RE: SETTING ORDER OF BALLOT FOR SPECIAL ELECTION OF MARCH 20 ,
1990
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a number of measures have been proposed for
placement on the ballot for special election which the Board has
called for March 20 , 1990 , and
WHEREAS, the Board must set the ballot for the election.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the ballot for the
special election of March 20 , 1990 , shall be set as follows:
County Initiated Measure
Ballot Issue No. 1
Shall a countywide sales and use tax of Weld County, Colorado, at
the rate of one percent (1%) , be levied and imposed for the
purpose of reducing the ad valorem property tax mill levy
equivalent to the net amount collected in accordance with the
proposal and resolution of the Weld County Board of County
Commissioners?
Citizen Initiated Measure
Ballot Issue No. 2
Shall there be an ordinance: (1) Requiring that all swine
production facilities in the County designed to hold more than
25 , 000 animals at one time provide secondary treatment and
disinfection of all effluent, and provide stabilization of all
solid waste, prior to discharging any such effluent or solid waste
onto the land; (2) Requiring that such facilities only apply
effluent and solid waste to the land at a rate and in a manner
which does not pollute ground and surface water; and (3)
Authorizing that County officials and residents can enforce the
ordinance?

County Initiated Charter Amendments
Ballot Issue No. 3
Shall Sections 3-7 and 3-11 (2) and 3-14 (7) of Article III, Section
6-1 of Article VI, and Section 8-2 (3) and (5) of Article VIII of
the Home Rule Charter for Weld County, Colorado, be amended so as
to provide that the Clerk to the Board will be under the direction
of the Board of County Commissioners and not the County Clerk and
Recorder, effective July 1 , 1990?
Ballot Issue No. 4
Shall Section 5-2 of Article V of the Home Rule Charter for Weld
County, Colorado, be amended to provide that the County Attorney
be an attorney licensed by the State of Colorado and not for the
State of Colorado?
Ballot Issue No. 5
Shall Section 6-3 of Article VI of the Home Rule Charter for Weld
County, Colorado, be amended to provide that vacancies in elective
offices (except for County Commissioner and County Council) shall
be filled not filed by the Board of County Commissioners?
Ballot Issue No. 6
Shall Section 11-3 of Article XI of the Home Rule Charter for Weld
County, Colorado, be amended to delete reference in the
qualifications of the Chief Deputy to the County Treasurer to a
minimum period of experience?
Ballot Issue No. 7
Shall Section 13-8 (4) of Article XIII of the Home Rule Charter for
Weld County, Colorado, be repealed to delete the County Council ' s
authority to suspend an officer during the pendency of a recall?
Ballot Issue No. 8
Shall Section 13-8 (5) of Article XIII of the Home Rule Charter for
Weld County, Colorado, be amended to delete the authority of the
County Council to suspend elected officials formally charged or
indicted of a crime pending prosecution for the offense?

Ballot Issue No. 9
Shall Section 13-9 subsections (2) , (4) , (6) , (8) and (9) of
Article XIII of the Home Rule Charter for Weld County, Colorado,
be amended to require extending the time frame prior to the date
of election for circulating, amending, filing, withdrawing, and
objecting to nomination petitions for County Councilmen?
Ballot Issue No. 10
Shall the definition contained in Section 16-10 (30) Of Article XVI
of the Home Rule Charter for Weld County, Colorado, be amended to
specify that "qualified electors" must be registered to vote in
Weld County, Colorado?
Citizen Initiated Charter Amendment
Ballot Issue No. 11
Union Recognition and Negotiation
Immediately upon adoption of this amendment, Section 4-2 (B) of the
Weld County Home Rule Charter, which concerns the Division of
Personnel and personnel practices, shall be repealed and the
provisions thereof nullified; the Board of County Commissioners
shall recognize the Communications Workers of America (CWA) as the
sole and legal bargaining agent for all non-managerial employees
of Weld County government; the Weld County Board of Commissioners,
or their designees, shall, within sixty (60) days of passage of
this amendment and every three years thereafter, enter into good
faith contractual negotiations with CWA with regards to wages,
benefits, and working conditions; and, in the event that an
impasse is reached in any contract negotiations with CWA, CWA ' s
final bargaining offer shall be submitted to the voters of Weld
County for their approval in a special election to be held within
sixty (60) days of the date that an impasse is declared by either
party to contract negotiations in a written statement to the Weld
County Clerk and Recorder.
BE IT FURTHER RESOLVED by the Board that the conduct of the
election shall be in accordance with the Colorado Election Code of
1980 , as amended, as applicable.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
