RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (PICKLE PROCESSING FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - LYNN FAGERBERG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of May, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Lynn Fagerberg, 18271 Weld County Road 70, Eaton, Colorado 80615, for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (pickle processing facility) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the W; SWy of Section 7, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, at said hearing of May 26, 1993, the Board deemed it advisable to continue said matter to June 2, 1993, and WHEREAS, at said hearing of June 2, 1993, Lynn Fagerberg, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Urban Growth Boundary Area Goals and Policies as set forth in the Weld County Comprehensive Plan. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. The site has not been used as productive farmground. c. The uses which would be permitted will be compatible with the surrounding land uses which include agricultural production and rural residences. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. d. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (pickle processing facility) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. If a new access is to be constructed, the Special Review Permit plat shall be amended to show the access prior to recording the plat. The Site Specific Development Plan and Special Review Permit is for an agricultural service establishment (pickle processing facility) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. Culverts shall be placed to accommodate any drainage or irrigation waters. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. No on-site disposal of produce of any type shall be permitted at anytime. 5. No permanent disposal of wastes shall be permitted at this site. 6. Waste materials and produce shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Any required air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust, odors, or other emissions. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to Section 25-12-102, Colorado Revised Statutes. 10. Adequate toilet facilities shall be provided for the workers. An individual sewage disposal system is required for the proposed facility, and the system shall be installed according to the Weld County Individual Sewage Disposal System Regulations. A vault privy is acceptable for the short-term seasonal use proposed by the applicant. If a septic system is installed, the system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. A vault privy system does not require the Engineer's design. 930481 DEVELOPMENT STANDARDS - FAGERBERG PAGE 2 11. All pesticides, fertilizers, and other potentially hazardous chemicals shall be stored and handled in a safe manner, as set forth in Section 25-8-205.5 of the Colorado Water Quality Control Act and Rules and Regulations thereof. 12. The facility shall utilize the existing public water supply. 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18. I appreciate the I applicant's planning and working with the various entities they had to work with in trying to get something like this , so I will vote yes. Don Feldhaus; It appears the applicant has a sincere desire to cooperate and work with the surrounding neighbors and make this a win, win situation. Shirley Camenisch: I believe the same way Jean does. It is not exactly the area for something like this. I know they've worked hard out there, I drove by it F today. I keep thinking about the spectators that are there too, and the people that are going to be there just to walk their dogs and get some exercise and come along with the players. I vote for denial. Bud Clemons: I think to deny this would be to deny Mr. Kammerzell (the property owner) some of his property rights. I feel that there is evidence provided to show that the applicant's sincerity in trying to protect the habitat, to create minimum disturbance to the wildlife. There are numerous options that the landowner could do that would create far more damage to the wildlife and the environment, than what this operation would do. I agree that there might be a better place, but there' s always a better place for every landfill and every undesirable situation and there had to be a place for everybody and if there is a better place I'm sure the applicant has searched for a suitable site. I know the area quite well, I've lived in the neighborhood and it seems to be fairly adequate and I have had some limited experience with these operations, so I know something about them. I vote yes. This operation will involve only the grading and sizing of the cucumbers. The bulk product will be shipped to La Junta for further processing. The local farmers who grow cucumbers in the area will benefit from this type of operation. s Richard Kimmel asked about surrounding property owners who would be affected by this type of operation. Lynn Fagerberg said they own and farm the land on both a j sides of the proposed operation. To Whom It May Concern; The applicant seeks permission to utilize a parcel of land approximately 1. 52 acres which they own and which is located in the W4 of the SW3 of Section 7-T6N-R65W for the grading and sizing of pickles. This facility is needed to inspect and size the pickles before being shipped to Green Bay Foods in La Junta, Colorado. This particular site is centrally located for easy access due to the fact that pickles for the facility will come from the Greeley, Eaton and Ault areas . The surrounding properties consist of irrigated farm property. The nearest residence to the North of the facility is approximately 4 mile, to the West is approximately . 1 of a mile, to the South is also approximately .1 of a mile, and to the East is in excess of 1 mile. There are several pickle growers in 'the vicinity who provide pickles to the facility for inspection and sizing. No patrons will actually come to the facility, as after the pickles are processed they will be shipped in crates to La Junta, Colorado. Trucks come to pick up the pickles at the facility and the laborers assist in loading the pickles upon the trucks . At the height of their season they will employ approximately 12 employees in 8 to 10 hour days . The facility will be open approximately 5 weeks out of each calendar year. The water provided to the facility will come from the North Weld County Water District. The facility is located along Weld County Road 37 approximately 14 miles South of Eaton and approximately 24 miles Northwest of lucerne. Traffic going to the facility may access any of the existing County Roads from Highway 85. The property is adjacent to the half mile line between County Roads 70 and 72 .
