HomeMy WebLinkAbout900845.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1298 - SCHLOTTHAUER WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 1298 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1298 was submitted by Robert H. and Izetta L. Schlotthauer for property which is located in part of the NE} , Section 22 , Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 47 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be , and hereby is , exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) The applicants shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within 60 days from the date of approval by the Board of County Commissioners. Schlotthauer. The parcel of land on which this request is being made is described as part of the NE} of Section 22, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property is located west of Weld County Road 21 and south of and adjacent to Weld County Road 80. This request is to divide a 48.070 acre tract of land into lots of 46.519 acres and 1.551 acres, more or less. One dwelling is located on the proposed smaller lot. It is the opinion of the Department of Planning Services' staff that sufficient reasons have not been given by the applicant to warrant creating an additional lot at this time. The Department of Planning Services' staff has concerns about the level of development and the potential for continued divisions occurring in this section. The staff would like the Board to be aware of the development pattern that has occurred in this area and whether it wishes to allow this type of piecemeal development to continue. There have been five recorded exemptions, two amended recorded exemptions, and two subdivision exemptions approved in this section since 1977. In the northeast quarter of this section, there are seven parcels existing. There would be a total of eight in this quarter section if this request is approved. Development in this area is reaching a level where continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. Weld County and other entities are responsible for providing services such as road maintenance, police and fire protection, school busing, snow removal and other urban type of services necessitated by residential development. SCHLOTTHAUER 1 . Robert Schlotthauer acquired Lot A of RE 267 from his parents in 1977 and constructed a new residence. The remainder of the NW4NE4 was inherited in 1979 as part of his Mother's division of property. The property has been in the family for four generations. In October 1983, Robert & Izetta filed Amended RE 267 in order to create a parcel for their daughter to build a residence. Additionally, they have acquired a 13.6 Acre tract adjoining to the South from a brother. This Recorded Exemption is being requested for the purpose of separating their improvements from the farm land, and to aggregate the remainder into a legal tract. They have not been directly involved with the farming for many years. The farmland is under lease for farming by Everett Schlotthauer, brother of Robert. He has farmed the land for the past 25 years in conjunction with 650 acres of other land in the area. The proposed division of land will not affect the present farming operation or the irrigation system. A permanent access has been included in Lot B to provide access to Weld County Road 80. 2. The integrity of the policies of the Weld County Comprehensive Plan would not be jeopardized by this proposal as an additional lot will not appreci- ably alter the nature, use or make-up of this agricultural land. New con- struction would only be single family dwelling and other agriculturally related structures. Furthermore, the proposed split would be in compli- ance with applicable state and county regulations. 3. The lots created by this proposal will remain agricultural in use as well as agriculturally zoned, and thus this proposal is consistent with the intent of the zone district in which they are located. 4. To remain compatible with the existing land uses, only those uses presently permitted on the surrounding properties will be permitted on the proposed parcels. In applying for the Recorded Exemption we are not seeking a land use variance or any change in zoning so the proposed split would not hinder future develop- ment as projected by either the County or nearby municipalities. There will be no change in the existing infrasturcture except the services. 6. This proposal is consistent with efficient and orderly development in that it easily blends in with what is currently permitted or taking place in the area. 7. The existing residence .is served by the North Weld Water District and has an individual sewage disposal system. New construction would have similar servi- ces. Application will be made to Weld County for the necessary building per- mits and sewage disposal systems for the new construction. 8. The property under consideration is not located in a geological hazard area or the Weld County Airport Overlay, and is NOT located in a general Flood Area as defined by Flood Insurance Rate Map, Community Panel Number 080266- 0475 C, effective date September 28, 1982. 9.
