I l o - - RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1652 - CITO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1652, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1652 was submitted by Donald and Bonnie Cito, 5050 Weld County Road 50, Loveland, Colorado 80550, for property which is described as Lot B of RE #1061, being located in part of the El of the NW4 of Section 1, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 74 acres and 4 acres. NOW, THEREFORE,:BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1652 submitted by Donald and Bonnie Cito be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit shall be obtained for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by ,he Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 3. Access to Lots A and B shall be by common access to Weld County Road 50. The common access shall be located one-half on Lot A and one- half on Lot B. Prior to recording the plat, the applicant shall show on said plat said common access as an easement to both Lots A and B and shall place on said plat a dedication of said easement using the language found in Section 11.7. 12.5 of the Weld County Subdivision Ordinance. Dear Commissioners: This request for a recorded exemption was submitted by Donald A. and Bonnie B. Cito. The parcel of land on which this request is being made is described as Lot B of RE-1061, located in part of the E'/2 of the NW'/a of Section 1, T4N, R68W of the 6th P.M., Weld County, Colorado. The property is located 11/4 miles east of I-25, south of and adjacent to Weld County Road 50. The parcel of land under consideration is not the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 74 acres and four acres, more or less. Little Thompson Water District is proposed for the water service to both lots with septic being used for sewage disposal. The applicant wishes to retain the larger parcel and give the smaller parcel to a family member. The proposed parcels are currently in farm production, no residences at this time, and both are proposed to access onto Weld County Road 50. The property under consideration is Lot B of RE-1061, which was part of a 160-acre parcel, more or less, that was divided into 80 acre parcels, more or less, by a Quit Claim deed in 1987. The approval of RE-1061 divided the 80-acre parcel into 78 and two acres, more or less. The existing two acre parcel, which is Lot A of RE-1061, lies west of the and north of the subject site, contains a residence, and accesses onto Weld County Road 50. The applicant has not demonstrated that this request is consistent with efficient and orderly development. Splitting land in this manner and creating lineal subdivision with individual accesses onto county roads is clearly not efficient or orderly development. Additionally, the applicant is evading the intent of the recorded exemption application process by creating multiple lots without utilizing the subdivision process. This results in an area of piecemeal type development that emphatically opposes the intent of the A (Agricultural) zone district, the Subdivision Ordinance, and the Weld County Comprehensive Plan.
