RE: APPROVE AGREEMENT FOR THE TEMPORARY HOUSING OF YOUTH AND AUTHORIZE
CHAIRMAN TO SIGN - ALTERNATIVE HOMES FOR YOUTH
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for the temporary
housing of youth between the County of Weld and Alternative Homes for Youth,
commencing November 1, 1992, and ending October 31, 1993, with the further terms
and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for the temporary housing of youth between
the County of Weld and Alternative Homes for Youth be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 28th day of September, A.D. , 1992.

AGREEMENT j
THIS AGREEMENT, made and entered into this c7j� day of )2:! j
1992, by and between the County of Weld, the State of Colorado, by and through
the Board of County Commissioners of Weld County, whose address is 915 10th
Street, Greeley, Colorado 80631, hereinafter referred to as "County", and
Alternative Homes for Youth, a Colorado non-profit corporation, whose current
address is 3000 Youngfield Street, Suite 157, Lakewood, Colorado 80215,
hereinafter referred to as "AHFY".
WITNESSETH:
WHEREAS, County currently operates a Youth Shelter for the temporary
housing of youth for the benefit of Social Services and the Courts, and
WHEREAS, County wishes to contract out said services to AHFY for program
enhancements for the youth in need, and
WHEREAS, AHFY provides similar services in the State of Colorado.
NOW, THEREFORE, in consideration of the mutual promises and covenants
contained herein, the parties hereto expressly agree upon:
1. TERM: Initial term of this Agreement is from November 1, 1992 to
October 31, 1993. Unless one or both parties have given notice to
one or the other no later than July 1, 1993, to the effect that the
Agreement will be terminated as of October 31, 1993, the Agreement's
term will automatically be renewed for an additional one-year term,
upon the same provisions as this Agreement, and the Agreement will
be extended for additional one year renewal terms thereafter in the
absence of a similar notice by either party to the other declaring
the termination of the Agreement as of the end of the current
renewal year. If AHFY violates the terms of this Agreement, the
County may thereafter serve to AHFY written notice specifying the
violation and allowing AHFY 30 days to correct the violation. If
AHFY fails to correct the violation within said 30 day period,
county may thereafter terminate the Agreement at any time upon 20-
days written notice to AHFY.
2. LICENSURE: Alternative Homes for Youth (AHFY) will obtain licensure
from the Colorado Department of Social Services as a Specialized
Group Center or a Residential Child Care Facility with a licensed
capacity of 12 youth or 12 plus 1 youth if possible. Licensure will
be maintained in good standing and in compliance with the Colorado
Department of Social Services' rules and regulations.
3. STAFF: AHFY will provide between ten and eleven FTE staff as
determined by program needs and state rate setting procedures. This
will include overnight awake staff and night on-call staff. Current

staff will receive priority for hiring for all positions based on
qualification requirements and current positions.
4. PROGRAM: The program will be designed to empower youth and parents;
be culturally responsive; provide instruction in decision making,
refusal, and living skills; promote the recognition of feeling
and/or behaviors that are useful or problematic; and assist with the
youth's preparation to return home or enter placement. Recreational
activities will be provided in the community. AHFY will maintain
intake accessibility 24 hours a day, seven days per week.
Cooperation with and facilitation of referring and outside agency
(Mental Health, Probation, School District) involvement will be a
major goal and evaluation criteria.
5. CLIENT ASSESSMENT/DOCUMENTATION: When appropriate, AHFY will
provide assessments that may include but not be limited to
Personality Inventory (PIC) , Roberts Apperception Test for Children
(RATC) , Tennessee Self-Concept Scale (TSCS) , Personal Experience
Screening Questionnaire (PESQ) for chemical dependency and Pre-
employment Skill Development with the California Psychological
Inventory, Revised.
Daily and monthly behavioral and adjustment documentation will be
maintained to evaluate adjustment and progress on goals during
placement. Reports to the referring agency will be completed
monthly.
6. QUALITY ASSURANCE: AHFY will develop specific quality assurance
standards with input from the Weld County Department of Social
Services and will make quarterly reports available to the
department.
7. GUARANTEE: County will guarantee ten FTE placements based on semi-
annual average. AHFY will guarantee placement availability for
twelve youth and will attempt to accommodate additional Weld County
shelter care youth at their other facilities based on space
availability and appropriateness of placement. AHFY will make best
effort to maintain ten FTE placements.
8. FACILITY REMODEL: County will remodel at it's expense the facility
located at 1709 7th Avenue, and bring all systems into compliance
with building codes based on mutually agreed upon plans.
9. LEASE: County will lease the facility at 1709 7th Avenue in
accordance p with the Jease Agree°�ent entered into by both parties on
the ,„?`?"8 day of Q%[jn/ rld , 1992. This Agreement shall be
conditional upon said lease. In the event of cancellation of the

lease by either party, this Agreement shall be null and void
concurrently unless this Agreement is amended in writing otherwise.
10. INDEMNIFICATION: AHFY covenants and agrees that it will indemnify
and save harmless County from all demands, claims, costs, causes of
action, debts, attorney fees or judgments and from all expenses that
may be incurred in investigating or resisting the same arising from
or growing out of any act or neglect of AHFY, its contractors,
agents, employees, invitees, servants, subtenants, successors, or
assigns in connection with this Agreement or their occupancy of any
portion of the leased premises.
11. LIABILITY INSURANCE: AHFY shall keep in full force and effect
throughout the initial term of the Agreement and throughout every
renewal term a policy of liability insurance, naming the Lessor as
an additional named insured. The coverage shall be no less than
$500,000.00 for any claim.
12. NONDISCRIMINATION: AHFY covenants that it will not discriminate
upon the basis of race, color, religion, sex, national origin, or
handicap in the provision of services under this Agreement. The
County, the State of Colorado, and the United States shall be
considered beneficiaries of an entitled to enforce this covenant.
13. MISCELLANEOUS:
A. Time is of the essence in all provisions of this Agreement.
B. Colorado law will be referred in the interpretation and
construction of the Agreement and the resolution of all
disputes hereunder.
C. This Agreement is binding upon and will inure to the benefit
of the parties hereto, their successors and assigns.
D. The provisions of this Agreement may be amended only in
writing signed by both parties.
E. Any dispute, controversy, or claim arising out of relating to
this Agreement or the breech of this Agreement shall be
settled by arbitration by the American Arbitration
Association. The loser of said arbitration shall pay all
costs associated with the arbitration.
F. Any notice permitted or required by this Agreement can be
given by personal service of a written notice upon the party
to whom the notice is given, or by mailing the written notice
by certified mail, postage prepaid, return receipt requested,
to the party. Any mailing must be to the following addresses
(which can be changed if written notice of the change is given
to the other party) :

G. If any paragraph, sentence, clause, or phrase of this
Agreement is for any reason held or decided to be invalid or
unconstitutional, such decisions shall not change the validity
of the remaining portions. Parties hereto hereby declare that
they would have entered into this Agreement irrespective of
the fact that any one or more paragraphs, sentences, clauses,
or phrases might be declared to be unconstitutional or
invalid.
