RE: ACTION OF BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL
REVIEW PERMIT FOR A PRIVATE MICROWAVE REPEATER STATION IN THE A
(AGRICULTURAL) ZONE DISTRICT -BURLINGTON NORTHERN RAILROAD
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 29th day of September, 1993, at
10:00 a.m. for the purpose of hearing the application of Burlington Northern
Railroad, 176 East 5th Street, St. Paul, Minnesota 55101, for a Site Specific
Development Plan and Special Review Permit for a private microwave repeater
station in the A (Agricultural) Zone District on the following described real
estate, to-wit:
Part of the NE! of Section 27, Township 1
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the applicant was represented by Steve Hudson, and
WHEREAS, after hearing testimony and statements of those present, the Board
deemed it advisable to continue said matter to October 6, 1993, at 10:00 a.m. ,
at the request of a surrounding property owner.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Burlington Northern Railroad for a Site
Specific Development Plan and Special Review Permit for a private microwave
repeater station in the A (Agricultural) Zone District on the above referenced
parcel of land be, and hereby is, continued to October 6, 1993, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 29th day of September, A.D. , 1993.

DISTRICT - BURLINGTON NORTHERN RAILROAD
A public hearing was conducted on September 29, 1993, at 10:00 A.M. , with
the following present:
Commissioner Constance L. Harbert, Chairman
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Shelly Miller
County Attorney, Bruce Barker
Planning Department representative, Greg Thompson
The following business was transacted:
I hereby certify that pursuant to a notice dated August 18, 1993, and duly
published September 16, 1993, in the Windsor Beacon, a public hearing was
conducted to consider the request of Burlington Northern Railroad for a
Site Specific Development Plan and Special Review Permit for a private
microwave repeater station in the A (Agricultural) Zone District. Bruce
Bosshardt, adjacent property owner, said he has a scheduling conflict this
afternoon and requested this matter be continued to next week. He stated
he is against the Special Review Permit. Bruce Barker, County Attorney,
said the Board could continue the matter if good cause is shown or
comments could be submitted in writing, with the decision held until said
comments are received. Mr. Bosshardt indicated he was made aware of this
hearing on the Monday before last. Greg Thompson, Planning Department
representative, stated this request was preadvertised and heard by the
Planning Commission on September 21, 1993. Commissioner Baxter suggested
taking testimony out of order. Mr. Barker said that is an option;
however, the disadvantage to the opposing individuals is they would not
hear the applicant's testimony and would waive their right to respond. In
response to a question from Commissioner Kirkmeyer, Steve Hudson,
representing the applicant, stated there is no objection to continuing
this matter to next week. Commissioner Kirkmeyer moved to continue the
request of Burlington Northern Railroad for a Site Specific Development
Plan and Special Review Permit for a private microwave repeater station in
the A (Agricultural) Zone District to October 6, 1993, at 10:00 a.m. The
motion was seconded by Commissioner Hall, and it carried unanimously.
This Certification was approved on the 4th day of October, 1993.
