a . A decision was made at the state level as it applied to Senate
Bill 92-101 that it became effective on June 2 , 1992 , the date
the bill was signed by the governor . The fact is that the legis-
lation did not contain an "effective" date but rather only an
"approval" date. To make a law retrospective by administrative
pronouncement rather than by legislative act is unlawful and
unenforceable.
b . Prior to June 2 , 1992 , when the Governor approved Senate Bill
92-101, the Assessor utilized historical aging and number of
sales in arriving at an appropriate market absorption rate .

for tax abatement and denied same.
Pursuant to Section 39-2-125(f) , C.R.S. , you have the right to appeal this
decision to the State Board of Assessment Appeals within thirty days. You may
obtain the appropriate forms and instructions from the Board of Assessment
Appeals, Department of Local Affairs, 1313 Sherman Street, Room 420, Denver,
Colorado 80203.

Colorado Property Division, as approved by the State
Board of Equalization, in 1992 , changed to a data
collection period which goes back only 18 months from
the time of assessment . This is unlawful as it con-
stitutes legislation by administrative act and therefore
is unenforceable . There has been no enabling legislation
prior or subsequent to the administrative modification
of the absorption rate .
All 1992 valuations of properties listed on the attached
Petition for/ Abatement or Refund of Taxes should be
modified or abated to conform to 1991 valuations .
