HomeMy WebLinkAbout910180.tiff RESOLUTION RE: DENY SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR THE EXPANSION OF A NONCONFORMING USE TO INCLUDE AUTO RESTORATION AND OUTSIDE STORAGE - ROY BOLES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day March, 1991, at the hour of 10:00 a.m. , in the Chambers of the Board for the purpose of hearing the application of Roy Boles, 1160 Van Gordon, Golden, Colorado 80401, for a Site Specific Development Plan and Special Review Permit for the expansion of a nonconforming use to include auto restoration and outside storage on the following described real estate, to-wit: Part of the NW/4 NW/4, Section 21, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Roy Boles, said applicant, was present and represented by Norma Boles, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is not consistent with the Weld County Comprehensive Plan. b. The proposal is not consistent with the intent of the district in which the use is located because it is primarily agricultural. c. The uses which would be permitted would not be compatible with the existing surrounding land uses. d. The uses which would be permitted would not be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County or the adopted master plans of affected municipalities. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for the expansion of a nonconforming use to include auto restoration and outside storage on the hereinabove described parcel of land be, and hereby is, denied. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated February 11, 1991, and duly published February 21, 1991, in The New News, a public hearing was conducted to consider the request of Roy Boles for the expansion of a nonconforming use to include auto restoration and outside storage. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Grubb, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Norma Boles represented the applicant and stated they were agreeable to this. Ms. Boles said the uses would include car restoration and marine salvage. Ms. Boles answered questions of the Board concerning screening. Mr. Morrison stated that Development Standard 115 addresses the maintenance of the screening. Ms. Boles answered further questions of the Board concerning traffic and the number of cars to be stored on the site. Chairman Lacy stated that letters of opposition were received from Schaefer Homes, Inc. , and Leo and Margaret Bissell. Harlan Gartrell, Donna Hotchkiss, Walt Dittmer, Marilyn Trautman, Joe Rautzon, Ron Tigg, Loren Trautman, (Tape 1191-06) Lawrence Schoen, Iva Lee McAlmond, and Neil Putnam, all surrounding landowners, spoke in opposition of said request. Ms. Trautman also submitted a petition as Exhibit J and information regarding oil as Exhibit K for the record. Florence Griffin, current owner of property for proposed use, spoke in favor of said request. Ms. Boles gave her rebuttal to the opposition of the above listed people and answered questions of the Board. Let the record reflect that a recess was taken at this time until 1:00 p.m. Roy Boles, Jr. , applicant, gave the definition of muscle cars, which is what they restore. He said they are cars ranging from years 1968 to 1973, with large engines. After further discussion, Mr. Grubb read the amendments to Development Standards #4 and 118 into the record concerning the number of, and sizes of, vehicles and boats to be stored on site, and the gravel specifications. Commissioner Webster questioned within what distance the petitioners are from the site. Ms. Trautman said they were all within one to two miles of the site. Commissioner Kennedy moved to deny the request of Roy Boles for a Site Specific Development Plan and Special Review Permit for the expansion of a nonconforming use to include auto restoration and outside storage. Commissioner Harbert seconded the motion. Commissioner Kennedy stated his reasons for his motion. Chairman Lacy said he would vote against the motion and stated his reasons. We feel that an increase of traffic on our already heavy traveled dirt roads would only mean quicker deterioration plus an additional dust hazard to this area. Dear Commissioners: Please read the following into the minutes of the above noted public hearing. As an effected property owner, I do not object to the use of this site for "auto restoration" if this means automobile repair. Nor do I object to the outside storage of automobiles under repair. However, the enclosed notice does not define "outside storage" and I do strongly object to outside storage if this term means and includes an automobile junkyard. To clarify this, I would suggest to the commissioners that any outside storage in connection with auto restoration be limited to a period of 30 days per automobile. If this site is not to be used for automobile repair but is merely a ruse to create an automobile junkyard, I strongly oppose the approval as it will seriously damage my property and the property of others in the vicinity. The Ditch Company has reviewed the attached map and legal description contained in the information furnished the Ditch Company, but is not able to pinpoint the exact location of the proposed use as it relates to the irrigation ditch of Fulton. One of the requirements imposed by the County would be complete fencing of the proposed use. If such land area on which the proposed expanded use is to take place is adjacent to the Fulton Ditch, the Ditch Company would request sufficient set back of any required fences to permit the Ditch Company to continue maintenance and operation of its irrigation ditch. Also, the Ditch Company is concerned about the restoration and containment of oil, antifreeze and other like materials. We do understand that one of the requirements imposed by the County is that all such materials be placed in containers; however, it is highly likely that there will be spills of antifreeze and other type of degreasers utilized in connection with the proposed expanded use. The land in the proposed general location slopes toward the ditch so any surface spills could eventually contaminate the irrigation ditch of Fulton. LEGAL DESCRIPTION: Part of the NWI NW} of Section 21, T1N, R66W of the 6th P.M., Weld County, Colorado. . LOCATION: Approximately 2 miles southeast of the City of Ft. Lupton; at the southeast corner of Weld County Road 8 and Weld County Road 29. Mrs. Roy Boles, Jr. , applicant, submitted a request to conduct an auto restoration business and outside storage on property they are purchasing. The reason for this request is to enable them to live and work on the premises. The property has a part-time shop in existence and they need more outside storage. The Boles restore 1968-1972 automobiles, known as "muscle cars" . They need allotted space for the "donor parts", parts they remove while work is in progress. They plan to enclose this proposed storage area and will be distributing any waste accordingly. They also salvage old boat motors, which requires inside storage. Eighty-five percent of sales are out of state. Types of shipping include United Parcel Service and freight, 91.0180 WELD COUNTY PLANNING COMMISSION SUMMARY ❑SR-929 Page 2 which limits traffic to and from the property. Boat work is extremely seasonal, running from late March until September. The chairman called for questions from the board. Ann Garrison wanted to know what was done to the boats. Mrs. Boles replied that they do not accept the boats unless resale value is good. Tf they have to be stored on the property it is not for more than one summer season. Normally they accept only the broken boat motors for service. The marinas will no longer service the older boat motors and they are one of the few companies in the Denver area that deals with older boat motor parts. Jean Hoffman asked if this was considered a form of recycling. Mrs. Boles acknowledged that it was definitely recycling of both the boat motors and the cars. Ann Garrison wanted to know if what they were shipping by UPS was, in fact, car and boat parts. Mrs. Boles answered yes. Bud Clemons asked how they disposed of the residual, to include the car bodies and frames. Mrs. Boles explained that the residual is very limited because most of the cars have been sitting for so long. What they do have for disposal in oil, antifreeze, or waste is picked up by a chemical company on a monthly basis. The car bodies and frames are taken to the crusher, and counted as extra income. Judy Yamaguchi asked how long they have been running this particular business. Mrs. Boles replied that she has been involved for about 3} years. Her husband and father-in-law have been working at it for 20 years. Jean Hoffman wanted to know if they hold a contract for the parcel of land. Mrs. Boles explained that it was contingent on the outcome of the zoning. Bud Clemons stated that he had not seen any documentation requesting an extension. Brian Grubb acknowledged that the property was zoned agricultural. Richard Kimmel wanted to know if the existing storage area is fenced. Mrs. Boles explained that the storage area is enclosed with small plywood fencing. The Chairman called for discussion from the audience. Royal Griffin is a neighbor whose property adjoins the Boles and he wanted to know exactly where, on the property, the Poles planned to store the cars. Mrs. Boles replied that they are planning storage space on a small 6 acre parcel around the house, and extend it as required, not to exceed 10 acres. Bud Clemons requested that the staff read its recommendation. Brian Grubb read the recommendation to the Commission. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. 4. Prior to recording the special review permit plat, the performance guarantee to ensure installation and completion of the phase one screening plan shall be filed with the Clerk to the Board for the approved amount. The guarantee shall be returned to the applicants or released after the improvements have been satisfactorily completed. If the improvements have not been completed within 120 days of the date of approval of the Special Review permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. 5. All materials including waste shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11. An employee bathroom with toilet facilities served by a sewage disposal system is required for the proposed facility, if an employee works an 8 hour shift and does not reside on the property. Lupton; at the southeast corner of the intersection of Weld County Road 8 and Weld County Road 29 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1 . The submitted materials are in compliance with the application requirements of Section 24,7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposed Special Review Permit area is located within the Urban Growth Boundary Areas of the Cities of Fort Lupton and Brighton. The City of Fort Lupton has reviewed this proposal and found no conflict with its' interests. The City of Brighton recommended denial and outlined several concerns regarding this proposal. These concerns have been addressed in the conditions of approval and development standards. The proposed use is consistent with the intent of the A (Agricultural) Zone district and is provided for as a Use by Special Review. The uses permitted will be compatible with existing surrounding land-uses which include: irrigated agricultural production, a dairy and rural residences. It is the opinion of the Department of Planning Services' staff that the conditions of approval and development standards will make this use compatible with the future land use of the area. No overlay districts affect the site. 9101.80 J Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to scheduling this request before the Board of County Commissioners: (a) a screening plan for phases one and two of the equipment storage area shall be submitted to the Department of Planning Services for review and approval. The screening plan shall include a proposal for landscaping. The approved plan shall be incorporated into the application materials and shown on the special review plat map. (b) the applicants shall submit an estimate of costs for phase one of the screening plan and a proposal for a performance guarantee as allowed in the Weld County Zoning Ordinance under Section 24.4.3. The estimated amount and performance guarantee shall be reviewed and approved by the Board of County Commissioners. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. 4. Prior to recording the special review permit plat, the performance guarantee to ensure installation and completion of the phase one screening plan shall be filed with the Clerk to the Board for the approved amount. The guarantee shall be returned to the applicants or released after the improvements have been satisfactorily completed. If the improvements have not been completed within 120 days of the date of approval of the Special Review permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. 5. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S., as amended. 3. The Use by Special Review permit shall not be transferable to any successors in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 4. All vehicles being restored, vehicles used for parts, and equipment associated with the operation of the business shall be screened , by the approved screening plan, from all adjacent properties and public rights-of-way. 5. The screening and landscaping shall be maintained in a manner consistent with the approved screening plan. 6. Waste oil, waste paints, stains, treatments, anti-feeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7. Any required Emissions Permit shall be obtained from the air Pollution Control. Division, Colorado Department of Health. S. All materials including waste shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11. An employee bathroom with toilet facilities served by a sewage disposal system is required for the proposed facility, if an employee works an 8 hour shift and does not reside on the property. Range 66 West Dear Brian: Please be advised that the City of Brighton Planning Division has some concerns about this expanding specific non-conforming use in a predominantly Agricultural area. The proposed use is within the City of Brighton future growth area along the US 85 corridor. This entire area is designated as a residential/open space area with industrial development occurring immediately adjacent to the highway and railroad. The City of Brighton's Comprehensive Land Use Plan calls for the strategic location of Neighborhood Activity Centers (NACs) to be developed at the intersection of arterials and collector streets to serve the consumer demands from adjacent residential development. These centers are to be "limited in size in order to protect the residential neighborhoods from traffic, noise and fumes". associated with heavier volumes related with commercial usages. The size and location of this use is not conducive with City policies concerning such Neighborhood Activity Centers, due to the premature nature of this development proposal . This use is not compatible with the surrounding area, which is almost exclusively agricultural . Additionally. it is a City Land Use Policy, as stated in the Comprehensive Plan, to restrict infill or replacement development to land uses which demonstrate compatibility with and sensitivity to existing neighborhoods, in terms of use, quality, density, building height, placement, scale, landscaping and architectural character. The present condition of this site, as viewed by staff in field surveys, does not demonstrate any compatibility with or sensitivity to the existing neighborhood. Staff observed some "junk" automobiles, several trailers, and various car parts. If, this operation were to exhibit any growth at all , it would adversely affect the quality of life for the adjacent rural development. 91®180 22 South 4th Avenue - Brighton, Colorado 80601 - [303] 659-4050 Finally, it is staff opinion that the present applicant is only pursuing this special use designation in order to take advantage of depressed land values in the area to keep overhead costs on this business down. Locating this type of an expanded business in an agricultural area on "gravel roads" would be an extremely bad case of spot zoning and misplaced development. The amount and type of traffic generated by this expanded use of the property would result in rapid deterioration of the roads, extensive dust and particulate dispersal , and increased hazard potential for the local neighbors. Furthermore, the property is traversed by the Fulton Ditch and the applicant does not address any potential for water contamination or safeguards against that potentiality. (h)Cylinders,valves,regulators,hose and other apparatus and fittings contain- ing or using oxygen shall be kept free from oil or grease. Oxygen cylinders, apparatus and fittings shall not be handled with oily hands or gloves or greasy materials. (i)When moving compressed gas cylinders by crane,suitable cradles shall be used in order to reduce the possibility of dropping. (n)When welding or cutting is done above or within 10 feet of combustible construction or material, a fire watch shall be on hand to make use of fire- extinguishing equipment. (o)A fire watch shall be maintained for at least a half hour after completion of cutting or welding operations to detect and extinguish possible smoldering fires. Containers for Calcium Carbide • Sec. 49.108. Containers used for the storage of calcium carbide shall be of metal of sufficient strength to ensure handling without rupture and shall be provided with a screw top or its equivalent. They shall be of watertight con- struction. Solder shall not be used on joints in such a manner that fire would - disrupt the package. Packages shall be marked CALCIUM CARBIDE—DAN- GEROUS IF NOT KEPT DRY.
