HomeMy WebLinkAbout941017.tiff RESOLUTION RE: APPROVE WORKING AGREEMENT FOR ALIVE-E PROGRAM WITH COLORADO DEPARTMENT OF HUMAN SERVICES AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Working Agreement for the ALIVE-E Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Colorado Department of Human Services, commencing October 1, 1994, and ending September 30, 1995, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Working Agreement for the ALIVE-E Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and the Colorado Department of Human Services be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 17th day of October, A.D. , 1994, nunc pro tunc October 1, 1994. Kirkmeyer 941017 �, . 5J (36rt9 ) WORKING AGREEMENT THIS AGREEMENT is made and entered into this 1st day of OCTOBER 1994, between the Colorado Department of Human Services (hereinafter referred to as the State) and Weld County, on behalf of the Weld County Department of Social Services (hereinafter referred to as the County). WITNESSETH:• WHEREAS,the Colorado Department of Hummt Services requires the following services; and WHEREAS, the parties hereto desire to enter into this working agreement for the provision of those services; NOW, THEREFORE, the parties hereto in consideration of the mutual covenants and conditions contained herein agree as follows: L TERM A. Unless sooner terminated as provided herein, this Agreement shall commence on October 1. 1994 , and shall automatically terminate June 30. 1995 Thereafter, this agreement may be renewed for a successive year period by a separate written document signed by the parties hereto. Any such renewal shall be made subject to the availability of appropriated funds within the annual budget of the State for the fiscal year corresponding with renewal dates This agreement shall be for an interim period for the remainder of the current federal fiscal year (date of signature through 6-30-95) and for the subsequent federal fiscal year subject to appropriation of federal and state funds. B. Either party hereto may terminate this Agreement by giving thirty (30) days notice to the other party of its intention to so terminate the Agreement Unless sooner terminated as provided herein, this Agreement shall terminate at the end of the contract period set forth above. Notwithstanding anything to the contrary, if State does not appropriate the funds for any fiscal year of State during the term hereof sufficient to pay the amounts due hereunder, and State has exhausted all funds legally available for payments due under this Agreement, State may, by giving thirty (30) days advance written notice to Attorney, terminate this agreement without liability to State. 1 941017 IL ASSURANCES The county assures that: A. The funds will be used exclusively for the purposes contained in this Agreement. B. Funds will not be used for room and board C Funds will not be used to supplaru; duplirnte or replace existing county funds. D. Funds will not be used for county budget shortfalls. III. DUTIES A. The County agrees to perform the following duties for eligible children placed in the following counties.fietcl 1. Conduct comprehensive assessment services to youth age 16 and over who me eligible for Title IV-E Independent Living Services using the assessment instrument provided. 2. Develop a written Plan for Transition to Independent Living for each youth based on the assessment with standard program time frames 3. Provide group services, where feasible, using the standardized ALIVE/E I%ogra:a curriculum and materials with appropriate regional modifications. 4. Provide individualized independent living services to youth as documented in the Plan for Transition to Independent Living. S. Provide aftercare services for youth in the community following transition out of foster care, including support groups where feasible. 6 Maintain appropriate case notes and quarterly progress notes according to ALIVE/E procedures. 7. Coordination and collaboration with the regional ALIVE/E counselor, ongoing county caseworker and ALIVE/E Program office. 8 Attend quarterly statewide ALIVE/E Program meetings in Denver, reimbursed by the ALIVE/E Program. 2 941011 9. Provide independent living services to Division of Youth Services clients in community placements in the region served by this agreement when such procedures are established. 10. County Child Welfare Services Administrator, Director or designee will meet with the State Independent Living Administrator annually to review the agreed upon services. III_ Assurances A. As host county, county agrees to provide supervision of the position with other counties served. IV. PAYMENT A. Funding is 100%federal No county portion required R. The position is classified as a Caseworker III by the Merit System. Associated costs and fringe benefits we built in as a block grant to a maumum of$15,000 for this nine month period ($20,000/year). Y. REVIEW/MODIFICATION This Agreement, together with the time records submitted by County pursuant hereto, shall be reviewed at the end of the period Any modification of this Agreement shall be in writing and signed by the parties hereto. n ASSIGNMENT Any submitting or assignment of this Agreement without the prior written consent of the other party shall be void. 3 941017 VII. ENTIRE AGREEMENT This Agreement constitutes the entire Agreement between the parties. This Agreement shall be construed and enforced in accordance with the laws of the State of Colorado. Total reimbursement cannot exceed $40,000/FTE. Consideration must be given for future salary progression in order to remain under the cap of $40,000./FTE For the position funded as 0.5 FTE, the amount is $20,000. Associated costs are estimates. Counties are not required to expend funds in each category. As long as expenditures remain under amount in the Agreement and comply with Merit System classifications, counties may direct these funds to meet the local costs of the position. For partial years, the funds will be prorated on a monthly amount equal to 1/12 of the total yearly amount permitted. Griego, Director, Social Service SUBJECT: Working Agreement Between Weld County pa, tmen of Social Services and the State Department of Soci Se vice DATE: October 13, 1994 Attached is a Working Agreement between the Weld County Department of Social Services and the State Department of Social Services. This Agreement continues our present working arrangement. The major provisions of the Agreement are as follows: 1. Provides for services under the ALIVE-E Program. These services will lead youth who are 16 years of age into independent living. 2. Provides for 100% reimbursable funding (no County match) for one FTE and associated overhead costs. The reimbursable amount is $35,507.00 with a reimbursement cap of $40,000. 3. Requires services for youth in Weld County. 4. Provides for a year term of October 1, 1994 through September 30, 1995.
