APPLICATION
2. a. Our hope and intent is to eventually have 50% of
the 40 acres as a museum and 50% as an airport to
accommodate our friends and neighbors who fly as
well as our flying museum displays. In the mean
time, it is a private airport, collectible museum,
jump zone, screened aircraft salvage as well as
other accessory items related to the airport and
museums All types of aircraft operate here,
including but not limited to airplanes, hot air
balloons, helicopters, spray planes, gliders and
ultralites. The jump operations include, but are
not limited to jumping out of airplanes, balloons
and other aircraft , off towers, cranes and similar
structures using parachutes, bungee cords and
other devices to insure the safe landing of the
individual .
Jump areas, as indicated on plot plan map, are for
all types of jumping. However, the jump areas
will not be used for more then one type of jumping
at one time, to insure the safety of the
participants.
Wings ' N Things Museum and Airport has workshops
in which to repair, build and store usable and
static displays which include but are not limited
to; aircraft , automobiles, trucks, motorcycles and
scooters, tractors, farm implements and machinery,
pickups, tractor trailers ( for mobile display) ,
trains and historical buildings, some of which
include but are not limited to; log cabins, an old
school house,a church, a frontier fort , a
telegraph office, a bank , etc. Display pedestals
are not necessarily to be in the positions shown,
but will always be at least 50' from the runway
centerline. The position these buildings are
shown on the plot plan are not necessarily the
position they will be shown in when erected and
some will probably be moveable, and will be at
least 50' from the runway centerline.
The map indicates a fence and bushes around the
perimeter. This will probably never be installed
around the whole perimeter however, we wanted it
on the map in case we ever wanted to do one or the
other.
We will install fences as necessary to screen
unrestored items. The first fence will be for
unrestored museum displays along the west fence
and will be completed within six months and will
run along the west boarder from the south end of

the -xisting fence to the corns, of the existing
120' x 52' building with fencing to be added as
necessary.
The fence will be of the type on which we can hang
collectibles and have pictures painted . It will
be constructed of 3/8" plywood or metal ; the same
as which is used for metal buildings. The new
fence will start 8" above ground (per Weld County
Planning Department, and we would like to reserve
the right for discussion on this matter at our
hearing ) with a 2' space between fence and
collectibles, leaving room for the sheep to graze
for weed control . The new fence will be installed
within six months and will be used to screen some
of the unrestored museum collectibles. At some
time we may plant bushes or trees along part or
all of the West boarder.
The existing chain link fence area ( which is
approximately 144' x 138 ') at the SW end of the
property will be used as a special attraction area
for rare displays which are not completely
restored because parts are not available,
including but not limited to the helicopter,
missile, WWII fuselage and army vehicles. This
will be the only area where unrestored displays
are located which are not visually screened from
all adjacent properties and road right sways. .
We have been collecting for a display of engines
(gas, diesel , stream, etc . ) . For the small
engines, we have a 45' x 9 ' 6" mobile display
trailer. For larger engines, other types of
protection will be fabricated . We also have a 34'
x 8' mobile display trailer for local fly-in
display exhibits. These trailers, when not in
use, will be kept in the storage yards.
We have a military display which includes but is
not limited to all types of aircraft ( airplanes,
helicopters, gliders, etc. ) , military vehicles,
military tents and other military memorabilia.
We have several pieces of airport and museum
maintenance equipment some of which serves two
purposes; it is usable as well as for museum
display. There is storage, tie down and a fuel
truck on site with aircraft, car and machinery
fuel available. There will also be museum
collectibles on consignment for display ( not for
resale) .

style barn. When we discontinue use of the mobile
home as living quarters, we will continue to use
it as housing for a caretaker and office space.
Museum pieces as well as maintenance equipment are
sometimes traded or sold to upgrade display
attractions and equipment . However, this is not a
large part of our operation.
Within the next year , we would like to erect the
100 x 50 building Just north of the existing 120
x 52 building. We would also like to put in a
pool during this time period .
Within the next one to five years, we hope to
erect the small hangers.
b . This has been an airport since the 1930' s and a
Jump zone since the late 1960' s. I started
fulfilling my dream for a museum collection years
ago and now hope to give it my full attention. My
wife; Sharon and I travel all over the country
locating, purchasing and transporting collectibles
for our museum.
c. There are several neighbors to the west : 1 )
operates a parachute Jump operation and totally
depends on this airport to make a living for his
family and has operated here for more than twenty
years. 2) is a commercial truck driver and often
has his tractor and trailer parked at his house.
3) works away from home ( vocation unknown) and
doesn' t use his land for any particular purpose.
4) is retired and has horses, cows and goats ( his
wife drives a school bus) . 5) is retired and
spends a lot of time working on his airplane and
uses this airport for flying. 6 ) has a commercial
auto repair shop on the property and has cows and
horses. 7 ) purchased his home and land here for
the express purpose of operating a non-profit
organization; he and his wife restore older
aircraft and train pilots and mechanics for
service in humanitarian and mission oriented
groups. At this time they have ceased their
operation at the airport pending their application
for a special use permit .
d . North - no residential structures for more than .5
mile ( my property line is next to the back fields
of the residents who live on WRC 11 ) . South - no
residential structures for several miles. East -
a mobile home is appx. .5 mile then commercial
buildings appx. 1 mile away.

e. The maximum number of users, patrons, members and
buyers would remain at 200.
f. The number of employees in approximation would be
six to eight , number of shifts is one, with hours
of operation from daylight to sunset or 8:00 p .m. ,
whichever comes first.
g. Water source is a system and water tanks.
h . Access is gained from road 16 and has two ( 2)
gates which are kept locked for security and
public safety. When the museum is open for
display, access and supervision will be provided .
i . Vehicular traffic would remain at 100.
j . Sewage facilities will be septic tanks and santi—
lets as have always been sufficient and should
continue to be sufficient since the number of
users has not changed .
k . For fire protection we have a 3500 gallon portable
tank as well as two additional water tanks for
future use.
1 . Livestock will not exceed the number allowed .
m. We have an eight yard rubbish truck .
n. We have no problems with storm water retention, if
one arises we will install a retention pond .
o. Debris, junk and waste are disposed of once a
month, or as needed .
p. Erosion control is aided by vegetation cover and
has been determined by Richard Mullaney with the
Soil Conservation Service that this will be
adequate with two sheep for grazing .
q . My intention is to always keep this as an airport
and museum and jump zone.
r. The airport and museum and Inmp zone are all in use now.
3. a. At the time Weld County was zoned , it was
determined that it met the Weld County
comprehension plan. (See Exhibit Al

the proposal is consistent with the intent of the

d . We comply with Federal FAR flight regulations and
have a letter in file from Laura Littrell of the
FAA.
e. It was determined by the Planning commission that
the activities and improvements proposed will be
compatible with existing and future uses in the
neighborhood , (See Exhibit A) . Existing land
uses are listed in 2c ( page 1 ) .
f. As the County is developed , it would be
advantageous to county residents to have an
airport and museum in this location.
g . No Overlay districts affect the site. (See Exhibit
A)
h . We have a 3500 gallon storage tank and system on
the property.

complies with regulation #CRS 25-12-13.

will I be screened is refering to items which are not
visually pleasing. Some items which may not be completely
restored but appear in tact will be displayed without
being screened.

OPERATION STANDARDS
1 . The users permitted shall be an airport for no more
than twenty-five airworthy aircraft ( excluding museum
displays) and antique and collectible museum.
Structures and future structures are as follows: Five
museum storage and workshop buildings. a house, and
old style barn ( or replica of old style barn) an
accessory mobile home used as an office and residence,
twenty-five hangers, one shop and trailer used in
conjunction with the jump operation, fifteen storage
sheds, a display of historical buildings ( log cabin ,
school house, church , telegraph office, weather
reporting station, etc . , display pedestals will be in
various locations on the property and necessary
enclosed storage areas for airplane salvage, unrestored
collectibles ( not on display) and associated parts .
These uses are described in application materials filed
with the Department of Planning Services.
2. The use by Special Review Permit area shall have a
reasonable effort put forth to control soil erosion and
the growth of noxious weeds.
3. One toilet is provided per each hundred persons.
4. The accesses for the airport from Weld County Road 16
to the site shall be maintained .
5. The hangers shall be used for storage, maintenance, and
repair of aircraft and museum displays and airport
vehicles and equipment .
6 . Hours of operation for the airport shall be from dawn
to sunset or eight p.m. , whichever comes first.
7 . Trash and refuse shall be removed from the property
regularly. All trash not removed shall be stored in an
enclosed container to prevent blowing of refuse onto
surrounding properties.
8. There will be access available to the airport for the
following adjacent properties at the airport owners
option: 7462 WCR 11 ; 5053 WCR 16 ; 5059 WCR 16 . The
accesses may be used for ingress and egress for
aircraft and vehicles. The property owner( s) and/or
operator( s) of the airport shall be responsible for
maintaining the fence and keeping it in good repair and
free of debris.
9 . A sign shall be placed on the property containing the
limitations as to use, including hours of operation and
number of airworthy aircraft permitted .

10. The parki..g for 100 vehicles shall rL ..ain the same.
Other parking areas may be allocated for the use of the
operations of the aircraft in storage and in the
hangers.
11 . The building and fuel storage plans shall conform with
the Longmont Fire Protection District requirements.
12. A storage tank of sufficient size to hold 3,500 gallons
of water shall be maintained on the property for fire
protection of the property. The storage tank has had
the approval of the Longmont Fire Protection District.
13. The gas pumps shall be approved by the Longmont Fire
Protection District .
14. Junk aircraft , and miscellaneous parts and other Junk
and accessories, shall be stored within the screened
area provided by the solid security fences. The
security fences shall also enclose all aircraft salvage
parts and museum collectibles not yet ready for
display. Some will be displayed unrestored because
parts are no longer available due to rarity. This
will be the only area where unrestored displays are
located which are not visually screened from all
adjacent properties and road right aways.
15. The property owner and or operator of this operation
shall be responsible for complying with all of the
above stated Standards. Noncompliance with any of the
above Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
16 . The applicant shall comply with the design standards
for the Use by Special Review, Section 24.5 et seq . , of
the Weld County Zoning Ordinance.
17 . The applicant shall comply with the design standards
for the Use by Special Review, Section 24.6 et seq. , of
the Weld County Zoning Ordinance.
18. Representatives or members of the Weld County Health
Department, Longmont Fire Protection District , and Weld
County Department of Planning Services shall be granted
access onto the site at any reasonable time by
appointment only (due to theft , we would prefer no one
comes on the property without advanced knowledge and
one of us being present during inspection, for the
safety of the inspector as well . ) ; in order to insure
the operations carried out on the site comply with the
Operation Standards stated hereon and all applicable
Weld County Regulations.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the
applicant has shown compliance with Section 24.3 of the Weld County Zoning
Ordinance as follows:
The proposed Special Review permit area is located within
the Urban Growth Boundary area of the Towns of Frederick,
Firestone; and the City of Dacono. The Tri-Area Planning
Commission has reviewed this proposal and recommends
approval of this application with conditions. The
concerns expressed by the Tri-Area Planning Commission
are addressed in the attached Conditions of Approval and
Development Standards.
The proposed use is consistent with the intent of the A
(Agricultural) zone district and is provided for as a Use
by Special Review, provided the Conditions of approval
and Development Standards are complied with.
The uses permitted will be compatible with existing
surrounding land uses which include: dryland pasture,
oil and gas productions facilities, and rural residences.
It is the opinion of the Department of Planning Services'
staff that the Conditions of Approval and Development
Standards will make this use compatible with the future
land uses.
No overlay districts affect the site.

The Special Review Permit Conditions of Approval and
Development Standards will provide adequate protection of
the health, safety, and welfare of the neighborhood and
County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to scheduling the case before the Board of County
Commissioners, the application materials and plat, shall be amended
to show the following:
A. display pedestals located within properly screened open
display areas only.
B. the museum and all associated uses shall not exceed 10 acres
in size. The 10 acre museum area shall be clearly identified
on the plat.
C. all areas for open display, display pedestals, museum historic
buildings, and museum display and storage areas shall be
visually screened from all adjacent properties and road
rights-of-way at all times. Visual screening shall be
provided by a minimum of a 6 foot solid board fence. The
fence may be located no more than 8 inches above ground level.
Corrugated metal and/or plywood are not acceptable materials
for construction of visual screening. This does not include
one area containing 9,416 square feet, fenced by the existing
chain link fence.
D. all structures, fences, and display areas shall be a minimum
of 125' from the centerline of existing or proposed runways.

E. the location and features of the storm water management plan
approved by the Weld County Engineer.

4. Prior to recording the plat:
A. Evidence shall be submitted to the Department of Planning
Services that an agreement has been made, in writing; between
the Mountain View Fire Protection District and the applicants,
to mitigate all concerns expressed in Charles E. Boyes' March
19, 1992 letter.
B. An on-site improvements agreement according to policy
regarding collateral for improvements shall be approved by the
Board of County Commissioners for visual screening of existing
museum and airport materials on-site. The applicant shall
complete this form to show the improvements that the applicant
is required to construct and the type of collateral which will
guarantee installation of the solid board fence for visual
screening of all existing museum and airport materials on
site.
5. The applicant/property owner or operator of the facility shall
enter into a road maintenance agreement with the Weld County Board
of County Commissioners when the average daily traffic count meets
or exceeds 100.
6. All existing open storage and display areas shall be visually
screened from adjacent properties and road rights-of-way within 3
months of the date of approval by the Board of County Commissioners
for this Special Review permit.
7. Prior to allowing public use of this Special Review permit area,
evidence shall be provided to the Department of Planning Services
that the Weld County Health Department has approved the
installation of adequate sanitary facilities and water supply.
8. A storm water management plan shall be submitted to the Weld County
Engineering Department for review and approval.
9. This Special Review permit shall be void if conditions of approval
are not complied with and if the plat is not recorded within 90
days of the date of approval by the Board of County Commissioners.
An extension of this time frame shall only be granted by Board of
County Commissioners resolution.

1. The Site Specific Development Plan and Special Review permit is for an
airport, 10 acre open-air museum, balloon bungee jumping facility and
associated uses in the A (Agricultural) zone district as submitted in
the application materials on file in the Department of Planning Services
and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Special Review permit shall not be transferable to any successors in
interest to the described property and shall terminate automatically
upon sale, transfer or conveyance of the property to others for the
operation of the facility.
4. The storm water management plan, approved by the Weld County Engineering
Department, shall be maintained at all times on this Special Review
permit site.
5. The property shall be maintained in compliance at all times with the
Mountain View Fire Protection District requirements.
6. All areas to be used for museum materials storage and display, display
pedestals, museum historic buildings and structures, junk aircraft,
aircraft salvage parts, airport maintenance equipment and derelict
vehicles shall be visually screened, with approved solid board fence,
from all adjacent properties and road rights-of-way. The only exception
is one area, 9,416 square feet in size, specifically shown on the plat.
7. The 9,416 square feet unscreened open display area shall be maintained
in a neat and orderly condition. Should this area not be maintained in
a neat and orderly condition visual screening shall be installed.
8. The storm water management plan approved by the Weld County Engineering
Department shall be maintained at all times.
9. Fences constructed for visual screening shall be a minimum of a 6 foot
solid board slat fence placed no more than 8" from ground level and the
materials and completed fence shall be uniform in size, color, and
shape. The maximum spacing shall be 1/4 inch between boards that are 4
inches or less in width and 3/8 inch for boards that are over 4 inches
in width. The fence shall be maintained at all times in good repair.
10. All materials stored within the visually screened area shall be placed
a minimum of 2 feet from the fence or building providing visual
screening.

11. All commercial operators, property owner, and/or operator shall maintain
individually a minimum liability insurance of $1 million per person and
$3 million per occurrence. The insurance company shall be notified in
writing that Weld County Department of Planning Services shall be
notified in case of insurance lapse. The Department of Planning
Services shall be notified by the insurance companies of current
coverage of operations located on site.
12. For operator safety the Special Review permit area shall be used by one
operation at a time. Jump operations (including parachutes and bungee
cord) shall not be operated while the airport is being used by fixed
wing aircraft, rotary wing aircraft, or hot air balloons.
13. Structures shall not exceed 25 feet in height while the airport is being
used by fixed wing aircraft, rotary wing aircraft, or hot air balloons.
14. All buildings, structures, fences, and display materials and areas shall
be located a minimum of 125 feet from the centerline of existing or
future runways.
15. Gates or openings within the screening fence for access, shall be kept
closed when not in use or designed and constructed to maintain visual
screening from all adjacent properties and road rights-of-way.
16. No organized sale of items associated with the museum or airport
operation shall be conducted on the Special Review site.
17. All waste materials shall be handled, stored, and disposed of in a
manner that controls fugitive dust, blowing debris and other potential
nuisance conditions.
18. The maximum permissible noise level shall not exceed the industrial
limits of 80 dB(A) as measured, according to 25-12-102, Colorado Revised
Statutes.
19. Fugitive dust shall be controlled on this site.
20. The property shall be maintained in compliance with S.A.R.A. , Title III,
requirements.
21. The Use by Special Review permit areas shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust, and the growth of
noxious weeds.

22. Separate toilets shall be installed for each sex at the rate of two for
the first one hundred persons and one for each additional one hundred
persons, or fraction thereof. Portable toilet facilities are not
approved sanitary facilities and shall not be located on the Special
Review permit site.
23. Two accesses for the airport from Weld County Road 16 to the site shall
be maintained. The accesses shall be clearly labeled on the property
and shall be unlocked during public use of the property.
24. Maintenance and repair shall be permitted only between the hours of 8:00
a.m. and sunset but no later than 8:00 p.m. , for uses which create
light, noise and/or vibration noticeable at, or beyond, the property
line.
25. Hours of operation for the airport shall be from dawn to sunset, but no
later than 8:00 p.m. Hours of operation for bungee jumping or other
associated uses of the property shall be from 7:00 a.m. to sunset, but
no later than 8:00 p.m. , Monday through Friday, and 8:00 a.m. to 5:00
p.m. , on Saturday and Sunday.
26. All trash shall be stored inside a building or in an enclosed container
to prevent blowing of refuse onto surrounding properties. Trash and
refuse shall be removed from the property monthly.
27. A four strand barbed wire fence shall be constructed along the entire
west side of the property with three private access points for use by
the following adjacent properties: 7462 Weld County Road 11; 5053 Weld
County Road 16; and 5059 Weld County Road 16. The accesses may be used
for ingress and egress for aircraft and vehicles. The property owner(s)
and/or operator(s) of the airstrip shall be responsible for maintaining
the fence and keeping it in good repair and free from debris.
28. A sign (3 feet x 4 feet) shall be posted at each entrance to the
property containing the limitations as to use, including hours of
operation, and number of airworthy aircraft permitted.
29. A paved parking area of sufficient size to park one hundred vehicles
shall be located on the property. The parking areas may be allocated
for the use of the operators of the planes in storage in the hangars.
The parking areas shall conform to the requirements of Section 41.1.3 of
the Weld County Zoning Ordinance. No parking shall be allowed on Weld
County Road 16. All traffic shall be controlled within the Special
Review permit site.
30. The buildings, gas pumps, and fuel storage shall conform with the
Mountain View Fire Protection District requirements.

31. A storage tank of sufficient size to hold 3,500 gallons of water shall
be maintained on the property for fire protection of the property. The
storage tank shall have the approval of the Mountain View Fire
Protection District.
32. The owner/operator shall maintain a ditch for traffic control on the
south side of the property.
33. Aircraft designed to be used for the museum shall be displayed in the
designated areas on the plat.
34. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason for
revocation of the permit by the Board of County Commissioners.
35. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
36. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
37. Representatives or members of the Weld County Health Department,
Mountain View Fire Protection District, and Weld County Department of
Planning Services shall be granted access onto the site at any
reasonable time in order to insure the operations carried out on the
site comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
38. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.

Mr. Schuett:
After reviewing the materials you sent on Mr. McDonald proposed
airport and museum and after taking a tour of the proposed
facilities, we urge that Mr. McDonalds request for a special review
use be denied at this time for the following reasons:
1. A review of the history of this proposal shows that Mr.
McDonald has not met the requirements of the original special
review permit. This latest request only seems to be a thinly
veiled attempt to make legal all the infractions of his present
permit.
2 . Although Mr. McDonald may be sincere in his desire to create
a museum, we think that he does not have the wherewithal to
accomplish the task. Museums display items in a narrow well
defined context that will give the viewer a sense of their
historical meaning or value. Mr. McDonald' s collection of
airplanes in various states of disrepair, no more imparts any
knowledge of the development of aviation, than what an auto junk
yard tells us about the development of the automobile.
3. Mr. McDonald continues to acquire more and more pieces of
airplanes, autos, etc. If he lived for a hundred years, he would
never be able to restore what he presently has on the site. So why
should he be allowed to continue in his present activities? He is
not creating an airplane museum, but an airplane salvage yard.
4 . Mr. McDonald has several storage buildings on the site which
do not meet any building or fire codes that we are aware of.
5 . Mr. McDonald' s request to allow ballooning and bungee jumping
from his airport are activities that are increasingly becoming an
annoyance to the surrounding property owners. I know you have
heard their complaints. Unless the County can enforce stricter

regulations to insure that this operation is made more compatible
with surrounding homeowners, this activity should not be allowed.
6. The Town of Frederick has annexed areas on all sides of the
airport. The present Comprehensive Plan of the Town designates
these areas as low density residential. The Town is presently
working with land owners to develop the land west of County Road 11
into a residential area with an 18 hole golf course. We are very
concerned that the County is still allowing uses that might be
appropriate in a rural area but will not be compatible as the area
becomes more urbanized.

I have reviewed the submitted materials and drawings for
compliance with the Uniform Fire Code and the Fire
Protection Development Standards, as adopted by the Fire
District. Below are listed the items that are needed to
comply with these standards:
1. The minimum required fire flow for a commercial
development is 2500 gallons per minute at 20 psi
residual pressure. This may be provided by connection
to a water system of a municipality or water district
or by on site storage. The water supply, whether
provided by a water system or on site storage, must be
able to maintain this fire flow for 120 minutes. If on
site storage is selected as the method of providing the
required fire flow, fire pumps to provide the required
flow and pressure must comply with National Fire
Protection Association (N.F.P.A. ) Standard 20, Standard
for the Installation of Centrifugal Fire Pumps . (Fire
Protection Development Standards Section 5 .02-3)
2 . Based on the required fire flow, a minimum of three
fire hydrants are required to be installed on the site.
These are to be served by the water system described in
Item 1 above. The average spacing between hydrants is
450 feet. Hydrant and underground piping installed
shall comply with N.F.P.A. Standard 24 Standard for the
Installation of Private Fire Service Mains and Their
Appurtenances. (Fire Protection Development Standards
Section 6.04-1)
3 . Fuel tanks, piping and dispensing units installed on
the site must comply with all requirements of the
Uniform Fire Code Article 79 . Contact the Fire District

for specific requirements and details. A permit from
the Fire District is required for installation or
alteration of fuel tanks, piping or dispensing units.
4 . Hangars, museum display buildings and workshops
constructed in the future must comply with all
requirements for required fire flow, access and
hydrants. When planning the water system for this site
it is important to anticipate future construction.
Required fire flow, number of hydrants and hydrant
location is dependent on the type of construction and
square footage of construction. The 2500 gallon per
minute fire flow outlined above is the minimum fire
flow for a commercial site. For example, a 20, 000
square foot building could require a fire flow of 3,750
gallons per minute for certain construction types. It
is important to coordinate plans for future
construction with the Fire District to avoid conflicts
with Codes.
5 . If the workshops are to include spray painting
operations for aircraft or vehicles, those spray
painting rooms, areas or booths shall comply with
Article 45 of the Uniform Fire Code.
6 . The Fire District has adopted a plans check and
inspection fee. For future reviews of construction
plans on this site, the Fire District should be
contacted for the amount of the fee.
The Fire District has recently examined the water supply
situation to the airport. The Fire District will allow one
additional building, in addition to those already on the
airport site as of this date, to be constructed or moved
onto the site using the present 3500 gallon tank for fire
protection water. If any building is built or moved onto the
site after that, then water for fire protection must be
provided as described in Paragraph 1 above. The Central Weld
Water District has a 6 inch pipeline about 3500 feet north
of the intersection of WCR 11 and WCR 16 on WCR 11 . Plans
should be made to extend that water line onto the site and
provide hydrants as shown above.

When the applicant first applied for an amended USR in October of 1991, he
proposed major additions to the property. Although a few buildings have been
left off of the most recent application, the applicant is still proposing a
substantial expansion. Originally, he proposed up to 1,000 museum patrons per
day, and now proposes the maximum number of users would remain at 200.
The most recent traffic counts indicate approximately 200 vehicles per day on
Road 11, and 100 vehicles per day on Road 16. The applicant indicates the
vehicle traffic count would remain at 100. I recommend a road maintenance and
improvements agreement be required if there are more than 100 vehicles per day
generated by the site.
This application still proposes the addition of several buildings. Storm water
discharge will definitely increase from the site. The applicant should be
required to provide a storm water plan that addresses how runoff is handled on-
site, detention facilities, and effects to downstream properties.

States Department of Agriculture has just recently developed new rules and
regulations governing storage, mixing and loading of pesticides and fertilizers.
This is in accordance with 25-8-205.5 of the Colorado Water Quality Control Act.
We feel that their rules and regulations should apply in this and future similar
cases.

Dear Keith,
The above captioned application was reviewed by Tri-Area Planning
Commission on March 12th at a work session. We heard public
comments in November 1991 and March 1992 , walked through the
property on March 7th, and have been individually contacted .
Since our response is required by March 24th for the April 7th
meeting of Weld County Planning, and our meeting is in jeopardy
because of the municipal elections , we determined there was
sufficient information to respond.
Of those expressing a negative opinion on the airstrip operation,
the majority recognized the inherent value of its development .
Their objections focused on; the quantity and quality of visible,
outside storage of relics ; the appearance of existing, and lack
of sufficient , screening; and, the disruption (nuisance) resulting
from public activities (parachuting, bungee jumping, etc. ) .
Section 2 .a . of the application narrative refers to a 50% division
between airstrip and museum acreage. Precise language is missing
as to museum acreage, thus conjuring up visions of any and all
types of described mechanical contrivances sprawling over 20
acres . It is reasonable to assume, when restoration catches up to
acquisition, the units would be stored or displayed in buildings
because of weather related deterioration, a common problem in
Colorado. Considering the potentials, we recommend that outside,
uncovered storage of the described units , be limited to 10 acres .
The remaining 30 acres can be devoted to airstrip, residential
(owner and caretaker) , and buildings ( including hangers , workshops ,
displays, etc. ) .
Fences have acquired expanded uses beyond exclusion and/or con-
tainment. "Ladybird" fences are now used for screening, only
secondarily for other purposes as referred to in the narrative.
Existing fencing is ineffective and unsightly. Required screening
at other locations (example : Columbine Metals ) , although not
entirely effective, are an improvement. Also, from the WRC #11
(West ) side, an appropriate application would run from the
He$son north property line to the Grisham north property line.

The Tri-Area Planning Commission considered the above captioned
application on November 5, 1991 , a review of the application and
evaluation of the objections from adjaclent property owners compelled
the Commission to unanimously recommend denial of the application
for amendment .
The following considerationsled to the recommendation:
1 . Safety concerns resulting from increased air traffic and
potentially larger aircraft if uses are expanded;
2 . Continued and increased incidences of tr5spassing from
uncontrolled or uncontrollable activities ;
3 . History of zoning violations to the extent that annexation
discussions were terminated ; no indications were given that
the approval of this application would improve the relationships
within the neighborhood or any other complainants;
4. The present airport is bounded by roads 11 , 16 3/4 and 18 .
Adjacent to the existing facility are single family residences
and small to medium agricultural operations (crops, hay,
livestock, etc . )
5 . Referencing the application, page 2 , item 2e - " . . .users could
be up to 1 ,000 per day. . . , " item 2f - " . . .employees . . .could
grow to 100 . . .hours of operation from daylight to sunset, " item
2i - " . . . traffic. . .could consist of 500 vehicles per day. " The
foregoing projections compels concern for substantial traffic
increases and the resulting safety and pollution effects .
Roads 11 and 16 are gravel roads and minimally maintained.
6 . Items 2g and j appear to be deficient considering the applicants
desired increase in activity.
Considering the applicants intentions , we feel the desired activities
are not compatible with agriculturally zoned areas, exceed the
ancillary purpose originally intended , and disregard the health and
safety of adjacent residents .

Dear Keith,
In response to the Tri-Area Planning Commissions letter to you dated 11 1U-91.
1. We stated in our application that this was moving toward 80% museum
and 20% airport which would decrease notincrease air traffic and nothing
has ever been mentioned about larger aircraft, our only expansion is
for museum display. In fact if you look at the map it shows going
from two runways to one in the future.
2. Ballooning activities which used to operate here have moved to the
east of Firestone. Property is now secure on all four sides with
fences and lockable gates and we anticipate no future problems.
3. We never applied for annexation and after discussing it with several
local people we decided against it at this time since Ed T'agi..iente,
the mayor of Firestone indicated that they only needed one more
property and then our annexation would be automatic anyway.
4. Requires no response.
5. Since our last amenduent to the USR the price has increased aPpx.
900% so we have tried to incorporate all our needs for the next twenty
to thirty years in this application. We do not plan this increase
in activicy to begin tomorrow or next week or next year but over the
next two to three decades our hope is to have a museum fashioned after
the Pioneer Museum in Minden, Nebraska and would bring in additional.
revenue to the iri-Area. How could the Weld County and Tr-Area
Commissioners be against any activity that would create jobs and revenue
and attract tourist?
6. Within the next 20 to 30 years as we expand we hope to have city water
and sewage. In the meantime how is Colorado National Speedway (two
miles south of us) addressing this problem?
Also in answer to question #5 above The Colorado National Speedway
is on a minimally maintained road with thousands of customers in one
day and it has not caused any problems.
As far as our desired activities not being compatible with agriculturally
zoned areas. the whole town of Minden, Nebraska is real agriculture and
the Pioneer Museum is the only attraction which brings tourist and revenue
from all over the world and causes no disregard to the health and crafty
of residents as ours will. not. We have operated here for twenty three
years and no residents have been harmed and the majority of the town residents
don't even know there is an airport here.

Gentlemen: James M. McDonald
This is in reply to the application from James M. McDonald for a Site
Specific Development Plan and Amended Special Review Permit. In the
application, it states under "Application 2. Item I. Livestock will not
exceed the number allowed, and Item p. Erosion control is added by
vegetative cover." It is recommended that a vegetative inventory be
completed and plans developed to establish proper grazing amounts and
erosion control during the process.

SUB: Two small sheds located on James McDonald property
facing WCR 16.
A Mr. Richard Rooney moved LONGMONT PARACHUTE CENTER from Longmont Municipal
airport to the above location in the spring of 1973.
In 1974, Mr Rooney acquired a second aircraft, a twin Beech 18, necessitating
storage, warehouse and locker security.
Each of these buildings were moved in intact and on skids. The larger was
used promarily to store the seats (10) of the Beech when it was used for
skydiving. The smaller bldg., was utilized for tools, spare parts and motor
oil.
Mr. Rooney abandoned these buildings and disposed of his interest at this air-
port prior to 11-17-1975.*

Dear Mr. Schuett,
This letter is in response to the application submitted to expand the
McDonald airstrip. After reading the application, hearing many of the
concerns brought up by my neighbors, and weighing the past track record
of the place, I am strongly opposed to the granting of this permit. I also
feel that the current permit requirements need to be enforced.
in the application Mr McDonald commits to nothing. The use of the words
"including but not limited to" grants carte blanche. The airstrip would be
limited to nothing. Whoever, whenever and used for whatever is my
interpretation of the terms being used here. There are too many undefined,
gray areas in this application that Mr McDonald could interpret to fit his
changing needs thus keeping the county off his back.
Included in this proposal is the provision for the bungee-jumpers to use
this area again. I'm sure I don't need to remind you of the problems they
created last summer with their constant noise starting at dawn, all night
Parties, open campfires and tampering with the oil wells. There were a
number of road hazards created by the excessive number of cars. And last,
the law enforcement agencies failure to do anything about it. Last summer
an article appeared from the associated press issued by the Boulder County
Zoning Division which "classifies bungee-lumping as an outdoor,
recreation, permitted only in non-residential, commercial business
districts." by using this policy a lot of the problems that were experienced
by residential and agriculture residents from this sport, were solved.
Mr. McDonald's proposal includes spray planes and fuel tanks. This means
chemicals. What kind of safety regulations is he going to force on the
people using the property and how is he going to enforce them? He doesn't
live on the site, he uses a Wheatridge address. What about the proposed
gliders or any other type of craft using this strip, who is liable when they
crash into our houses and kill or injure us or our live stock. He claims no
responsibility for what happens on his land. There are no regulations
requiring Mr McDonald or any body using his land to carry liability

Re: James McDonald ' s use permit
SAFETY
Mr. McDonald states that "All types of aircraft operate here,
including but not limited to, air planes, hot air balloons , helicopters ,
spray planes , gliders and ultralites . " The truth of the matter is that
I 've only observed airplanes , hot air balloons , gliders and ultralites
operate at the airport. In order for them to operate successfully,
and safely, they were forced to trespass on the 40 acre parcel adjoining
Mr. McDonalds property to the east, which is owned by Ronald Gaulke.
I have been granted power of attorney for Mr. Gaulke ' s property as he
lives in Wisconsin.
Mr. Gaulke came to Colorado last summer and erected a fence
on his property at the property line of Mr. McDonald ' s land. Shortly
after being installed, the fence was cut down. Oddly enough, the fence
has been cut in the exact area where the bungee jumpers moved their
operations when they were forced off of Mr. Gaulke ' s land when he regained
control of it. The simple fact of the matter is , "Does Mr. McDonald
have enough land to safely implement all proposed operations, with future
expansion, when he could not accomodate the activities of the airport
last summer?"
LIABILITY
At the Tri-Area Planning Commission meeting on 7Uesday March
3 , Mr. McDonald was posed with a question in regards to liability at
the airport. I was appalled at his response when he claimed that due
to the fact that the airport is privately owned that he does not have
to assume liability for the activities being carried out at the airport.
I may have misunderstood this statement, but nevertheless , I feel that
Weld County should clarify the responsibility of liability to the
surrounding neighbors of the airport. It is my personal opinion that
Mr. McDonald should be liable for activities on his property, just as
all land owners are liable for activities carried out on their property.
Recently, Ed Herson, the operator of the parachute activities at the
airport, was fined by Flight Standards for various violations . Mr.
McDonald was more than likely aware of the violations of Ed Herson,
but he continued to allow him to operate on his property anyway. Mr.
McDonald claims, "We comply with Federal FAR flight regulations . . . "
Does "WE" in the above statement refer to ALL users of the airport?
If so, FAA, Flight Standards , and the NTSB, probably have documentation
to the contrary.

FIRE HAZARDS
Mr. McDonald states that there are several fuel storage tanks
on his property, as well as various other chemicals used with the spray
planes for agricultural purposes . These large quantities of fuel and
other chemicals pose a threat to surrounding citizens , as well as the
McDonalds themselves . Not only is the potential for a fire of outstanding
magnitude greatly possible, but the storage of these chemicals should
also be addressed. Are these fuels and chemicals being stored according
to EPA and HAZ-MAT regulations? Mr. McDonald proposes that a 3500 gal .
water tank will be their one and only means of fire protection. In
my opinion, a 3500 gal . water tank is completely and totally insufficient
for the property as it presently exists . ? feel that due to the fact
that he will be running an operation that serves the public, it should
be his responsibility to have an inexhaustible supply of water to meet
the high fire hazard. He should be required to run a water line and
have at least two fire hydrants on the property.
In closing, I would like to state that I am not opposed to
an airport that is well run and clean. In fact, an airport that is
well run and clean could quite possibly be an asset to the Tri-Area
as well as the surrounding agricultural property. What I am opposed
to is the non compliance that presently exists. I am extremely opposed
to Mr. McDonalds interpretation of his special use by review permit,
as he adopts its wording to his benefit, with a total disregard for
his existing permit. Mr. McDonald continually operates out of compliance .
It would be my inclination to revoke his current permit, as well as
to deny any further expansion on this property.
I strongly urge each and everyone of you to consider the wording
which is used throughout Mr. McDonalds application, I quote "INCLUDED,
BUT NOT LIMITED TO. . . " What a scary thought ! !

This letter is in reference to the amended Special Use Permit
Application submitted by Mr . James McDonald . As a property
owner in the area I wish to address some concerns with the
application .
My neighbors and I have been fighting the noise and traffic
issues for quite some time . The amended application states
that vehicular traffic will consist of passenger vehicles and
traffic will depend on museum popularity , but could consist
of 500 vehicles per day . Our roads were not designed to
accomodate that many vehicles on a daily basis . Is Weld County
going to pave the roads to allow for additional traffic and
eliminate the constant blowing of dust?
The application also states that the number of users could be
up to 1 , 000 per day . We already have a problem with noise
pollution from the activities of his current permit . Can you
imagine the noise generated by 1 , 000 people that are jumping
from balloons , planes and platforms or structures ! Add the
noise from several airplanes , balloons and ultralights at
6 : 00 A . M. and the whole community will be able to discard their
alarm clocks ! I fail to understand the compatibility within
an agriculturally zoned area . I am not opposed to a well kept ,
well run personal airstrip however , keeping in mind the history
of non-compliance and the nuisane factor , I urge the Planning
Commission and the Board of County Commissioners to cautiously
consider Mr . McDonalds application .
I wish to extend my Thanks to all members of the Planning
Commission and the Board of Count Commissioners for considering
my concerns in this matter .

Dear Mr . Schuett ,
As interested citizens and homeowners in Weld County , I am
writing in regard to the Use by Special Review Application
which has been submitted by Mr . James McDonald . As property
owners adjacent to Mr . McDonald , we have several concerns that
we would like to bring to the attention of the Board Members .
Our number one concern is SAFETY ! ! ! We have two small children ,
ages seven and nine , who like to ride horses . Mr . McDonalds
runway is adjacent ( to the south) of our horse pasture . The
airplanes always land from the north going directly over the
horse pasture and frightening the horses . The potential for one
of my children being harmed while riding is very , very great !
Mr . McDonald has stated that he has provided parking for 100
vehicles . I have numerous photos showing cars lined up on
both sides of Road 16. On several occasions , emergency vehicles
have been called to the airport however , due to locked gates
could not gain access . Fortunately , no one has ever been injured
to the degree that they required emergency aid on site but in
the event they should , how will the emergency team get to them?
How will Weld County ever ensure that people participating in
these activities will be properly cared for? Shouldn ' t someone
have the health , safety and well being of residents and part-
icipants in mind?
As a parent I am afraid for my children ! ! Those fears include
planes frightening the livestock , planes crashing in our pasture ,
potential fires . If I need emergency aid for my children will
they be able to reach me or will there be numerous obstacles
to endure because of this airport and museum?
As property owners and parents we are requesting that the
Weld County Planning Commission and the Weld County Board of
County Commissioners to carefully scrutinize Mr . McDonalds
amended application . For someone who has such a poor record
in the past of violations on his current Special Use Permit ,
we feel that an amended permit should be out of the question .
We would like to Thank the Planning Commission and the County
Board of Commissioners in advance for listening and considering
our concerns .

This letter is in reference to the amended Use by Special Review
Application recently submitted by Mr . James McDonald . I would
like to bring my concerns to the attention of the Planning
Commission , as well as , the Board of County Commissioners before
the April 7th meeting of Weld County Planning .
Mr . McDonalds current application states that he has a 3500
gallon water tank on the property for fire protection . The
storage tank has been approved bu the Longmont Fire Protection
District for current structures but will this be adequate for
32 acres dedicated to eleven museum displays and workshops , a
house , an old style barn , a mobile home used as an office , forty
hangers , twenty storage sheds , a log cabin , a school house , a
church , a telegraph office and numerous buildings containing
airplane salvage , unrestored collectibles and associated parts .
I find it hard to believe that 3500 gallons of water could pro-
tect that many structures . And what would happen should that
fire spread to surrounding properties? We currently have
problems with cars parking on Road 16 making access for emer-
gency vehicles impossible . In contacting a Fire Protection
District regarding an airplane fire , we were told that it
required chemicals to contain a fire of that nature . Has
Mr . McDonald made provisions for this kind of occurance or do we
solely rely on emergency aid?
Mr . McDonald has a past history of non-compliance of his
current Special Use Permit , will he really commit to the
necessities of the amended application? I urge the County
Planning Commission and the Board of County Commissioners to
carefully study Mr . McDonalds amended application for com—
patibility with future uses in the area .
My Thanks to the Board of County Commissioners and the
Planning Commission for their consideration in this matter .

4e have lived here since. 1965. :When we bought 20
acres out of this section of wheatland we had to wait
until after harvest to take possession.. But we didn' t
mind that or all the work it took to make: our home here.
we. loved the rural atmosphere and the absolute quiet.
Then the airport came along. To begin with this
airport started without permission and over protests.
4Ihat they do is done first then permission asked after
the fact and frequently continued after refusal.
James McDonald and associates are regularly before
the Comission answering violations and then submitting
applications to cover the. situation. This can be
historically documented. Each time they promise all
regulations will be. followed,all violations corrected,
and nothing new will be added. But if these: scoff-laws
do anything it is done only in the most perfunctory
manner passible.
The newest application will however solve the
problem and expense of frequent inspections,citations,
and hearings. It grants Mr. McDonald and associates
absolute carte blanche in everything and anything they
might do or ever think of doing. The phrase "includes
but. not limited to" covers it all. What unlimited
power,.priviledge,s.eope of operation, and junkyard this
could grant.. No. one would ever again be able to. question
anything done at the airport. And who will have to live
with this? 4e who make our homes here. Mr. McDonald
has said for years he. plans to build his. house. out here.
Is there any evidence? Or is he comfortably far away
from the obscene language,the noise,the. traffic,the
clouds of dust,the screaming ambulance,fi.re and police
vehicles?' M.o s t importantly is it wise to grant Mr.
McDonald such a far reaching liscense especially in
view of his past track record?
Please, we ask your careful consideration on this
matter and we hope a refusal of this application.

Dear Mr . Schuett , Weld County Planning
I am writing this letter to voice my concerns with the amended
Special Review Application submitted by Mr . James McDonald .
My concerns are numerous however , if I mentioned them all , I
would have enough chapters for a book so I will concentrate
on the ones most disturbing to me .
Our area has been agriculturally zoned so I fail to understand
how Mr . McDonald has or will be allowed to collect funds from
individuals for activities such as parachute jumping and bungee
jumping . These activities may have been compatible when this
area was more rural however , it has and is becoming , more
urbanized , especially with the current planning of a 18 hole
golf course and housing development on Road 18 . Mr . McDonalds
airstrip , if properly maintained , is fine for his personal
use but I do not find his amended application compatible with
this area currently or in the future .
Within the application , Mr . McDonald has stated that his intent
is to have 80% or 32 acres as a museum and 20% or 8 acres as
an airport to accomodate his friends and neighbors that fly , as
well as his flying museum displays . How can 8 acres accomodate
hot air balloons with bungee jumpers , helicopters , spray planes ,
gliders , ultralights , bungee jumping structures and parachute
jumping? His property may have been an airport since 1930
but I don ' t believe anyone would have ever expected all of
these activities to take place in that small of an area !
Mr . McDonald has made comment that he carries no home owners
insurance . If the amended application is approved , will Weld
Count ensure that Mr . McDonald has appropriate insurance
coverage? Mr . Herson currently operates his jump facility
with no insurance coverage ! Will Weld County ensure that he
operates with appropriate insurance coverage? Because I am
Mr . McDonalds neighbor , I could potentially lose livestock ,
my home and vehicles because he has no insurance . If an
airplane crashed on the north end of his runway and started a
fire , burned my barn or my home , I am liable for losses that
he created .
I believe that Mr . McDonalds dream for a museum is truly
wonderful but I don ' t think he has obtained the amount of
land required to accomodate that dream. Why isn ' t he more
willing to fulfill that dream in more adequate surroundings?
I would think a more rural setting would better facilitate
his dream and offer his public following better enjoyment
of that dream.

The applicant is proposing a dramatic expansion from the existing use. He
indicates the possibility of 1000 museum patrons per day and up to 100
employees. Also, his application would allow the construction of a number of
buildings and airplane hangers.
The gravel roads that serve the area would not support the additional traffic
generated by the proposed facility. The increase would make surface
maintenance and dust control unmanageable. If the applicant is granted this
use, he should be required to enter into a Road Improvements Agreement with the
Board of Weld County Commissioners that would address paving roads that access
the site.
The addition of the proposed buildings would definitely increase the storm
water discharge from the site. The site drains to the west across neighboring
properties and onto County Road 11. The applicant should be required to
provide a storm water plan that would address how run off is to be handled on-
site, detention facilities, and effects to downstream properties.
Two entrances are shown from Weld County Road 16. It is my understanding one
is to be used for a residential purpose, and the other to be used as a
commercial entrance to the airport and museum. The residential access should
be restricted to that use, and the commercial access paved and upgraded to a
standard suited to the traffic. Acceleration and deceleration lanes are not
warranted because of limited use by heavy vehicles.

Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. All waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. An I.S.D.S. Evaluation on any existing septic systems will be necessary,
prior to issuing the required septic permits on the existing systems.
7. Bathrooms with adequate toilet facilities served by an individual sewage
disposal system, are required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal
Regulations. The use of portable toilets will not be acceptable at this
facility.
8. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.

Jim McDonald asked me to write you a follow-up letter regarding
their Site Specific Development Plan. He said via a phone conversation,
the maximum number of animals to graze will be two sheep over
40 acres. I have not taken an inventory of the area nor looked
at the range site description, but do believe that two sheep will
not harm the vegetative resource.
Fencing could be used in the area to better manage the resource
and give part of the area a rest each year. Continuous grazing
over the entire area throughout the year promotes spot grazing
which is not good for the vegetation. Splitting the area into two
or more pastures would create a more even grazing pattern over
the area.

To Whom It May Concern,
This letter is written in response to the application for an Ammended
Special Review Permit filed with the Weld County Planning Office on behalf
of Mr. James McDonald and the Fredrick/ Firestone Airport -- "Wings & Things
Museum and Airport" (Case # USR 537-3) .
I understand that this is a private use airport, and that many of the
guidelines and regulations set forth for public use airports may not be
applicable in this case, however, there is purpose to these guidelines --
and that is to help ensure a safe operating environment for airport users
as well as the surrounding community.
I would like to point out some of the safety guidelines as may be found
in Federal Aviation Administration Advisory Circular 150/5300-13 that I
believe should be considered when planning future use at this facility.
For example: (1) Runway Object Free Area (as denoted by the orange lines
drawn onto the plot plan) -- depicts a ground area approximately 250 feet
in width (125' either side of runway centerline) which should remain
clear of all objects except those objects that are fixed by function (such
as navigation antannae) critical to aircraft operations . It is evident
that a number of structures/ buildings encroach into this area, including
the "future old fort," an entire row of aircraft hangars that run parallel
to, and apparently actually touch along the edge of the actual runway,
several museum display workshops , a tie-down display area, several
undefined future historic buildings , and a number of "display pedestals"
and display areas ; (2) Runway Safety Area -- this is an area which in
this case should be at least 120 feet in width (60' either side of runway
centerline) which should be prepared or suitable for reducing the risk
of damage to airplanes in the event of an undershoot, overshoot, or
excursion from the runway (requires an absence of ditches, obstacles ,
and debris) ; (3) Aircraft Parking Area -- runway separation standards
outlined to provide an area at least 125 feet in width (62.5' either
side of runway centerline) in which no aircraft should be parked. This
helps to avoid incidents involving landing/taxiing aircraft from colliding
with parked aircraft; (4) Runway Visibility Zone -- there are guidelines
which necessitate free and unobstructed visibility between the ends of
intersecting runways to help ensure that two aircraft operating on
opposing runways may see one another, thus avoiding a simultaneous
take-off and collision with one another at the intersection -- the
erection of museum workshops , displays , and a house/duplex between the

ends of the existing runways would preclude this line-of-sight requirement;
(5) Obstruction Clearance guidelines for approach end of runways would
also be viewed as being in violation of safety standards -- no object
should penetrate a surface that starts at the threshold of the runway
centerline and slopes upward from the threshold at a slope ratio of 20:1.
The road on the south side of the property (WCR 16) constitutes a 15' obstacle
by FAA Standards -- at a ratio of 20:1 this would dictate that the
threshold of the runway should be moved 300' into the property from
the road. Additionally, the 4' fence on the north side of the property
would dictate that the runway be moved 80' into the property from
that end for proper obstacle clearance. These and other safety issues
should warrant further evaluation and consideration.
Recommendations to promote a safer operating environment would include:
(1) Construction of one runway running north/south located toward the
east side of the property -- this will help remove the landing surface
from close proximity to the large array of buildings, displays , and
obstacles as proposed. Additionally, the difference in magnetic alignment
of the two existing runways is nearly negligible (less than 20 degrees) ,
and therefore it appears there is no real forseeable benefit to having
two runways as opposed to one; (2) Eliminate all proposed structures ,
displays , exhibits , jump zones , parking areas , etc. that encroach into
the Runway Object Free Area -- there are several high safety concerns
with having any obstacles within this area, particularly the high
number of obstacles as proposed. In the event that an aircraft loses
control or departs the runway to either side for some reason, the
existence of the number of obstacles as proposed would almost certainly
insure collision with one or more of those obstacles and/or other aircraft
and individuals -- possibly causing great harm and damage to persons
and property; (3) Several inconsistencies exist with the design plan
as currently drawn -- the existence of a jump zone located within a
display area does not prove to be a productive relationship, as a jump
zone should also be free of obstacles . The area allotted for future
parking of 500 cars is far too small an area to accommodate such a
number of vehicles -- this area is also described as another jump zone
which would also not prove conducive to such an activity while also
serving as a parking lot.
Locating and constructing a single north/south runway to the eastern side
of the property, free of all obstacles on either side of the runway, as
well as bringing the approach ends of the runway inward to provide for
proper obstacle clearance outward from the thresholds -- in conjunction
with locating all display areas to the west side of the property, would
certainly improve levels of safety at the airport.
I would like to point out that the proposed operations at the "Wings &
Things Museum and Airport" meet none of the safety criteria required
for public use airports , and I would hope that Mr. McDonald reconsider
some of his planned operations , designs , and additional structures
that may prove to be detrimental to flight safety at his facility.

Dear Mr. McDonald:
Your application and related materials are being processed for the request described
above. I have scheduled a meeting with the Weld County Planning Commission for
December 3, 1991, at 1:30 p.m. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Planning Commission members might have with
respect to your application.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is location within the comprehensive planning area of
a town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Tri-Area Planning Commission for its review and comments. Please
call Jay Curtis at 659-8112 for further details regarding the date, time, and place
of this meeting. It is recommended that you and/or a representative be in attendance
at the Tri-Area Planning Commission Meeting to answer any questions the Commission
members may have with respect to your application.
It is the responsibility of an applicant to see that a sign is posted on the property
under consideration at least 10 days preceding the hearing date. Sometime prior to
November 15, 1991, you or a representative should call me to obtain a sign to be
posted on the site no later than November 19, 1991. The sign shall be posted

The Tri-Area Planning Commission considered the above captioned
application on November 5, 1991 , a review of the application and
evaluation of the objections from adjacent property owners compelled
the Commission to unanimously recommend denial of the application
for amendment .
The following consideration9led to the recommendation :
1 . Safety concerns resulting from increased air traffic and
potentially larger aircraft if uses are expanded;
2 . Continued and increased incidences of trtdspassing from
uncontrolled or uncontrollable activities;
3 . History of zoning violations to the extent that annexation
discussiore were terminated ; no indications were given that
the approval of this application would improve the relationships
within the neighborhood or any other complainants;
4. The present airport is bounded by roads 11 , 16 3/4 and 18 .
Adjacent to the existing facility are single family residences
and small to medium agricultural operations (crops, hay,
livestock, etc . )
5 . Referencing the application, page 2 , item 2e - " . . .users could
be up to 1 ,000 per day. . . , " item 2f - " . . .employees . . .could
grow to 100. . .hours of operation from daylight to sunset, " item
2i - " . . .traffic. . .could consist of 500 vehicles per day. " The
foregoing projections compels concern for substantial traffic
increases and the resulting safety and pollution effects .
Roads 11 and 16 are gravel roads and minimally maintained.
6 . Items 2g and j appear to be deficient considering the applicants
desired increase in activity.
Considering the applicants intentions , we feel the desired activities
are not compatible with agriculturally zoned areas, exceed the
ancillary purpose originally intended, and disregard the health and
safety of adjacent residents .

April 1, 1991 Received a letter dated March 30, 1991 from Chirstine
V. Warren, Adrenalin Adventures.
April 2, 1991 Staff informed Christine V. Warren that the proposed
uses would be a material deviation to the approved
plans and would require an Amended Special Review
permit. Prior to the activity being conducted on the
property.
April 3, 1991 The Special Review permit application was reviewed with
Christine V. Warren.
April 4, 1991 The Tribune ran a front page story about the bungee
jumping conducted April 4, 1991 on the Special Review
permit site.
April 5, 1991 Violation letter issued.
May 17, 1991 A property owner in the area indicated the bungee
jumping activity is still being conducted on the
subject property.
May 20, 1991 A certified letter was sent to property owner and
operator indicating that the probable cause hearing was
scheduled.

compliance with Development Standards placed on your property at the time USR-537
was approved by the Board of County Commissioners (violations of Operation
Standards #1, 17 , and 21) . A copy of these items from the approved resolution
are enclosed.
The Use by Special Review area must be brought into compliance with the
Conditions of Approval and the Development Standards within 30 days from the date
of this letter. Noncompliance will result in our office scheduling a Probable
Cause Hearing before the Board of County Commissioners. If the Board determines
there is sufficient probable cause to warrant further action, a Show Cause
Hearing will be scheduled to consider revocation of the Use by Special Review
permit.

COLORADO MANS 2,400' FALL WILL BREAK THE WORLD 'RECORD.
BOULDER, OD - Boulder adventurer Doug Base (Hat-zee) will once again attempt
to break the world record bungee cord jump by free-falling 2,400 feet from a hot-
air balloon.
The standing record of 1,000'feet, set in February, 1991 by a California team,
was reported to have been broken by the same group, with an unconfirmed jump of
2,000 feet, in September, 1991. Base, 23, had attempted to break the record last
month, but was forced to abort the balloon jump due to adverse wind conditions.
The jump will take place at sunrise Monday October 14, north-east of Denver.
Media wi4bing to attend the world record breaking attempt should phone (303)572-6575
for a recorded message confirming the time and date of the jump. While scheduled
for Monday morning, adverse wind or other weather conditions may necessitate a. post-
ponement. Confirmation will be recorded by 4 a.m.
To reach the drop site, travel I-25 north from Denver to Ett 235. Travel
rient on Highway 52 for one stile to Road 11. Travel left one mile to Road 16.
Travel right 100 yards to site on left side of road.
