RE: SERVICE PLAN FOR THE PROPOSED THOMPSON RIVERS PARK AND RECREATION
DISTRICT
A public hearing was conducted on January 12, 1994, at 10:00 A.M. , with
the following present:
Commissioner W. H. Webster, Chairman
Commissioner Dale K. Hall, Pro-Tem
Commissioner George E. Baxter
Commissioner Constance L. Harbert
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Shelly Miller
Assistant County Attorney, Lee Morrison
Planning Department representative, Greg Thompson
Finance and Administration Director, Donald Warden
The following business was transacted:
I hereby certify that pursuant to a notice dated December 20, 1993, end
duly published December 23 and 30, 1993, and January 6, 1994, in the
Windsor Beacon, a public hearing was conducted to consider a Service Plan
for the proposed Thompson Rivers Park and Recreation District. Lee
Morrison, Assistant County Attorney, made this a matter of record t.nd
explained the Board's procedure. He noted that the applicant complied
with the statutory requirement of the notice process. Greg Thompson,
Planning Department representative, entered the favorable recommendation
of the Planning Commission into the record as written. John Perrol.t,
Attorney, represented the applicant and stated the active members of the
district were present to answer any questions. Ray Wadas, Mayor of
Johnstown, indicated there are a lot of volunteers in the area willing to
take over the maintenance of the recreation area, which was initially
maintained by the school district; therefore, the area should be turned
over to a recreation district to obtain the necessary funding. Mayor
Wadas stated the area is growing and a need exists for more recreational
facilities and the coordination of programs. In response to questions
from Commissioner Harbert, Mayor Wadas said they would continue to u_.e the
school's property, but the school would not contribute funds; however,
there would still be maintenance cooperation among Johnstown, Milliken,
and the school, with a number of volunteers. Tom Farmer, Trustee on the
Town Board of Milliken, explained the pool remains uncovered, and the
school has little or no use for it; however, it is expensive to mairt_a .n,
and there are budget constraints due to Amendment One. He sail :he
recreation district would help kids stay out of trouble, help the society,
and provide administrative details to pick up the slack. Shannon kaldo,
resident of Berthoud, stated the district would improve quality and
provide coordination of programs for all ages by hiring a director. She
mentioned the need for a day field and walking paths and reiterated there
is good community support from both towns. Ms. Waldo also indicated there
are 25 acres behind the high school which can be used. Jacob KammerzeLl,
farmer in the area, said he would like the district confined within :he
towns rather than taxing rural properties. M . Morrison explained
agricultural properties over 40 acres are automatically excluded. He aLsc
explained that any individual within the district has the opportunity to
petition the court for exclusion. Donald D. Warden, Finance Ind
Administration Director, indicated a financial feasibility study of the
worst-case scenario was done, which excluded all agricultural and oil and
gas properties, and it showed the district would still be financially
feasible. He clarified, however, owners of agricultural properties artier
40 acres and oil and gas companies would still be required to petition if

they wish to be excluded. Commissioner Harbert stated people living on
farms could still benefit from the recreation district. Harriet Williams,
who owns a farm northeast of Johnstown, stated she will petition into the
district to participate and indicated this would be an excellent use of
taxes. Mr. Morrison stated any people wishing to petition into the
district must provide a letter prior to the district's formal filing with
the court, and Commissioner Kirkmeyer encouraged Ms. Williams to petition
in soon. In response to a question from Rod Uhrich, Mr. Morrison
explained all qualified electors registered within the district would be
allowed to vote on the issue and clarified no one had petitioned for
exclusion. Mr. Morrison then explained the procedure would be to file the
Board's resolution of approval with District Court, which supervises the
election. He said individuals can contest or support the district at the
District Court level , and, if the election is successful, District Court
will declare the district created. Said election will be held in May, ind
Mr. Warden explained the district cannot levy taxes for another year after
the election. He said the levy will be 1.5, which would result in $18 or
$19 per year on a $100,000 home. Mr. Morrison reiterated the time frames
for petitioning in or out of the district. Commissioner Harbert moved to
approve the Service Plan for the proposed Thompson Rivers Part. znd
Recreation District, and Commissioner Kirkmeyer seconded the moticn.
Commissioner Harbert stated recreation districts are beneficial to ell
ages, and the benefits are much greater than the cost. Mr. Morrison
suggested the motion reflect the Planning Commission's recommendation e.nd
that no petitions objecting to or requesting exclusion from the district
have been received. Commissioners Harbert and Kirkmeyer agreed to seid
suggestion, and the motion carried unanimously.
This Certification was approved on the 17th day of January, 1994.
