RE: REFUND OF FEE FOR FAILURE TO SIGN AFFIRMATION CLAUSE OF INSURANCE COVERAGE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Sections 42-3-104 and 42-3-111, CRS, as amended, required a
reprocessing fee of fifteen dollars ($15.00) for failure to include the required
affirmation clause regarding insurance coverage when registering vehicles,
effective January 1, 1991, and
WHEREAS, Senate Bill 91-49 approved in the 1991 legislative session,
authorizes the refund of any or all of the moneys collected between January 1,
1991 and the effective date of Senate Bill 91-49, for failure to sign said
affirmation clause, and
WHEREAS, the Clerk and Recorder has recommended, and the Board of County
Commissioners concur, that the entire fifteen dollar ($15.00) fee should be
refunded.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado that, in accordance with Senate Bill 91-49, the Board hereby
authorizes the refund of all moneys collected between January 1, 1991 and the
effective date of Senate Bill 91-49 for the failure to sign the affirmation
clause on the Registration Application pursuant to Section 42-3-104(1.5) (c), CRS,
as amended, or the failure to sign the affirmation clause on the Notice for
Renewal of Registration pursuant to Section 42-3-111(2.5) (c) , CRS, as amended.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 1st day of May, A.D. , 1991.
