HomeMy WebLinkAbout930603.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT FACILITY (BRINEWATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT - CONQUEST OIL COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 14th day of July, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Conquest Oil Company, 3400 West 16th Street, Suite 6L, Greeley, Colorado 80631, for a Site Specific Development Plan and Amended Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE4 SEe of Section 8, Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Dale Butcher, Vice President of Conquest Oil Company, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Agricultural Policies. The amended proposal will not remove prime agricultural land from production. b. The amended use which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, and other oil and gas facilities. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the existing zoning. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Special Review activity shall not occur on site until the following is provided: a. A detailed diagram of the injection well which has been approved and permitted by the Oil and Gas Conservation Commission shall be submitted to the Weld County Environmental Protection Services Division for review and documentation. b. Evidence that the requirement of the U.S. Army Corps of Engineers have been met pursuant to Section 404 of the Clean Water Act. 4. Prior to any injection of waste into the well, a copy of the drilling log must be submitted to the Weld County Environmental Protection Services Division. 5. Prior to pressure testing at the facility, the Weld County Environmental Protection Services Division shall be informed of the specific dates in order to observe the process. 930603 SPECIAL REVIEW PERMIT - CONQUEST OIL COMPANY PAGE 3 6. Prior to expansion of the Special Use activity, the facility shall provide a written document from the Colorado Oil and Gas Commission verifying that the facility and well are adequately constructed to handle the proposed waste volumes. 7. Within 30 days of approval by the Board of County Commissioners, a road maintenance and improvements agreement shall be approved by the Board of County Commissioners. The agreement shall address the paving of Weld County Road 46 to Weld County Road 53 and shall designate a restricted haul route on Weld County Road 46 to Weld County Road 53. Kirkmey r 930603 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS CONQUEST OIL COMPANY AMENDED USR #996 1. The Site Specific Development Plan and Amended Special Review Permit is for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The facility shall be permitted to accept a maximum of 5,000 barrels of brine water per day. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. 4. A safe and adequate sewage disposal system shall be available on the facility premises. A vault system shall be acceptable. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3-foot by 4-foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed and copies of any required analysis shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review Permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to Section 25-12-102, CRS. 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east to Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. 930603 DEVELOPMENT STANDARDS - CONQUEST OIL COMPANY PAGE 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least 24-inch, compacted or in- situ earthen materials or other low-permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and shall maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. The facility shall accept waste from dawn to 10:00 p.m. 24. The submitted drawing depicts the additional five (5) storage tanks within the existing bermed area. The installation of these five (5) storage tanks shall be in such a manner so that the existing liner is not compromised. 930603 DEVELOPMENT STANDARDS - CONQUEST OIL COMPANY PAGE 3 25. Upon cessation of injection activities, a detailed closure plan shall be submitted to Environmental Protection Services for review and approval. This shall include the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. 26. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 27. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 28. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 29. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 30. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 31. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards before additional barrels of brine water are accepted. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 930603 HEARING CERTIFICATION DOCKET NO. 93-48 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT FACILITY (BRINEWATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT - CONQUEST OIL COMPANY A public hearing was conducted on July 14, 1993, at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller County Attorney, Bruce Barker Planning Department representative, Greg Thompson Health Department representative, John Pickle The following business was transacted: I hereby certify that pursuant to a notice dated June 16, 1993, and duly published July 1, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Conquest Oil Company for a Site Specific Development Plan and Amended Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, said the original Permit was approved in March. On May 26, 1993, Trevor Jiricek of the Health Department found five Development Standards that were not yet addressed. Per a letter to Conquest from Mr. Jiricek dated July 7, 1993, Development Standard #13, concerning suitable evidence of a completed lining, had still not been addressed when the June 28, 1993, inspection was done. Said letter, allowing ten days to accomplish compliance, was mailed July 7, 1993. Mr. Thompson questioned whether the Board wanted to continue this hearing until said standard had been suitably addressed. Mr. Barker noted the Board is considering amending the existing Permit which, if it is being violated, could prohibit the amendment. Commissioner Webster suggested approving the amendment contingent upon compliance with the Development Standard. John Pickle, Health Department representative, said Conquest has contracted with Empire Labs to test compaction and permeability capability of the berm and lining. Mr. Pickle answered questions from the Board and noted the permit holder has not demonstrated full compliance. In response to a question from Chairman Harbert, Mr. Thompson said the facility has been operating. Mr. Pickle confirmed sufficient time has been allowed to prove compliance. Dale Butcher, Vice President of Conquest Oil Company, indicated they have provided evidence on an on-going basis since they were first contacted by Mr. Jiricek. He reiterated Empire Labs has done compaction testing and noted there has been misunderstanding and miscommunication among the parties. Mr. Butcher stated effort has been put forth to comply in good faith since March. He indicated all specifications, a sample of the liner, and results of a permeability test have been provided to Mr. Jiricek. He noted if Empire Labs' test results indicate non-compliance, it will be remedied immediately. Mr. Barker indicated the Board could continue this matter until suitable evidence has been provided or approve the amendment conditional upon the permit holder providing evidence. Commissioner Webster moved to approve the amendment conditional upon completion and testing. Chairman Harbert stated the only decision which needs to be made at this time is whether to hear or continue this matter today. Commissioner Webster amended his motion to hear said matter today. Commissioner Baxter seconded the motion, stating he feels the Board needs to decide whether the permit holder has deliberately tried to not comply or has worked in good faith to comply. He said possibly the permit holder has done what was thought necessary to comply and has just not yet proven it. The motion carried unanimously. 930603 RE: HEARING CERTIFICATION - CONQUEST OIL COMPANY PAGE 2 Mr. Thompson entered the favorable recommendation of the Planning Commission into the record as written. Mr. Butcher submitted two photographs of the facility for the record; however, later in the hearing, Mr. Barker noted that said photographs were already part of the record as Planning Commission Exhibits A and C. Mr. Butcher explained the maximum number of barrels of brine water now allowed is 3,000 per day, and the amendment would allow 5,000 per day. There will be two other changes: 1) the addition of five 500-barrel water tanks, and 2) the addition of a pump in the existing pump house, which will have no visual or noise impact. He stated the Planning Commission Resolution is acceptable and agreed to an additional condition concerning permeability compliance. In response to a question from Commissioner Baxter concerning increased traffic, Mr. Butcher said approximately 30 trucks per day currently use the facility, and an increase to 50 per day is anticipated. In response to further inquiries by the Board, Mr. Butcher indicated the normal hours of operation are from 9:00 a.m. to 7:00 or 8:00 p.m. He said there are usually only two trucks at a time; however, there is capability for four, and the haul route is being adhered to. Mr. Butcher explained there is little drilling now, but a large increase is anticipated after harvest. He estimated it would be two to three months before they are receiving the maximum 5, 000 barrels per day. There was no public testimony offered concerning this matter. After discussion concerning Development Standard #23, it was determined allowed hours of operation would be from dawn to 10:00 p.m. Mr. Pickle confirmed there have been no dust complaints. Commissioner Baxter stated concerns about the traffic, but indicated the problem is not from trucks using this facility. (Changed to Tape #93-25. ) After further discussion concerning the roads, Mr. Butcher confirmed the correct term, in reference to the Planning Commission minutes, is barrels instead of gallons. Commissioner Kirkmeyer clarified this amendment would be approved conditional upon compliance with Development Standard #13. In response to a question from Commissioner Hall, Mr. Butcher indicated they are trying to keep trucks from coming to their facility on dirt roads, and he thinks they are doing a very good job. Mr. Pickle said, generally, any reputable engineering firm's compaction test results or consulting firm's reports are accepted as suitable evidence. Mr. Butcher indicated the test was done at 9:00 a.m. last Monday; therefore, the results should be in by the middle of next week. He also stated, if tests indicate non- compliance, remediation would start immediately and be completed within five working days after the delivery of clay. Mr. Butcher noted they are not trying to circumvent the Development Standards, and they have made every effort to provide adequate evidence. They have been working with Mr. Jiricek, they called Empire Labs immediately, and a letter from the contractor who laid the liner was sent to Mr. Pickle's office. He assured the Board everything would be fine after the compaction test results are complete. Commissioner Kirkmeyer stated she feels the permit holder has acted in good faith and their cooperation is appreciated. She then moved to approve the request of Conquest Oil Company for a Site Specific Development Plan and Amended Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and the addition of the following language to the end of the first sentence of Development Standard #31: . .before additional barrels of brine water are accepted. The purpose of the inspection was to inspect and assess the facility's compliance with the Development Standards as set forth in USR #996. On this date, field inspection, the facility was found to be operating without suitable evidence that the completed liner material and installation meets the requirements outlined in Development Standard #13. Development Standard #13 states: A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24-inch compacted or in- situ materials or other low permeability materials, so as not to exceed a seepage rate of 1 X 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. The Division acknowledges that the facility is currently in the process of completing the necessary documentation, however, the operation of this facility must be in compliance with all applicable standards, rules, and regulations. This would involve having to add 5, 500 i water tanks and adding one additional pump this would have minimal visual effect and the pump would also have no noise impact. Bill O'Hare asked how many loads of brine water .are brought in per day. Dale Butcher stated that the loads vary in size, so the number of loads vary. The Chairperson asked if there was anyone in the audience who would like to speak for or against the application. No one wished to speak. Dale Butcher did have concerns about Development Standards #4, #11, and #23. Development Standard #4 states "An individual sewage disposal system is required for the proposed facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. " Dale Butcher stated this was changed at the County Commissioners' hearing of the original proposal. Dale Butcher stated this was also changed at the County Commissioners' hearing. Gloria stated the Development Standard #23 should read "The facility shall accept waste from dawn to 10:00 p.m. Bill O'Hare asked if there had been any complaints. Dale Butcher stated that there had been two complaints. One was that the road was not maintained in compliance with the road improvement agreement. This was due to the fact that they did not fix the road during construction; they finished construction last Friday. The second complaint was from a property owner who complained about the air breaks on the trucks coming in and out of the facility. Conquest Oil Co. spoke to the trucking company and the complaint was taken care of. Bill O'Hare asked if the magnesium chloride used for dust control would be reapplied. Dale stated Drew Scheltinga with the Weld County Engineering Department would assess road damage after one year. If the damage was considerable, Conquest Oil Co. would be required to pay for the paving of the road. Bill O'Hare asked about the log kept for seismic monitoring. Dale Butcher said that condition was removed by the Weld County Board of County Commissioners. They had several private engineers state they could inject up to 2,000 pounds of water per square inch, Conquest oil now pumps about 150 pounds per square inch. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on-site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. PROPOSED USE: Conquest Oil Company operates a brine water disposal facility on approximately 4 acres on the Northwest corner of Weld County Roads 53 and 46 (SE/4, SE/4, SEC.8, T4N, R64W, 6th PM). The facility is currently operating under a Use By Special Review Permit (USR #996) to accept up to 3,000 barrels of brine water per day. This Use By Special Review Application request is to amend the existing USR to allow the plant to accept an additional 2 O00 barrels of water per day. All that is necessary to allow the increase frr— is to add five storage tanks and install another pump. 2. NEED FOR USE: Currently oil and gas producers use several commercial facilities such as Roggen, Wright's, and Northern Colorado Brine (when open) to dispose of production water. The nearest facility to the Conquest plant is approximately fifteen (15) miles. Given the number of existing oil and gas wells and the high level of drilling activity in the vicinity, additional disposal capacity is in demand. 3. EXISTING USES ON SURROUNDING PROPERTIES: All surrounding areas are zoned for agriculture and there are eight residential dwellings within approximately one-half (1/2) mile of the Facility. The proposed facility is surrounded by farmland. 4. DISTANCE TO RESIDENTIAL STRUCTURES IN EACH DIRECTION: The nearest residence to the facility is approximately 800' north. The nearest home to the south is 1000 ft. away and the closest residence to the west is 3/8 mi. There are no homes within 1/2 mile to the east. 5. MAXIMUM NUMBER OF USERS: The expected normal operation of the Facility will be approximately 50 (80-120 Bbls. ea.) water trucks each day. 6. NUMBER OF EMPLOYEES AND HOURS OF OPERATION: There will be an employee on site while water deliveries are accepted. Hours of delivery are dawn to 10:00 p.m. The facility will be automated and dispose of produced water 24 hours a day, 7 days a week. When the facility is not manned it will be secured with locking gates. 7. WATER SOURCE FOR PROPOSED USE: Since the Facility has only one employee on site, bottled watez,is used. Fresh water is trucked in and used to control any dust problems around the delivery and access points to the Facility. ACCESS ROUTE TO BE UTILIZED FOR THE PROPOSED USE: All access to the Facility is west from Weld County Road 46 into a driveway. The exit route is east on Weld County Road 46 to Weld County Road 53. 9. TYPE, SIZE, WEIGHT AND FREQUENCY OF VEHICULAR TRAFFIC: Vehicular traffic will consist of 80-120 barrel capacity water trucks with approximate gross vehicle weight of 85,000#each when full of water. The estimated number of vehicles a day will be fifty. 10. SEWAGE FACILITIES: A vault toilet will be placed on site and will be maintained by a professional service company. 11. FIRE PROTECTION MEASURES: There are no plans for any additional structures at the Facility. Fire extinguishers will be placed at strategic locations on the premises. 12. TYPE AND SIZE OF ANY WASTE, STOCKPILE OR STORAGE AREAS: There will be no stockpiling of any waste on the Facility. Ten storage/separation steel tanks (five in addition to the existing five tanks) will be used to hold the produced water until it is disposed down the wellbore. Two steel condensate tanks are used to store any oil that is separated from the produced water. These tanks will be periodically cleaned as required. As a result of the filtering process for the water, bacterial residue and particulates are accumulated. The waste is disposed of off site at an approved disposal facility. Chemical treating of the produced water is necessary to protect above ground equipment and wellbore material from corrosive elements. These chemicals will be stored on site in drums contained in buildings. 13. STORM WATER RETENTION FACILITIES: A stormwater construction discharge permit is not required as the site is less than five (5) acres. The site is also exempt from the Heavy Industrial Stormwater Discharge Permit until or unless a reportable spill of oil or water or other chemicals occurs during a storm runoff event. Therefore, there is no scheduled installation of storm water retention facilities for the water disposal site. If runoff occurs it will tend toward the southeast end of the site. 14. TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTES: Waste will come as a direct result of water filtration. This waste (bacterial residue and particulates) will be stored and transported to an approved waste disposal site. Any other waste material will be disposed of by the use of trash bins and hauled away on an as-needed basis. 15. LANDSCAPING AND EROSION CONTROL: Aesthetically pleasing landscaping will be accomplished by the planting of trees along the east side of the property. The tanks and buildings are painted tan to blend in with the natural environment surrounding the facility. Erosion is not expected to be a problem because of the lack of a significant contour change within and around the site. 930SU3 16. RECLAMATION PROCEDURES TO BE EMPLOYED UPON CESSATION OF THE USE BY SPECIAL USE ACTIVITY: Reclamation of the Facility area will be the return of the area to farmland in the event the area is abandoned. Equipment, and tanks, will be dismantled and removed upon abandonment of the Facility. The well will be plugged and abandoned in accordance with COGCC Rules and Regulations. 17. TIME TABLE FOR CONSTRUCTION AND START-UP: It is estimated, after receipt of the approval, a time of 2-4 weeks (weather permitting) is necessary to set the five new storage tanks and install the additional pump. 18. STATEMENT RE: WELD COUNTY COMPREHENSIVE PLAN The proposed use is consistent with the Weld County Comprehensive Plan for the following reasons: A. The Facility is designed to be an environmentally preferred produced water disposal option versus what is presently available (evaporation pits, etc.). B. The traffic impact will be acceptable since established, well-maintained, paved and gravel roads will be used to access the Facility. A posted speed limit for vehicles is enforced by Conquest to ensure the safety of surrounding areas. C. The Facility is consistent and compatible with oil and gas development and facilities throughout the area, including wells, pipelines, tanks batteries and other disposal facilities. The Comprehensive Plan allows for mineral owners and lessees to have the right to develop their property. D. The facility will only be visited during the hours of dawn to 10:00 p.m. for delivery and maintenance purposes. 19. CONSISTENCY WITH THE INTENT OF THE DISTRICT: The proposed use is consistent with the intent of the Agricultural Zoning District. The site location is small and will have little impact on the surrounding farmland and is in a relatively unpopulated area. The Facility is designed to be environmentally sound and aesthetically pleasing to the surrounding areas. 930S03 20. EFFORTS TO CONSERVE AGRICULTURAL LAND: The site for the Facility was chosen because it is near existing oil and gas production surface equipment and a paved county road. Any negative impact to the surrounding agricultural areas is considered minimal. 21. PROVISIONS FOR THE PROTECTION OF HEALTH, SAFETY & WELFARE OF THE NEIGHBORHOOD: A six-foot chain link security fence is installed on the site to prevent any harm to either livestock or unauthorized personnel. If emergency assistance is needed, the site is serviced by the Platte Valley Fire District. A containment berm is installed to contain any spillage that would occur in the tank battery. 22. Colorado Southern Pad United States Department of Agriculture Soils Conservation Service. 4. Aquolls and Aquepts, flooded. This nearly level map unit is in depressions in smooth plains and along the bottoms of natural drainage ways throughout the survey area. Aquolls, which have a dark colored surface layer, make up about 55 percent of the unit. Aquepts, which have a lighter colored surface layer, make up about 25 percent. About 20 percent is soils that are well drained and soils that have sandstone or shale within 48 inches of the surface. These are deep, poorly drained soils that formed in recent alluvium. No one pedon is typical. Commonly the soils have a mottled, mildly to moderately alkaline loamy or clayey surface layer and underlying material that extends to a depth of 60 inches or more. In places they have a gleyed layer in the underlying material. Most of the acreage is subject to excessive runoff. The water table is at or near the surface in spring and during the peak of the irrigation season. These soils are used for rangeland and wildlife habitat. Some small areas are irrigated pasture. The potential native vegetation is dominated by switchgrass, prairie cordgrass, saltgrass, alkali sacaton, big bluestem, indiangrass, western wheatgrass, slender wheatgrass, sedge, and rush, Cattails and bultrush grow in the swampy spots associated with these range sites. Potential production ranges from 4,000 pounds per acre in favorable years to 3,000 pounds in unfavorable years. As range condition deteriorates, the tall and mid grasses decrease, production drops, and saltgrass, sedge, and rush increase. The farming and irrigation in adjacent areas has increased the amount of salts on much of the acreage. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Swithcgrass, big bluestem, indiangrass, western wheatgrass, pubescent wheatgrass, intermediate wheatgrass, tall wheatgrass, and tall fescue are suitable for seeding. The plants selected should meet the seasonal requirements of livestock. For successful seeding, a firm prepared seedbed in needed. A grass drill should be used. seeding early in spring has proven most successful. Tillage is needed to eliminate the undesirable vegetation. Wetland wildlife, especially waterfowl, utilize this unit. The wetland plants provide nesting and protective cover as well as some food. The nearby irrigated cropland, where wildlife obtain much of their food and find protective cover, makes this unit valuable to both wetland and openland wildlife. Openland wildlife, especially pheasant, use this unit for cover and nesting. Deer find excellent cover in some areas. These valuable wildlife areas should be protected from fire and fenced to prevent encroachment and overuse by livestock. They should not be drained. AM USR-996 1. The Site Specific Development Plan and an Amended Special Review permit is for an oil and gas support facility (brinewater disposal) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. The facility shall be permitted to accept a maximum of 5,000 barrel of brine water per day. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on-site when the facility is receiving waste. 4. An individual sewage disposal system is required for the proposed facility and the system shall be installed according to he Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3 foot by 4 foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed, and copies of any required analysis, shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east of Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. 9:0Z(3 DEVELOPMENT STANDARDS, AM USR-996 Conquest Oil Co. Page 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24 inch compacted or in- situ earthen materials or other low permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on-site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required Air Emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. The property shall be maintained in compliance with the microseismic monitoring program approved by the Weld County Health Department. 24. The submitted drawing depicts the additional five (5) storage tanks within the existing bermed area. Prior to pressure testing at the facility, the Weld County Environmental Protection Services Division shall be informed of the specific dates in order to observe the process. 6. Prior to expansion of the Special Use activity, the facility shall provide a written document from the Colorado Oil and Gas Commission verifying that the facility and well are adequately constructed to handle the proposed waste volumes. 7. Within 30 days of approval by the Board of County Commissioners, a road maintenance and improvements agreement shall be approved by the Board of County Commissioners. The agreement shall address the paving of Weld County Road 46 to Weld County Road 53 and shall designate a restricted haul route on Weld County Road 46 to Weld County Road 53. 9 .C 13 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Conquest Oil Co. AM USR-996 1. The Site Specific Development Plan and an Amended Special Review permit is for an oil and gas support facility (brinewater disposal) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. The facility shall be permitted to accept a maximum of 5,000 barrels of brine water per day. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on-site when the facility is receiving waste. 4. An individual sewage disposal system is required for the proposed facility and the system shall be installed according to he Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3 foot by 4 foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed, and copies of any required analysis, shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east of Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. 9 ,Cco3 DEVELOPMENT STANDARDS, AM USR-996 Conquest Oil Co. Page 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24 inch compacted or in- situ earthen materials or other low permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on-site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required Air Emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and shall maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. The facility shall accept waste during daylight hours only. 24. The submitted drawing depicts the additional five (5) storage tanks within the existing bermed area. The installation of these five (5) storage tanks shall be in such a manner so that the existing liner is not compromised. 9-70se3 DEVELOPMENT STANDARDS, AM USR-996 Conquest Oil Co. Page 3 25. Upon cessation of injection activities, a detailed closure plan shall be submitted to Environmental Protection Services for review and approval. This shall include the manner in which the well will be plugged and abandoned as well as specific details regarding reclamation of the property. 26. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 27. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 28. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 29. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 30. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 31. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards.
