HomeMy WebLinkAbout940282.tiff 4 AR2381584 RESOLUTION RE: ACTION OF BOARD CONCERNING SECOND AMENDED RECORDED EXEMPTION #256 - GRUEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Second Amended Recorded Exemption #256 was submitted by Ronald W. Gruen, 27455 Weld County Road 66, Gill, Colorado 80624, for property which is located in part of the S} of Section 22, Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to amend Lot B by shrinking the size of Lot B to 48 acres, more or less; add an additional parcel of 80 acres, more or less; and leave Lot A as 17 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Second Amended Recorded Exemption #256, submitted by Ronald W. Gruen. The parcel of land is described as part of the S2 of Section 22, T6N, R64W of the 6th P. M. , Weld County, Colorado. This request is to amend Lot B of Recorded Exemption 256, by shrinking the size of Lot B to 48 acres, more or less. Lot A of Recorded Exemption 256 would remain approximately 17 acres. An additional 80 acre parcel would be created through this process. Recorded Exemption 256 was originally approved in April, 1977. Subdivision Exemption 290, used in conjunction with the first Amended Recorded Exemption 256 created an eight acre parcel in 1986. In November, 1988, the applicant applied for Recorded Exemption 1114, which was designed to create one parcel of 109 acres and one of 19 acres. The Board of County Commissioners denied this request. The Department of Planning Services recommends denial of this present Second Amended Recorded Exemption request based on the same rationale which the Board used to deny Recorded Exemption 1114. The Board concurred with staff that the application was not consistent with the Weld County Comprehensive Plan and efficient and orderly development. Since 1977 this 154 acre parcel has been involved in 3 successful land splits and one which was unsuccessful. This request would create the fourth parcel on this former 154 acre tract. This type of development is piecemeal and evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3 of the Subdivision Ordinance. The application before the Board today provides the same result as RE-1114. This proposal would create an additional lot which could have a residence built upon it. The relationship of the section-line to the centerline of the state highway has not indicated. Projected traffic on SH 37 indicates the need for a 150 foot total ROW, 75 feet each side of the highway centerline. Should it be determined that additional width be required. to meet that need, the additional width should be protected by reservation, or preferably, dedication as permitted by County regulations . ACCESS The application for exemption states that there is an existing dwelling on the larger 48 acre parcel and no dwelling exists on the smaller parcel . Address of access for the properties has not been made. The narrative states that the properties are in agricultural use and that no change of use is anticipated. The owner and future owner should be aware that ANY change of use of either portions could result in changes to access.. As the property is bordered by WCR 66, direct access to the state highway should not be anticipated. ' Future re- evaluation of the access, which would be warranted by change of use, could result in closure, reconstruction or relocation of existing accesses to the state highway. My comments on state highway access are based upon the information presented for this property only. The highway drainage system is for the protection of the state highway ROW and is not intended to accommodate drainage from abutting properties beyond that which has historically been accepted. UTILITIES As no change of use is anticipated it is unlikely that utility permits would be required. However, the applicant should be informed that upon any development of the property which would require utility lines or connections within the ROW, a utility permit would be required.
