PURPOSE OF PUBLIC NOTICE The purpose of this notice is to solicit public comment on the proposal by the Region VIII Office of the U. S. Environmental Protection Agency ( EPA) to issue a permit to inject nonhazardous industrial waste fluids underground via a Class I disposal well, the Suckla Farms #1 ( EPA Permit Application #COS1516-2115 ) . BACKGROUND EPA Region VIII is currently reviewing an application for a Class I Underground Injection Control Permit from Wright ' s Disposal, Inc. , 9270 Quitman, Westminster, Colorado 80030 , regarding nonhazardous industrial waste disposal operations. The injection fluids are to be reclaimed water associated with the removal of underground fuel storage tanks, pit water from oil field wash pits , contaminated surface water from construction sites, and stored fuels . The permit will allow only the disposal of nonhazardous wastes; reporting and monitoring requirements will assure that all fluids to be injected are not hazardous . The Suckla Farms # 1 well is located in the SE 1 /4 of the NW 1 /4 of Section 10 , T1N, R67W, Weld County, Colorado. The well has been in operation as a Class II salt water disposal well in the Lyons Formation since July 15 , 1989 , as authorized by the Colorado Oil and Gas Conservation Commission. The disposal zone is the Lyons Formation between the depths of 9, 276 and 9, 418 feet; this interval will also serve as the injection zone for the disposal of Class II nonhazardous fluids . The Lyons Formation in this area is not an underground source of drinking water; total dissolved solids [TDS] content of the formation water is 33 , 240 milligrams per liter ( mg/1 ) . Reservoir calculations of the injection zone indicate that a combined volume of 27 , 672 , 353 barrels of Class I and Class II fluids will be contained within a radial distance of one-quarter ( 1 /4 ) mile surrounding the disposal well . When this cumulative volume of injected fluids is reached, EPA will make a decision whether to extend the limits of the reservoir, or to terminate the permit . Periodic pressure fall-off tests and well monitoring data may dictate an earlier termination of the permit . In any case, the permit will be reviewed after five years of operation to determine if changes in requirements are warranted. 1 Iat `CY{t,(A,C� lthz) 901354 bc9%-\i\ PLC(r�`� , EPA has made a preliminary determination to approve the permit application, and that by doing so, any underground sources of drinking water ( USDW) will be protected. Therefore, EPA is hereby serving notice of intent to issue a permit, for the proposed underground injection activities, to Wright ' s Disposal, Inc. PUBLIC COMMENTS All data submitted by the applicant, as well as the draft permit prepared by EPA, are contained in the administrative record for Wright ' s Disposal, Inc. A request for a public hearing should be made in writing and should state the nature of the issues proposed to be raised at the hearing. A PUBLIC HEARING WILL BE HELD ONLY IF SIGNIFICANT INTEREST IS SHOWN. FINAL PERMIT DECISION AND APPEAL PROCESS After the close of the public comment period, EPA will issue a final permit decision, and will notify all commenters regarding this decision. The final decision may be to: issue; deny; modify; or revoke and reissue the draft permit. The final decision shall become effective thirty ( 30 ) days after the final decision is issued, unless no commenters requested a change in the draft permit, in which case the permit shall become effective immediately upon issuance. Within thirty ( 30 ) days after a final permit decision has been issued, any person who filed comments on the draft permit or participated in a public hearing, may petition the Administrator to review the permit decision.
