Box 1948 Greeley, CO 80632 RE: Hereford Lanes and Homestead Saloon/Zane Richard Pavlica and Zane Nicholas Pavlica Dear Mr. Barker: I apologize for the delay in getting this letter to you. One of the difficulties I have in providing you this information, it that it is beginning to appear to us that Zane Richard and possibly Zane Nicholas are not telling the same story twice. ; t,3, c+::(paring the documents received from the Clerk of the Board of County Commissioners to the documents received from the University of Wyoming to the documents Zane Richard has provided to the Court's we have noticed several inconsistencies. For that reason I am enclosing documents from both entities for your review. 1 . A Memorandum of Management Agreement dated December 15, 1988. (This document indicates that on December 15, 1988, Zane Nicholas was intended to obtain a liquor license - he would have been approximately 16 years of age at that time). 2. The Financial Aid Form Need Analysis Report of Zane Nicholas. (The only significance of this document is that when Zane Nicholas applied for Financial Aid with the University of Wyoming in May of 1991 , he claimed that his real estnt holdings were valued at $15,000.00. Also, see the note on page two which indicates that Zane Richard was disabled in an automobile accident and has been unable to work.) 3. The Financial Aid Form Need Analysis Report of Zane Richard. (This report backs up the information provided in Zane Nicholas' report.) 4. An Award Notice from the University of Wyoming to Zane Richard. (There is a handwritten personal note on this from Zane Richard which states that he has been receiving 100% disability and has not been employed since 1988.) 5. Zane Richard's 1040 for 1990. (Under Schedule C he did not take a deduction for the Rent on business property, but he did take a deduction for depreciation.) 6. Handwritten Lease Agreement between Zane Richard and Tami Lynne Van Pelt dated January 3, 1989. (On this Lease you will Note that Zane Richard states that "I, Zane Richard Pavlica: Lease to Tami L. Van Pelt, a portion of my building, . . .") 7. Business Lease between Zane Nicholas Pavlica and Zane Richard Pavlica dated February 20, 1991. 8. Business Lease between Zane Nicholas Pavlica and Zane Richard Pavlica dated December 15, 1988. 9. Handwritten Note from Zane Richard Pavlica dated January 3, 1989. (In this Note he specifically states: "I, Zane Richard Pavlica purchased this establishment also known as R.E.C. Lanes, Hereford, Colorado 80732 with funds from my personal savings from Charles E. Nussbaum and Dorothy L. Nussbaum. 10. Liquor License Application - Change of Ownership dated January 3, 1989. (Our biggest interest in this document is Zane 2 Bruce Barker Assistant County Attorney Weld County Attorney February 12, 1993 Richard's statement under item number 12 "I own the Premises, free and clear of all incumbunses (sic).") I understand from my assistant that you will be forwarding any documents you may have in your file including possibly a letter you wrote for Zane Richard and a memorandum to the file. After your review of these documents, I would appreciate it if we could set up an appointment to discuss this matter further. I am very interested in your impressions of these documents as compared to what you were told by the Pavlicas. We have forwarded discovery to the Pavlicas requesting further information about the two liquor establishments and licenses and will be sending them to you upon their receipt. I have requested a continuance of the March 24, 1993 hearing for a couple of reasons. After receiving the above documents, we find that we need to more discovery with various entities. Secondly, we would very much like to have you testify, and I understand that you will not be available the week of March 24, 1993. Therefore, we have asked for a 45 day continuance. When it comes time to reset the trial, we will consult your calendar as well. I anticipate that your testimony will only take a half day and we are willing to pay your expenses. Pavlica and Tami Van Pelt shall operate all of said enterprises as Managers , they paying all expenses , and receiving all income , including insuring the premises , until all legal documents for transfer of ownership are completed and new Liquor Licenses are issued ; and , Zane N . Pavlica and Tami Van Pelt shall promptly apply for appropriate Liquor Licenses to enable Zane N . Pavlica and Tami Van Pelt to acquire all required Liquor Licenses for said business enterprises . An Inventory of all business enterprises shall be completed on or before December 15 , 1988 , in order to enable Zane N . Pavlica and Tami Van Pelt to enter into performance of this Management Agreement ( a more detailed document will be executed as becomes necessary ) .
