RE: APPROVAL OF RECORDED EXEMPTION NO. 1421 - DON AND CAROLYN BRAZELTON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1421, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1421 was submitted by Don
and Carolyn Brazelton for property which is located in part of the NE; of Section
32, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being
more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 7 acres and 6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. An ISDS evaluation by the Weld County Health Department on all
existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
2. A Weld County septic permit is required for the proposed home and
it's septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
4. The following note shall be placed on the Recorded Exemption plat:

compliance with the Airport Overlay
District Requirements.

Subject: Recorded Exemption 1421 and vacation of Minor Subdivision S-291
Dear Commissioners:
This request for a recorded exemption and vacation of Minor Subdivision is
submitted by Donald L. and Carolyn J. Brazelton. The parcel of land is described
as part of the NE4 of Section 32, T6N, R65W of the 6th P.M. , Weld County,
Colorado. The property is located approximately one half mile north of Weld
County Road 62, west of and adjacent to Weld County Road 41. This request is to
vacate an approved 6 lot minor subdivision and divide the 13 acre parcel into two
lots of 7 and 6 acres, more or less. The zoning of this area is R-1 (Low Density
Residential) .
On March 23, 1988 the Board approved Minor Subdivision S-291 for Don and Carolyn
Brazelton. This Minor Subdivision was for six lots. Each lot was approximately
two acres in size. Mr. and Mrs. Brazelton have not pursued development of the
Minor Subdivision, and no plat has been recorded. The Brazeltons no longer want
to develop the property into the six lots, but want to divide the property into
the two lots proposed. The proposed 6 acre parcel has no improvements, the seven
acre parcel proposed has one dwelling.
The City of Greeley has reviewed this request and has no objections. The
applicant proposes North Weld County Water District as the water source and
septic systems for sewage disposal. Board of Adjustment Case 923 waived the
public sewer requirement in the R-1 (Low Density Residential) zone district.
It is the opinion of the Department of Planning Services' staff that this request
should be approved. To accomplish this the board would need to take two separate
actions. The first would be to vacate Minor Subdivision S-291. The second would
be the approval of Recorded Exemption 1421.

A certificate of Conveyances has been requested, and will be
submitted to you when we receive it.
On March 23 , 1988 the Board of County Commissioners adopted a
resolution approving Minor Subdivision S-291 for Don and Carolyn
Brazelton. This Minor Subdivision was for six lots in the R-1 (low
density residential) zone on the west side of 1st Avenue north of
Greeley. Mr. and Mrs. Brazelton have not pursued development of
the Minor Subdivision, and no plat for the subdivision has been
recorded. The Brazeltons no longer want to develop the property
into six lots, but instead want to divide it into two lots. One
lot, which has no improvements on it at the present time, will
contain approximately six acres, and the other lot, which is the
location of the Brazeltons' home, will contain approximately seven
acres. Both lots will be used for residential purposes.
In approving the Minor Subdivision, the County Commissioners
have already determined that division of this property is
compatible with the surrounding area and uses, is not inconsistent
with efficient and orderly development, is consistent with the Weld
County Comprehensive Plan, and is consistent with provisions of the
Weld County Zoning Ordinance. The Commissioners have further found
that water taps are available from North Weld County Water
District, that use of individual sewage disposal systems has been
approved, that there is no danger from soil erosion or instability,

that no unreasonable congestion or unsafe conditions will be placed
on existing highways, that there will not be a burden placed upon
school districts or local governments in providing services, and
that there will be no undue adverse effects on scenic, historical
or natural areas, wildlife habitat or surrounding residential
properties.
I therefore request that the Brazeltons' Application be
approved, and that as part of such approval, the prior approval of
the Minor Subdivision S-291 be withdrawn.

RE: APPROVE MINOR SUBDIVISION S-291 - DON AND CAROLYN BRAZELTON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 23rd day of March, 1988 , the Board reviewed
the request of Don and Carolyn Brazelton for a Minor Subdivision
for six lots in the R-1 (Low Density Residential) Zone District,
pursuant to the requirements of Section 12-3 G. of the Weld County
Subdivision Regulations , and
WHEREAS, said request is for property being described as
follows :
NE} of Section 32 , Township 6 North, Range 65
West of the 6th P.M. , Weld County, Colorado
WHEREAS, the Board deems it advisable to approve said request
for a Minor Subdivision for the following reasons:
1 . The Minor Subdivision conforms with the requirements of
Section 12-3 G. of the Weld County Subdivision
Regulations . This section incorporates the review
criteria of Section 5-4 A. of the Weld County
Subdivision Regulations .
a) The water taps from North Weld County Water
District are capable of supplying water of
sufficient quality, quantity, and dependability.
b) The applicant obtained a variance from the required
public sewer system in the R-1 (Low Density
Residential) Zone District from the Weld County
Board of Adjustment.
c) No danger to human life or structure will result
from soil erosion, soil instability, or air
pollution.
d) No unreasonable congestion or unsafe conditions
will be placed on any existing highways , nor will
there be a burden placed on educational or local

e) There will be no undue adverse effects on scenic,
historical , or natural areas , wildlife habitat, or
surrounding residential properties .
WHEREAS , the approval of the Board is subject to the
following conditions :
1 . Prior to the recording of the Minor Subdivision plat,
the applicant shall submit to the Department of Planning
Services evidence showing that the following has been
satisfied:
? a) The submittal of information verifying installation
of a six inch water line to service the Minor
Subdivision lots .
O b) A Subdivision Improvements Agreement shall be
submitted tc the Department of Planning Services
and approved by the Board of County Commissioners .
The agreement shall include , but not be limited to,
the road construction, the landscaping plan to be
utilized for the buffering of the western perimeter
of Lots 3 and 4 from U.S . Highway 85 , the
installation of the fire hydrant, the placement of
the six inch water line and all utilities .
/c) The submittal of a copy of the subdivision
covenants demonstrating the ability to perform the
maintenance , upkeep, and snow removal on the
interior cul-de-sac road serving the Minor
Subdivision.
b/ d) The submittal of a plan for drainage approved by
the Colorado Geological Survey and the Weld County
Engineer. The plan shall address the concerns
ahcut drainage expressed in the Colorado Geological
Survey letter dated February 18 , 1988 .
2 . The Minor Subdivision plat shall be amended to reflect
the following changes:
a) Show all pertinent easements in accordance with the
Weld County Subdivision Regulations : a minimum
total width of 20 feet apportioned equally in
abutting properties; and the perimeter easement
shall not be less than 15 feet in width extending
throughout the peripheral area of the development.

/b) Revise the cul-de-sac street to show a 65 foot
radius .
✓c) Show the exact location of the fire hydrant which
is to be installed between Lots 5 and 6 .
/d) Show the landscaped area on the plat to act as a
buffer from U.S . Highway 85 on the western
perimeter property lines of Lots 3 and 4 .
✓e) Delete the note pertaining to the 100 year flood
plain and show the boundary of the flood plain.
/f) Remove the heading "Minor Subdivision Number" and
replace it with the name "North Country Acres . "

WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Improvements
Agreement between Weld County and Don and Carolyn Brazelton

with one of the following alternatives, or as specified in the PUD plan, if
any:
10.1 The required acreage as may be determined according to Section
8-15-B of the Weld County Subdivision Regulations shall be
dedicated to the County or the appropriate school district, for
one of the above purposes. Any area so dedicated shall be
approved by the County or school district, and shall be maintained
by the County or school district.
10.2 The required acreage as determined according to Section 8-I5-B of
the Weld County Subdivision Regulations may be reserved through
deed restrictions as open area, the maintenance of which shall be
a specific obligation in the deed of each lot within the
subdivision.
10.3 In lieu of land, the County may require a payment to the County in
an amount equal to the market value at the time of final plat
submission of the required acreage as determined according to
Section 8-15-B. Such value shall be determined by a competent
land
appraiser chosen jointly by the Board and the Applicant. The cash
collected shall be deposited in an escrow account to be expended
for parks at a later date.
11.0 Successors and Assigns: This Agreement shall be binding upon the
heirs, executors, personal representatives, successors and assigns of
the Applicant, and upon recording by the County, shall be deemed a
covenant running with the land herein described, and shall be binding
upon the successors in ownership of said land.

Professional Engineer and Land Surveyor registered in the State of
Colorado, and shall conform to the standards and criteria
established by the County for public improvements.
1.2 The required engineering services shall consist of, but not be
limited to, surveys, designs, plans and profiles, estimates,
construction supervision, and the submission of necessary
documents to the County.
1.3 Applicant shall furnish drawings and cost estimates for roads
within the subdivision to the County for approval prior to the
letting of any construction contract. Before acceptance of the
roads within the subdivision by the County, Applicant shall
furnish one set of reproducible "as-built" drawings and a final
statement of construction cost to the County.
2.0 Rights-of-Way and Easements: Before commencing the construction of any
improvements herein agreed upon, Applicant shall acquire, at its own

The City of Greeley Planning Department has responded that its Policy
3.3.3 permits acceptable service when municipal service is not intended
prior to development. They strongly encourage the provision of
individual sewer systems for each lot.
- The lack of public sever to the property did not result solely from the
actions of the appellant. The City of Greeley Water and Sewer
Department has indicated in a letter dated May 4, 1987, that city sewer
service is curreutly not available to the area; and
- The Department of Planning Services' staff has received some inquiries
about this request. but no objections to the variance request.
The Board of Adjustment's approval is conditional upon the following:
1 . A Weld County septic permit shall be required for each proposed
home. The septic system shall be installed according to the Weld
County Individaul Sewage Disposal Regulations.
