y • • RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1561 - RIDER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1561, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1561 was submitted by James and Sandy Rider for property which is located in part of the NW,' of Section 6, Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 141 acres and 3 acres, more or less. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Any existing septic system which is not currently permitted through the Weld County Health Department will require an ISDS evaluation prior to issuing the required septic permit. 3. An ISDS shall be located at least 100 feet from any well. 4. The plat shall be amended to include a reservation for a 60-foot right-of-way east from the centerline of Weld County Road 1. 5. Prior to recording the plat: A. ISDS permits shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. The parcel of land on which this request is being made is described as part of the northwest quarter of Section 6, T2N, R68W of the 6th P.M. , Weld County, Colorado. The property is located northeast and northwest of the intersection of Weld County Road 1 and Weld County Road 26. The request is to divide a 144 acre parcel into two parcels of 143 and 1 acres, more or less. The applicants wish to create a building site for members of the family who farm the property to the north of Weld County Road 26. Longmont municipal water serves the proposed larger parcel, and a water well is proposed for the smaller parcel. A septic system would provide sewage disposal to the new lot and presently serves the large lot. Staff is concerned about the level of development in the immediate area. Section 6, in which the applicants have property, and Section 31, T3N, R68W, which is directly north of the subject property, have been substantially divided. Section 31 has 13 lots, excluding the Union Reservoir. The lots were created through various means, including 5 recorded exemptions and 2 subdivision exemptions. The reservoir encompasses almost two-thirds of the section. Section 6 has 16 lots excluding the lake, and has had 1 recorded exemption and 1 subdivision exemption filed. The large concentration of lots in the southeast quarter of the section include several lots created prior to the adoption of subdivision regulations. The applicants have indicated that the proposed 1 acre lot will be utilized as a building site for a family member to continue to farm the property. Agricultural policy 7.C. says, "enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the farm. " This proposal qualifies under this stipulation. At the time it was decided that an exemption would be granted and we were given some criteria that had to be met. in the months that foltowud we have worked to get all of these things done. We finally were able to get everything put together and took it up to Greg Thompson of the planning department. After reviewing the mylar, it was discovered that the excmpaon given to Dudley Rider in 1982 had been done incotrectly. As a result of that discovery, our exemption could not he processed. As best as we can understand it,Dudley's exemption was made off of a lot of 141 4\-acres. However, that 141 +\-acres is 2 separate fields of approximately 70 +\- acres with Weld County Road 26 dividing them We would like to receive our exemption to build on the 70 +\-acres on the north side of WCR 26. Dudley's exemption is on the south side of WCR 26. Dudley has filled out an application for an amended exemption. Duting the time that we h;tvo been working on this exemption, we also have drawn up a contract to purchase the 10l we arc exempting. Ed Kanemoto, broker of Prudential L1M Realtors of Longmont has worked with us in putting this contract together. Ed felt that one month would be plenty of time for us to finish the exemption process, as we had everything that we needed according to what had been discussed at the December meeting. We arc scheduled to close on the lot on May 16th. If we do not have our exemption processed before that time, our contract will expire and be void. This will require starting all over again and we would prefer to not have to go through that process again. 'Throughout this whole process we have tried to do everything exactly as we have been requested to do and now we would ask that this problem with the lot be resolved as quickly as possible in order that w':may be able to close on May 16th as planned. Commissioner Hall seconded the motion, and it carried unanimously. CONSIDER SITE APPLICATION FOR IMPROVEMENTS TO EXISTING WASTEWATER TREATMENT FACILITY - TOWN OF WINDSOR: Greg Thompson, Department of Planning Services, read the favorable recommendation of staff and the Planning Commission into the record. Dennis Wagner, Director of Public Works for the Town of Windsor, was present. He explained the request is for improvements to the existing plant, which is an area lagoon system requiring modification due to growth of the town, as well as more stringent environmental standards. There was no public input offered. Commissioner Kirkmeyer moved to approve said site application. Seconded by Commissioner Hall, the motion carried unanimously. CONSIDER RE 111561 - RIDER: Mr. Thompson reviewed the recommendation of staff and explained the property does abut the City of Longmont. He said there are approximately ten accesses between Weld County Roads 1 and 3, and approval of said exemption will add one additional access. Mr. Thompson pointed out proposed Condition of Approval 114, which is in response to the City of Longmont's request for a 60-foot reservation for right-of-way east of the section line on Weld County Road 1. In response to a question from Commissioner Hall, Mr. Thompson explained the effect of RE 11531, which was approved in 1982 and created a one-acre buildable parcel south of Weld County Road 26. As clarification for Commissioner Kirkmeyer, Mr. Thompson tated the request does not create three buildable lots, even though Weld County Road 26 splits the property in half. Bruce Barker, County Attorney, explained the difference is in the manner of conveyance; it all depends upon whether the easement was conveyed as "fee simple", an easement, or right-of-way. James Rider, applicant, explained he is the fourth generation to live on this parcel and approval of the request will allow him to construct a home. He clarified that the access to be used is already an existing farm access; and RE 11531 was obtained by his father, although it has not been used. In response to Commissioner Hall's question regarding the configuration of Lot A, Mr. Rider stated it is because of the location of the field access road, as well as the property sloping to the west at that point. He plans for his home to sit on the crest of that slope. After discussion with Commissioners Kirkmeyer and Webster concerning the configuration of Lot A, Mr. Rider agreed it could be enlarged, reconfigured, and attached to the south and east property lines in some manner. Chairman Harbert mentioned that if Lot A is changed in size, proposed Condition of Approval 05C will need to be amended to reflect the proper size of proposed Lot B. In response to Commissioner Kirkmeyer, Mr. Barker discussed the 60-foot reservation for right-of-way as requested by the City of Longmont. He clarified for Mr. Rider this is just a reservation for right-of-way, it does not give the City of Longmont the right-of-way. If the City needs the right-of- way in the future, it will have to negotiate with the owners for purchase at that time. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to approve RE 01561, with a change in wording for proposed Conditions of Approval 04, 05A, and 05C as stated by Mr. Barker. Seconded by Commissioner Hall, the motion carried unanimously.
