RE: APPROVE CHANGE OF SPEED LIMIT TO 45 MILES PER HOUR ON WELD COUNTY ROAD 7
BETWEEN HIGHWAY 52 AND WELD COUNTY ROAD 8
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Weld County Engineering Department has recommended to the
Board that the speed limit on Weld County Road 7 between Highway 52 and Weld
County Road 8 be changed to 45 miles per hour and the proper signs be installed,
and
WHEREAS, the Board has determined that said change in speed limit is
necessary for the protection of the general public.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Department of Engineering be, and hereby is, directed
to install speed limit signs as recommended, to change the speed limit on Weld
County Road 7 between Highway 52 Weld County Road 7 to 45 miles per hour, for the
safety of the general public, and that said signs must conform to the State
manual and specifications.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 28th day of October, A.D. , 1992.

County Commissioners approved resolution to make this a 45 mpd speed zone. No "Children

Brief Description of the problem/issue:
Establishing speed limits is often times a special interest to the Board. This
particular request has some odd twists that should be reviewed prior to being on
the Commissioners Hearing Agenda.
The three mile stretch of WCR 7 between State Hwy 52 and WCR 8 has approximately
25 houses that are spaced far apart within the 3 miles. In 1975 there was a
resolution that established a 35 mph speed zone in front of 5 houses that are
located just south of State Hwy 52. The remainder is unrestricted, leaving the
speed limit at 55 mph.
Our most recent request is to speed zone the rest of the road to 35 mph and place
"Children At Play" signs.
We counted traffic and measured speeds in an effort to determine the 85th
percentile at which the speed limit should be established. They were inconsistent
with 2 indicating 45 mph was correct and 3 indicating 55 mph was correct. Because
there is residential development in the area, and because the road surface is
gravel, it is my judgement the entire 3 miles should be established at 45 mph.
This would have the effect at increasing the speed limit just south of State Hwy
52 but decreasing it south of there.
Because my recommendation is not consistent with the request and also because it
would increase a speed limit, I expect the public reaction to be negative.
Also, I do not recommend the placement of "Children At Play" signs because they
are ineffective and in accordance with the MUTCD, they are to be placed only at
locations such as parks and school yards where children would be concentrated.
This also would have a negative reaction from the residents.
What options exist for the Board? (Include consequences, impacts, costs, etc. of
options) :
1. Leave the speed limits as they exist which are 35 mph and 55 mph.
2. Post the entire stretch at 35 mph as per the request.
3. Post the entire stretch at 45 mph.

• Recommendation to the Board:
I think the existing speed limit of 35 mph is unrealistic and is not being
observed. Lowering the speed limit to 35 mph for the rest of the stretch will
have little or no effect in slowing traffic.
It is my recommendation to post the entire stretch at 45 mph and not to place
"Children at Play" signs.

I would like to share my concern about the speed limit on Weld
County Road 7 between Highway 52 and Weld County Road 8.
As you turn south from highway 52 onto Road 7, there is a 55
mile per hour speed limit. This is a dirt road frequented by
many large trucks. After you cross road 8, there is a 35 mil=
per hour speed 1 imit which continues south to State Highway
including some paved road . To the west, road 5 is paved and
has posted speeds of 35 or 45 miles per hoar from Highways `2
to 7.
We have small grandchildren and neighbor children in this area
and I would like to know what we need to do to have a 35 mile
per hour speed limit posted to help protect them. At the very
least I would request the speed on road 7 between roads 8 and
10 be lowered to 36.
If it is possible could we also have some "Children At Play"
signs between roads 8 and 107 The parents do all they can to
teach the children to stay away from the road and to watch
them, but we all know how quick little ones can be and a gravel
truck doing 55 mile= per hour wouldn' t have any possibility of
stopping quickly to avoid hitting a child.
I hope you share my concern and will let me know what needs to
be done to lower this speed limit.

Traffic Control Devices published the Federal Highway Administration.
Enclosed is a publication by the Colorado Department of Highways titled
"Establishing Realistic Speed Limits" . It does a good job explaining how
and why speed limits are established.
The Weld County Engineering Department made an investigation of Road 7
that included traffic counts, speed data, accident investigation and a
physical inventory. There is no accident experience or hazardous
locations that would require reducing the speed limit. Only two out of
the five speed counts indicated 45 mph is appropriate; however, because
of the gravel surface and the residential development in the area, I
recommended the Board of Weld County Commissioners authorize a speed
reduction to 45 mph. The stretch of Road 7 immediately south of State
Highway 52 is inappropriately speed zoned at 35 mph. This speed zone is
unreasonably low and unenforceable. Therefore, I recommended the
Commissioners increase that zone to 45 mph.

Subject: Speed Limit Reduction
The current speed limit on Weld County Road 7, South of highway
52 is '55' MPH. I am requesting the speed limit be lowered to
a safer more resonable limit.
This road is a dirt, oft times washboarded, (which makes it more
unsafe) road that is in an area of residents with children.
I guess regardless of children, it has numerous houses on it.
Slowing down to make sharp turns into drive ways proves very
hazardous when other cars are coming behind at 55 MPH.
Please respond in writing.

Regarding our conversation on September 3, 1975 regarding
a complaint by the residents residing on County Road Number 7
between State Road 52 and County Road 12.
Upon contacting the residents in this area I feel they do
have a valid complaint of speeders and disregard for school
buses taking on and discharging children.
There are five dwellings in a close area all on the east side
of County Road 7.
I was taken to three different dwellings and was shown where
flying gravel stones had penetrated their windows . One family
was having their evening meal when a stone came thru their window
from a passing motorist .
He had to be speeding because these homes sit approximately 75
to 100 feet off the road right of way. There are numerous
oil trucks utilizing this road for hauling a water mixer to
seal a farmers dike.
In my discussion with these people they are concerned and they
have a friendly attitude .
I feel we should take action to see if we can aid this matter.
RECOMMENDATION:
That we speed zone County Road 7 between Road 12 and State Road
52 to 35 miles per hour. Also (Slow children signs)
See attached diagram for proposal of sign installation .
Request your consideration of this investigation , if approved
that a resolution be adopted.

It is proposed to have a 35 miles per hour speed zone from a
point 100 feet south of State Highway 52 to a point 4400 feet
south of State Highway 52.
Also it is proposed to have a speed zone of 45 miles per hour
from a point 4400 feet south of State Highway 52 to a point
5150 feet south of State Highway 52.
The above is shown on a sketch dated 9/30/75 .

An investigation has been made on County Road 7 between
County Road 12 and Colorado. State. Highway 52. This area
is developing and has many homes on each side of County
Road 7. Several residents in this area have petitioned
that speed zones be established in this area to limit
the speed of the cars on County Road 7.
It is our recommendation that speed limits be established
as shown on the attached sketch.
Will you please prepare the necessary resolution .

RESOLUTION
RE: REGULATION OF SPEED ON COUNTY ROAD #7 BETWEEN
• COLORADO STATE HIGHWAY #52 and BETWEEN COUNTY
ROAD #12,
WHEREAS, a multitude of complaints have been made to the Board
of County Commissioners, Weld County, Colorado, that motor vehicles are
habitually being driven at speeds greater than is reasonable and prudent along
that part of said County Road #7, being in Weld County, from its intersection
with Colorado State Highway #52 on the North and its intersection with County
Road #12 on the South, and all intersections of streets and roads therewith,
and
WHEREAS, said Board is authorized by the statutes of the State of
Colorado to regulate the speed of vehicles, and
WHEREAS, said Board, pursuant to such complaints, has deter-
mined upon the basis of engineering, traffic investigations and a special
speed survey, that any speed along or over said portion of said road or road-
way, and all intersections of other roads therewith, in excess of the following,
to-wit:
SOUTHBOUND TRAFFIC:
From a point 100 feet South of State Highway #52 to a point
4, 400 feet South of said State Highway #52 on County Road
#7-35 miles per hour; and
From a point 4, 450 feet South of said State Highway #52 to a
point 5, 150 feet South of said State Highway #52 on County
Road #7-45 miles per hour;
NORTHBOUND TRAFFIC:
From a point 5, 150 feet South of State Highway #52 to a
point 4, 450 feet South of said State Highway #52 on County
Road #7-45 miles per hour; and
From a point 4, 400 feet South of State Highway #52 to a
point 150 feet South of said State Highway #52 on County
Road #7-35 miles per hour;
is excessive and is greater than is reasonable, safe or prudent under the
conditions that exist.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that no motor vehicle shall be
driven on, over or along any portion, or portions, of said roads or highways,
or at or across, or at the entrance to, any intersection of any other street,
road or highway therewith, at a speed in excess of the following, to-wit:
SOUTHBOUND TRAFFIC:
From a point 100 feet South of State Highway #52 to a point
4, 400 feet South of State Highway #52 on County Road #7-
35 miles per hour; and
From a point 4, 450 feet South of said State Highway #52 to a
point 5, 1.50 feet South of said State Highway #52 on County Road
#7-45 miles per hour;

From a point 5, 150 feet South of State Highway #52 to a
point 4, 450 feet South of said State Highway #52 on County
Road #7-45 miles per hour; and
From a point 4, 400 feet South of State Highway #52 to a

Road #7--35 miles per hour;
and that any speed in excess of the aforementioned speed limits, and the
driving of any vehicles at any speed in excess of said limits, as afore-
mentioned, thereon or thereat, shall be prima facie evidence that said
speed is not reasonable, safe or prudent, and that it is unlawful.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 15th day of October,
