WHEREAS, the Board of County Commissioners of Weld County, Colorado,
o w pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
2 with the authority of administering the affairs of Weld County, Colorado, and

WWHEREAS, the Board has been presented with an Intergovernmental Agreement
0o c4 between the County of Weld, State of Colorado, and the City of Greeley to pave

59th Avenue, with the terms and conditions being as stated in said agreement, and

WHEREAS, after review, the Board deems it advisable to approve said
N U agreement, a copy of which is attached hereto and incorporated herein by
reference.

W NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
o y County, Colorado, that the Intergovernmental Agreement between the County of
Weld, State of Colorado, and the City of Greeley to pave 59th Avenue be, and
o hereby is, approved.

Z BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
N Z authorized to sign said agreement.

WHEREAS, the City of Greeley Public Works Department and the n
Weld County Department of Engineering jointly determine it to be IC

asphalt repair and overlay project being administered by Weld Z z tv
County on 59th Avenue, between 20th Street and 4th Street . hi N

WHEREAS, this section of roadway is jointly owned in portion a o
by the City of Greeley and Weld County. o

WHEREAS, funding would be available to complete the asphalt z
overlay work along 59th Avenue out of the 1992 Food Tax surplus, n N
or the 1993 Food Tax Program.

NOW, THEREFORE , in consideration of the mutual covenants and N
conditions hereinafter set forth, the County and City mutually R'' ;i;

The City of Greeley will process payment in the amount of R
approximately $24 , 500 . 00 to the County for the asphalt
repair and overlay administered by the County on the street Pd o

o v AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF GREELEY ,
,-., p COLORADO, TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH WELD
0 COUNTY, COLORADO, FOR THE ASPHALT OVERLAY PROGRAM.

o w BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY, COLORADO:

o x Section 1 . The Greeley City Charter , Section 3-7 , permits
q the City Council , by ordinance , to enter into contracts and
a cooperative or joint activities with other governmental bodies
wand that C .R .S .., 29-1-201 , et seq. , articulates a state policy
w x encouraging governmental cooperation .

Section 2. An agreement has been reached between the City
z and Weld County to have the County overlay certain City roadways
" I adjacent to County roadways. The cost of the program would be
m0 included in the 1992 Food Tax Program surplus or the 1993 Food
r-• z Tax Program. There are no administrative or engineering costs
Z w involved .

o a Section 3. The City of Greeley desires to enter into such
O ] an Intergovernmental Agreement for the purposes named in said
N w agreement .

Section 4 . It is in the best interests of the City of
" 4 Greeley to enter into said Intergovernmental Agreement .

w Section 5 . The City of Greeley authorizes the Mayor to
enter into the Intergovernmental Agreement according to the terms
d' of the agreement described in Attachment "A" .

'-; '-i Section 6. This ordinance shall become effective five (5)
M54 days after its final publication , as provided by the Greeley
Municipal Charter .
