A decision was made at the state level as it applied to Senate Bill 92-101 that it became effective on June 2 , 1992 , the date the bill was signed by the governor . The fact is that the legis- lation did not contain an "effective" date but rather only an "approval" date. To make a law retrospective by administrative pronouncement rather than by legislative act is unlawful and unenforceable. b . Prior to June 2 , 1992 , when the Governor approved Senate Bill 92-101, the Assessor utilized historical aging and number of sales in arriving at an appropriate market absorption rate . Pursuant to Section 39-2-125(f) , C.R.S. , you have the right to appeal this decision to the State Board of Assessment Appeals within thirty days. This is unlawful as it con- stitutes legislation by administrative act and therefore is unenforceable . There has been no enabling legislation prior or subsequent to the administrative modification of the absorption rate .
