RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1553 - KALLSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1553, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1553 was submitted by Matthew and Nancy Kallsen for property which is located in part of the NE; SE; of Section 10, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 9.5 acres and 0.5 acres, and WHEREAS, the Board deemed it advisable to exempt this request from the one-acre minimum lot size requirement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" and from the one-acre minimum lot size requirement. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. Conditional Use Permit #26 shall be vacated by a separate resolution of the Board of County Commissioners. 2. Prior to recording the plat, the applicant shall submit evidence that an Individual Sewage Disposal System evaluation has been completed by the Weld County Health Department on all existing septic systems. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 5. Prior to recording the plat, a complete Mobile Home Zoning Permit application for a principal dwelling on Lot A shall be submitted to the Department of Planning Services. The parcel of land is described as part of the NE4 SE4 of Section 10, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located south of 16th Street and west of Fern Avenue. The parcel under consideration is the total contiguous land holdings of the applicants. The request is to divide a 10 acre parcel into two parcels of 9.5 and .5 acres, more or less. A residence exists on each of the proposed lots. The applicants wish to retain the small lot as a continuing homesite for their retired parents and sell the larger lot with outbuildings. North Weld County Water District provides water to both residences. Septic systems are existing; the Weld County Health Department recommended conditional approval of this request to allow creation of a lot less than 1 acre in size. The Board of County Commissioners must determine, however, if it wishes to grant an exemption from the minimum one acre requirement prior to approval of the Recorded Exemption. The County Comprehensive Plan supports this application. The 10 acre parcel is located in the Urban Growth Boundary of the City of Greeley. The Greeley Planning Department has recommended approval of the proposed division. The subject property is adjacent to the Union Colony Subdivision, an area where there are similar lot sizes and residential uses compatible with the proposed use. The granting of this Recorded Exemption creates no new building sites, no additional accesses on East 16th Street, nor will agricultural ground be taken out of production. 931 193 YQCeI. eA49 sato 931190 RE /5E3 RECOMMENDATION Matthew and Nancy Kallsen RE-1553 Page 2 Conditional Use permit 26 was approved for the subject property in 1977, allowing a horse boarding facility. As it appears that this use has been abandoned and because the Kallsens propose to sell the 9.5 acre parcel, the staff requests that the Conditional Use permit be vacated. The mobile home existing on Lot A was allowed under Conditional Use permit 26 to house an employee for the horse business. If this Recorded Exemption is approved, the applicants will be required to repermit the mobile home as a principal dwelling. The Department of Planning Services' staff recommends approval of this proposal and requests that the Board consider the following Conditions of Approval: 1. Conditional Use permit 26 shall be vacated by a separate resolution of the Board of County Commissioners. 2. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 3. The Recorded Exemption plat shall show a 50 foot right-of-way reservation south of the centerline of East 16th Street on the property. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. Section 11.8.5 of the Weld County Subdivision Ordinance states that such a request may only be approved if the Board of County Commissioners wishes to exempt the proposed subdivision from the minimum one acre requirement. He said that he spoke with regarding a Recorded Exemption. He stated was in the process of applying for a Recorded Exemption for the property located at 2460 E. 16th Street. According to our files have septic permits on file for both systems. He said that his • clients are wanting to split the property with one part being less than an acre. I have no conflicts with this proposal as long as each septic system will ultimately be restricted to its respective property.
