very useful and easily accessible service to the farming
industry due to the location.
-We feel this site will be compatible with all surrounding uses
that might occur in the future. It will fit in ideally with
commercial and industrial development due to the like uses .
It will also be compatible with residential development due
to the existing buffers surrounding the site and the nature
of activities associated with this proposal .
-This proposal is not located within an overlay district and
does not comply with Section 50 of the Weld County Zoning
District .

RE: A Parcel in the West Half of Section 19 , Township 6 North,
Range 65 West ( 18302 Highway 392 ) , Weld County, Colorado
Dear Mr. Willits :
We have conducted percolation tests at the location referenced
above on July 7 , 1994 . It is our understanding that a proposed
filter bed is to be constructed to service a truck wash. The
maximum anticipated daily flow for the truck wash was estimated to
be 1500 gpd based on prior water usage . Sewage wastes are not to
be disposed of in this system. Wash water will have sediment with
occasional minor road salts . Traces of oil and grease which have
collected on trucks may be mixed with the wash water.
The site is located west of Lucerne on Highway 392 . The Greeley
#2 Canal forms the west boundary of the property . The filter bed
site is relatively flat and devoid of vegetation . The subsurface
conditions encountered in the eight ( 8 ) foot deep test pit (east)
indicate six ( 6 ) feet of clay, sand and rubble fill over a clean
sand to the depths explored. Free groundwater was not encountered.
Percolation rates of 5 . 2 , 16, 17 . 1 , 18 . 5, 21 . 8 , and 30 minutes per
inch with an average of 18 . 1 minutes per inch were obtained using
the standard test procedures described by the Weld County Health
Department.
Based on the type and quantity of the wash water and the conditions
described above, we recommend the use of a 1000 gallon septic
( sediment) tank followed by a grease trap. The wash water will
then flow into one of either two ( 2 ) beds by means of a diverter
valve. Two ( 2 ) filter beds totaling 2370 square feet are
recommended to filter and disperse the wash water . A concrete and
wood structure will be constructed to contain the beds and to
facilitate in the periodic removal of the contaminated soils .
Additional recommendations and notes are as follows :

-- The filter beds shall have the total area of 2370 square feet .
-- Additional material to be placed over the existing soils shall
be a clean, fine-grained washed sand. The filter sand shall
be approved by the Engineer .

-- The subgrade of the original soil shall be scarified to a
depth of eight ( 8 ) inches prior to placement of any additional
filter sand.
-- A total of four ( 4 ) feet of filter sand/on-site soil is
required from the footing level to the top of the filter bed.
-- The four ( 4 ) inch perforated pipe will lie directly on the top
of the filter bed . Gravel or surface cover will not be
utilized since health hazards from sewage wastes will not
exist. Temporary disassembly of the pipe will be necessary
during removal of contaminated soil .
-- A concrete foundation will be constructed to contain the
filter sand and wash water. One end will have removable
wooden walls in order to facilitate removal of contaminated
soil and placement of new material . The foundation should be
designed by and Engineer familiar with the site conditions and
structure . The existing fill at the site may be subject to
excessive settlement as the fill materials are inundated with
wash water. Ground modification may be necessary if
settlement of the structure is not tolerable. The enclosure
shall be well ventilated to aid in evaporation of the water
and to prevent condensation on wooden components .
-- Only wash water from the truck wash will be allowed in this
system.
-- An earth berm should be constructed next to the foundation
walls to add support to resist lateral pressures of the
saturated soils .
Operation/Maintenance Notes
-- The diverter valve should be switched periodically to allow
drying of the beds . The diverter valve will also allow the
removal of contaminated soil in one bed while the other bed
is being used.
-- The septic ( sediment) tank and grease trap shall be checked
periodically and pumped as needed .
-- The filter sand/on-site soil shall be removed when
infiltration rates into the bed are such that standing water
does not drain within a reasonable time . The contaminated
filter materials shall be disposed of in a manner which
involves no environmental dangers .
-- The removed soils/filter material shall not be excavated below
the footing elevations .
-- Lightly loaded equipment is recommended during removal of the
soil/filter material . The soils will most likely be
saturated. Heavy equipment can cause pumping of the subgrade
soils, possibly disturbing the footing subgrade .

The test results and recommendations described in this report are
based on those conditions encountered at the locations and
elevations tested. The locations and elevations were controlled by
current regulations, site conditions , and/or the client' s
preference . Elevations of the structures and septic system should
be carefully planned to accommodate adequate grades for wash water
flow. The test pit excavated indicates the soil profile at that
location. Variations in subsurface conditions can and often do
exist. These variations are sometimes sufficient to necessitate
modifications in design.

We have conducted percolation tests at the 1 t' siceleferenced
above on July 7 , 1994 . It is our understandin $tat a proposed
filter bed is to be constructed to service a truck wash . The
maximum anticipated daily flow for the truck wash was estimated to
be 1500 gpd based on prior water usage . Sewage wastes are not to
be disposed of in this system. Wash water will have sediment with
occasional minor road salts . Traces of oil and grease which have
collected on trucks may be mixed with the wash water.
The site is located west of Lucerne on Highway 392 . The Greeley
#2 Canal forms the west boundary of the property. The filter bed
site is relatively flat and devoid of vegetation. The subsurface
conditions encountered in the eight ( 8 ) foot deep test pit (east)
indicate six ( 6 ) feet of clay, sand and rubble fill over a clean
sand to the depths explored. Free groundwater was not encountered.
Percolation rates of 5 . 2 , 16 , 17 . 1 , 18 . 5, 21 . 8, and 30 minutes per
inch with an average of 18 . 1 minutes per inch were obtained using
the standard test procedures described by the Weld County Health
Department.
Based on the type and quantity of the wash water and the conditions
described above, we recommend the use of a 1000 gallon septic
(sediment) tank followed by a grease trap. The wash water will
then flow into one of either two (2 ) beds by means of a diverter
valve . Two ( 2 ) filter beds totaling 2370 square feet are
recommended to filter and disperse the wash water . A concrete and
wood structure will be constructed to contain the beds and to
facilitate in the periodic removal of the contaminated soils .
Additional recommendations and notes are as follows :

-- Additional material to be placed over the existing soils shall
be a clean, fine-grained washed sand. The filter sand shall
be approved by the Engineer .

-- The subgrade of the original soil shall be scarified to a
depth of eight (8 ) inches prior to placement of any additional
filter sand.
-- A total of four ( 4 ) feet of filter sand/on-site soil is
required from the footing level to the top of the filter bed.
-- The four ( 4) inch perforated pipe will lie directly on the top
of the filter bed . Gravel or surface cover will not be
utilized since health hazards from sewage wastes will not
exist . Temporary disassembly of the pipe will be necessary
during removal of contaminated soil .
-- A concrete foundation will be constructed to contain the
filter sand and wash water. One end will have removable
wooden walls in order to facilitate removal of contaminated
soil and placement of new material . The foundation should be
designed by and Engineer familiar with the site conditions and
structure . The existing fill at the site may be subject to
excessive settlement as the fill materials are inundated with
wash water. Ground modification may be necessary if
settlement of the structure is not tolerable. The enclosure
shall be well ventilated to aid in evaporation of the water
and to prevent condensation on wooden components .
-- Only wash water from the truck wash will be allowed in this
system.
-- An earth berm should be constructed next to the foundation
walls to add support to resist lateral pressures of the
saturated soils .
Operation/Maintenance Notes
-- The diverter valve should be switched periodically to allow
drying of the beds . The diverter valve will also allow the
removal of contaminated soil in one bed while the other bed
is being used.
-- The septic ( sediment) tank and grease trap shall be checked
periodically and pumped as needed.
-- The filter sand/on-site soil shall be removed when
infiltration rates into the bed are such that standing water
does not drain within a reasonable time . The contaminated
filter materials shall be disposed of in a manner which
involves no environmental dangers .
-- The removed soils/filter material shall not be excavated below
the footing elevations .
-- Lightly loaded equipment is recommended during removal of the
soil/filter material . The soils will most likely be
saturated. Heavy equipment can cause pumping of the subgrade
soils , possibly disturbing the footing subgrade .

The test results and recommendations described in this report are
based on those conditions encountered at the locations and
elevations tested. The locations and elevations were controlled by
current regulations, site conditions , and/or the client ' s
preference . Elevations of the structures and septic system should
be carefully planned to accommodate adequate grades for wash water
flow. The test pit excavated indicates the soil profile at that
location. Variations in subsurface conditions can and often do
exist . These variations are sometimes sufficient to necessitate
modifications in design .
