Dear Sirs,
You recently contacted me for permission to conduct geophysical seismography on
Sections 21 and 28, Range 58, located one mile west and two miles north of Raymer,
Colorado. I own 400 acres of wheat and pasture land there. As Permit Agents for
Western Geophysical, you requested permission to conduct the work. Permission was
refused. You both indicated that Western Geophysical Company was contracted by
Diversified Operating Company (DOC) to conduct this work. You both indicated that it
was not the policy of Western Geophysical to enter land without permission from the
landowner. I warned you both that in dealing with DOC you were jeopardizing your
company's reputation, from my understanding of DOC's past action and operations.
I explained to you both that the land had been leased for oil exploration on March 8,
1984 to Mitchell & Kennedy and the lease terminated on March 8, 1985. In 1986,
pursuant to an alleged assignment of the lease, trespass by DOC and service
companies under their authority began occurring, against my will. Trespass by DOC
and service companies has continued to date without any settlement or satisfaction of
damages, costs or right of way, easement or lease.
Western Geophysical trespassed on the property without permission in October 1992,
although I called the main office in Denver, Colorado (Dewitt Lane, 1-303-770-8660,
October 2, 1992) and provided the information noted above, before entry on the land,
and warned him to relay my request, not to enter without permission. Therefore, you
and Western Geophysical Company will be included in any claim for trespass,
damages, remedial and compensatory payments, and all court costs and legal fees
associated with a claim that a court of law determines is due for trespass on the lands.
