HomeMy WebLinkAbout940163.tiff RESOLUTION RE: APPROVE FLOOD HAZARD DEVELOPMENT PERMIT APPLICATION FOR GEISERT GRAVEL PIT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Flood Hazard Development Permit Application for the Geisert Gravel Pit, with the applicant being the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and WHEREAS, said application concerns property being described as SW* and part of the SE, Section 31, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, after study and review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Flood Hazard Development Permit Application for the Geisert Gravel Pit, with the applicant being the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, be, and hereby is, approved. APPLICATION FEE HEARINGS/MEETINGS Flood Hazard $k65-.00 Permit issued by the ` 1IS-1) 00 Department of Planning Services* *As soon as practicable after a decision has been reached, the Department of Planning Services shall notify the applicant of the action taken on the Flood Hazard Development Permit. AN ADDITIONAL INVESTIGATION FEE SHALL BE ADDED TO THE COST OF THE PERMIT APPLICATION WHEN SPECIFIC LAND, USES , BUILDINGS, MANUFACTURED HOMES, MOBILE HOMES, AND STRUCTURES THAT REQUIRE A PERMIT BY THE ZONING ORDINANCE ARE LOCATED, MOVED, OPERATED, OR CONSTRUCTED PRIOR TO OBTAINING A PERMIT. THE INVESTIGATION FEE SHALL BE 50% OF THE FEE ESTABLISHED BY SEPARATE ACTION BY THE BOARD OF COUNTY COMMISSIONERS FOR LAND-USE APPLICATIONS. THE PAYMENT OF SUCH INVESTIGATION FEE SHALL NOT RELIEVE ANY PERSONS FROM FULLY COMPLYING WITH THE REQUIREMENTS OF THE ZONING ORDINANCE, NOR FROM ANY OTHER PENALTIES . INTENT The purpose of the application is to give the applicant an opportunity to demonstrate through written and graphic information how the proposed building sites, developments and/or structures are safe from flooding if they are to be located within the FW (Floodway) , FP-1 and FP-2 (Floodprone) Districts and that the proposal complies with the Weld County Zoning Ordinance. A completed application form and supporting materials will enable the Planning Staff to process and reach a decision within the time frame established for the Flood Hazard Development Permit process. The applicant shall submit the following: ''1. A total of three packets of the required Flood Hazard Development Permit application materials and map (the original plus two copies) ; ✓2. Flood Hazard Development Permit Certification; and ✓3. Flood Hazard Development Permit application fee. 1 940163 Based upon the number of referral entities, the planning staff may request additional copies of the packets and maps. The Weld County Department of Planning Services shall be responsible for processing a Flood Hazard Development Permit in the unincorporated areas of Weld County in accordance with Section 26 . 3 of the Weld County Zoning Ordinance. APPLICATION REQUIREMENTS The submission requirements are explained in Section 26.5 of the Weld County Zoning Ordinance. The following items shall be submitted with an application for a Flood Hazard Development Permit: ✓ 1. A completed application form (form attached) . ✓2. Explanation of how the standards of Section 26.4 of the Weld County Zoning Ordinance have been or will be met. These standards are listed on page 3 of this guide. / 3. A Flood Hazard Development Permit map shall be submitted as part of the application requirements. The map shall be drawn and certified by a registered professional engineer and shall meet the following specifications and show the following information: ✓ 0. - Dimensions shall be a minimum of eight and one-half (81) inches wide by eleven (11) inches high or another suitable size when approved by the Department of Planning Services. ✓ S - The name and address of the property owner. J t - A legal description which describes the Section, Township and Range of the property under consideration. ✓ - A scale and a north arrow. v 2 - Existing ground elevations, above mean sea level, at the building site. - Water surface elevations of the Intermediate Regional Flood at the building site. - The boundaries of the FP-1, FP-2 ood rone Fl( p ) or FW (Floodway) districts on the property. The boundary of the FW (Floodway) District need be shown only if the information is available on the Official Weld County Flood Hazard Overlay District Zoning Maps . v k - The location, shape, exterior dimensions, and distance from lot or property lines of each existing or proposed structure. 1 ' - The proposed vehicular access to the property. 2 J - Any fill, sturage of materials , and drainage facilities located on the property. V 4. Copy of the deed or legal instrument by which the applicant obtained and interest in the property. 7 5. Flood Hazard Development Permit Certification. 6. Any other relevant information which may be required by the Department of Planning Services . FLOODPLAIN MANAGEMENT STANDARDS The Department of Planning Services shall not issue a Flood Hazard Development Permit until it has been determined that all applicable standards specified in Section 26.4 of the Weld County Zoning Ordinance have been met by the applicant. The following floodplain management standards apply: 1. The applicant has met all applicable conditions listed in Section 53.6 or 53.7 of the Weld County Zoning Ordinance. 2. If a structure is to be elevated in order to meet the floodproofing requirements, the property owner shall certify that the lowest floor is elevated (for existing structures which are being substantially improved) or will be built (for new structures) to the level, or above, of the regulatory flood datum. The certificate shall include the elevation of the ground and the existing (for substantially improved structures) or proposed (for new structures) elevation of the lowest floor of the structure. The ground elevation and elevation of the lowest floor of any existing structure shall be certified to be accurate by a licensed surveyor or registered engineer. The regulatory flood datum is identified as being one foot above the water surface elevation of an intermediate regional flood. 3. A registered professional engineer shall certify that all structures which are not elevated in order to be floodproofed are designed so the structure is watertight below the elevation of the regulatory flood datum and that the structures are designed to be capable of resisting the hydrostatic and hydrodynamic forces expected at the building site during an intermediate regional flood. The certification shall include the elevation above Mean Sea Level of the regulatory flood datum at the building site and the proposed elevation of the lowest floor of the structure. 4. A registered professional engineer shall certify that all new or replacement domestic water wells or water supply, treatment.,. or storage systems are designed to prevent inundation or infiltration of floodwater into such system by an intermediate regional flood. 5. A registered professional engineer shall certify that all new or replacement sanitary sewer treatment systems, including individual sewage disposal systems, are designed to prevent inundation or infiltration of floodwater into such system and to prevent discharges from such systems into the floodwaters of an intermediate regional flood. >lc 6. No encroachments, including fill, new construction, substantial improvements, and other development shall be permitted unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of an intermediate regional flood. 3 9401{; 7. If the proposed use or structure is to be located in the FW (Floodway) District, a registered professional engineer shall certify that the proposed use or structure, when built, will not limit or restrict the flow capacity of the floodway. X 8. If fill material is to be used in the FP-1 or FP-2 (Floodprone) Districts , a registered professional engineer shall certify that the FILL material is designed to withstand the erosional forces associated with an intermediate regional flood. ALTERATION OR RELOCATION OF A WATER COURSE Any use or development which causes or results in an alteration or relocation of a water course shall comply with the requirements listed below. If the use or development does not include any new construction or substantial improvement of structures and it only includes the alteration or relocation of a watercourse compliance with the following standards is the only requirement which needs to be met before the Department of Planning Services may issue a Flood Hazard Overlay District Development Permit. The applicant shall provide evidence that: 1. Municipalities within a three mile radius of the proposed alteration or relocation have been notified in writing of the proposed alteration or relocation. 2. The Colorado Water Conservation Board has been notified in writing of the proposed alteration or relocation. 3. The office of Insurance and Mitigation of the Federal Emergency Management Agency has been notified in writing of the proposed alteration or relocation. 4. A registered professional engineer shall certify that the flood carrying capacity within the altered or relocated portion of the watercourse will remain the same after the alteration or relocation as existed prior to the alteration or relocation. The certification shall also provide evidence which substantiates that the alteration or relocation shall not adversely affect landowners upstream or downstream from the alteration or relocation. IMPORTANT NOTICE When an applicant has obtained approval of a Flood Hazard Development permit and has been issued a building permit for new construction or substantial improvement to existing structures in the Flood Hazard Overlay District, an elevation or floodproofing certificate is required to be certified by a registered professional engineer, architect, or surveyor after construction. This certificate is required to be completed and submitted to the Building Inspection Department prior to approval of the final inspection of the building permit. 4 940163 FLOOD HAZARD DEVELOPMENT PERMIT PROCEDURAL GUIDE INTENT Application shall submit the following: 1.
