RE: APPROVAL OF RECORDED EXEMPTION NO. 1574 - BRAUHER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1574, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1574 was submitted by
Jessee L. Brauher for property which is located in part of the Si NE,' of Section
16, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being
more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 18 acres and 12 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home septic
system and shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) Regulations. However, a
permit cannot be approved if community sewer is within 400 feet of
the applicant's proposed dwelling, according to Section 3.12 of the
Weld County ISDS Regulations.
2. An ISDS must be located at least 100 feet from any well.
3. An ISDS permit must be finalized and approved by an Environmental
Protection Specialist within one (1) year of the application date.
4. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

Subject: Recorded Exemption 1574
Dear Commissioners:
This request for a recorded exemption is submitted by Jessee L. Brauher. The
parcel of land under consideration is described as part of the S2 NE4 of Section
16, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located
on the northeast intersection of East 24th Street and Balsam Avenue, east of the
Greeley city limits.
RE-491 created this 30 acre parcel, more or less, in 1981. This request is to
further divide Lot B of RE-491 into two parcels of 18 acres and 12 acres, more
or less. The proposed lots are physically separated by the Greeley #3 Canal.
There are no residences existing on either parcel. The applicant wishes to
retain the 18 acre lot, proposing no change in land use; he has indicated that
the City of Greeley is interested in purchasing the smaller lot as a future park
site. The property is served by 3 existing accesses. Balsam Avenue would
provide access to proposed Lot A, and E. 24th Street provides access to proposed
Lot B.
The applicant has demonstrated that this proposal is consistent with the Urban
Growth Boundary policies of the Weld County Comprehensive Plan. The subject site
lies within the urban growth boundary area of the City of Greeley. The City of
Greeley Planning Department supports this request because it does comply with the
Greeley Comprehensive Plan and meets density requirements of the area.
This request is consistent with the intent of the agricultural zone district, and
the proposed land uses are compatible with the surrounding area. Parks and
recreation areas are provided for as a use by right in the agricultural zone
district.

It is the opinion of the Department of Planning Services' staff that granting the
Recorded Exemption meets the criteria for review as set forth in Sections 11.5.1
through 11.5.6 of the Weld County Subdivision Ordinance. The staff
recommendation of approval is conditional upon the following:
1. Two City of Greele er s shall be inst ast of the Greele
Canal and not require cross' a Canal with a nes.
2. A Weld County Septic Permit is required for the proposed home septic
system and shall be installed according to the Weld County Individual
Sewage Disposal Regulations. However, a permit cannot be approved if
community sewer is within 400 feet of the applicant's proposed dwelling,
according to Section 3.12 of the Weld County Individual Sewage Disposal
System Regulations.
3. An Individual Sewage Disposal System must be located at least 100 feet
from any well.

Dear Mr. Brauher:
Your recorded exemption application is complete and in order and will be processed
on or before January 20, 1994. If it is determined that the application meets the
approval criteria of the Weld County Subdivision Ordinance, you will be notified
that the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners

Recorded Exemption Questionnaire
Item 1 . I have had my irrigated tract for sale for over
3 years, with virtually no interest in the entire
parcel . I have a full time job, and have been
renting out the tract. It is a financial burden and
it's difficult to find a renter interested in renting
such a small acreage. I have entered into a contract
with the City of Greeley who has offered to buy all
that portion of my property which is located west of
the Greeley #3 ditch consisting of approx. 12 acres.
It is my understanding that the city wants this
property for the future development of a city park .
Item 2 . The subject property is located approx . 1 mi . east
of 1st Avenue on 24th St (north side) . The lot size
of the total parcel we are requesting the exemption
on is approx . 30 acres . The smaller lot will
consist of approx. 12 . 36 acres M/L and the larger
parcel of 17 . 82 acres will remain as an irrigated
tract as it has been used in the past. There is
existing access to Lot A from Balsam St. and to Lot B
from 24th St.
Item 3 . This proposal is consistent with the Weld County
Comprehensive Plan because the land is surrounded by
irrigated agriculture land. The land for the park
will be annexed to the City of Greeley .
Item 4 . The uses permitted will be compatible with the
existing surrounding area, because the surrounding
area consists of irrigated farm land.
Item 5 . This proposal is consistent with the intent of the
Zoning District which is Agriculture and will remain
as such .
Item 6 . This proposal is consistent with the efficient
and orderly development of the county since the
property will remain as agriculture farmland, and
the smaller parcel will be annexed into the City .
Item 7 . There will not be anything that would create a health
or safety problem for the neighborhood. The City of
Greeley will provide utilities for any development
they make on the smaller parcel and have agreed to
supply the larger parcel with 2--3/4" City of
Greeley water taps as part of the purchase price.
The City of Greeley would provide sewer service for
the parcel which they are purchasing. A new septic
system woul be required for the larger parcel .

CONTRACT TO BUY AND SELL REAL ESTATE

1. Parties and Property. City of Greeley, Colorado, a
municipal corporation, [Purchaser] , agrees to buy, and Jessee L.
Brauher, [Seller] , agrees to sell, on the terms and conditions set
forth in this contract, the following described real estate in the
County of Weld, Colorado, to wit:
Part of Lot B of Recorded Exemption No. 491, being a part
of the S-1/2 of NE-1/4 Sec. 16, Twn. 5 North, Rg. 65 West
of 6th P.M. consisting of approx. 14 acs. M/L, all
located West of Greeley No. 3 Ditch, together with 100%
of any oil, gas, and other mineral rights which Seller
now owns, if any,
together with all interest of Seller in vacated streets and alleys
adjacent thereto, all easements and other appurtenances thereto,
all improvements thereon and all attached fixtures thereon, herein
called the Property, specifically excepting Seller's water rights
in Irrigation Well No. 13050. •
(a) Earnest Money.
$1, 000. 00 in the form of City of Greeley check, as earnest
money deposit and part payment of the purchase price, payable to
and held by Weld County Title, in their trust account on behalf of
both Seller and Purchaser.
3 . Water Tap Option. Purchaser grants and Seller reserves
the option to transfer his equity in a two-inch water tap for two
(2) three-quarter-inch taps, which may be used to serve his
property (approximately eighteen (18) acres) immediately east of
the Greeley No. 3 Ditch. This option shall be exercised within one
(1) year from the date of the closing of the purchase of the
property, after which time the option shall expire and be of no
force and effect.
If Seller exercises the option granted herein, the City shall
construct a waterline across Greeley No. 3 Ditch and install two
(2) three-quarter inch taps, two (2) three-quarter shut-off valves,
and two meters at the boundary of Seller's property east of Greeley
No. 3 Ditch. All costs of said extension and installation shall be
borne by Purchaser. Should Seller exercise this option, Seller is

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic
system and shall be installed according to the Weld County Individual
Sewage Disposal Regulations. However, a permit will not be approved if a
community sewer is within 400 feet of the applicant's dwelling, according
to Section 3.12 of the Weld County Individual Sewage Disposal System
Regulations.
2. An Individual Sewage Disposal System must be located at least 100 feet
from any well.
3. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.
