ORDINANCE NO. 119-L
IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 119, WELD COUNTY BUILDING CODE
ORDINANCE, AS CURRENTLY AMENDED, REVISING CERTAIN PROCEDURES, TERMS, AND
REQUIREMENTS
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE
OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is
vested with the authority of administering the affairs of Weld County, Colorado,
and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has
adopted Ordinance No. 119, Weld County Building Code Ordinance, establishing a
comprehensive revision of the building code requirements for unincorporated areas
of the County of Weld, and has adopted amendments in Ordinance No. 119-A through
119-K, and
WHEREAS, said Ordinance No. 119, as amended, is in need of revision and
clarification with regard to procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld
County, Colorado, that certain existing sections of said Ordinance No. 119, as
amended, are amended by the addition and revision of various sections, which
shall read as follows:
Amend Section 20. 13.2. 11 by adding "as determined by the Weld County
Health Department" to the end of the existing text.
Amend Section 30. 1.3 to read: Fences.
Add a new Section 30. 1. 1.13 to read: Re-roofing of single family
dwellings and noncommercial detached accessory structures.
Add a new Section 30.1. 14 to read: Residing of structures.
Add a new Section 30. 1. 15 to read: Replacement of existing gas
water heaters.
BE IT FURTHER ORDAINED, that the effective date of this Ordinance shall be
in accordance with Article III, Section 3-14(2) , of the Weld County Home Rule
Charter, but further, that as of April 1, 1993, the failure to obtain a building
permit for construction of any fence, re-roofing of any single family dwelling
or noncommercial detached accessory structure, residing of structures, or
replacement of existing gas water heaters shall not be considered a violation of
this Ordinance.

BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided
to be unconstitutional, such decision shall not affect the validity of the
remaining portions hereof. The Board of County Commissioners hereby declares
that it would have enacted this Ordinance in each and every section, subsection,
paragraph, sentence, clause, and phrase thereof irrespective of the fact that
anyone or more sections, subsections, paragraphs, sentences, clauses, or phrases
might be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 119-L was, on motion duly made and
seconded, adopted by the following vote on the 28th day of June, A.D. , 1993.

NOTICE OF PUBLIC HEARING
Docket #93-26
The Board of County Commissioners of Weld County, Colorado, will conduct a public
hearing at 9:00 A.M. , on Wednesday, May 26, 1993, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, Weld County Centennial Center,
915 10th Street, First Floor, Greeley, Colorado, for the purpose of considering
amendments to Sections 20 and 30 of the Weld County Building Code Ordinance.
The proposed amendments will clarify the responsibilities of the Weld County
Health Department in determining inadequate sanitation in substandard buildings.
The proposed amendments will delete the permit requirements for the reroofing of
single family dwellings and noncommercial detached accessory structures, residing
of structures, replacement of existing gas water heaters, and fences.
All persons in any manner interested in the proposed amendments to the Weld
County Building Code Ordinance are requested to attend and be heard.
Materials pertaining to the proposed amendments are available for public
inspection in the office of the Clerk to the Board of County Commissioners,
located in Weld County Centennial Center, 915 Tenth Street, Third Floor, Greeley,
Colorado, Monday through Friday, 8:00 A.M. to 5:00 P.M.

Bill O'Hare moved Case Number Amended USR-248, Varra Companies, Inc. , be
continued indefinitely, based on the recommendation of the Department of Planning
Services' staff, to allow time for the applicant to address the concerns of the
State of Colorado, Division of Water Resources, St. Vrain and Left Hand Water
Conservancy District, and Central Colorado Water Conservancy District. Bud
Clemons seconded the motion.
The Chairperson asked the secretary to poll the members of the Planning
Commission for their decision. Bill O'Hare - yes; Judy Yamaguchi - yes; Juliette
Kroekel - yes; Shirley Camenisch - yes; Bud Clemons - yes; Motion carried
unanimously.
Consider proposed amendments to Sections 20 and 30 of the Weld County Building
Code Ordinance.
Lanell Adler explained these amendments will delete the necessity for building
permits for fences, the re-roofing of single family dwellings and noncommercial
detached accessory structures, residing of structures, and replacement of
existing gas water heaters. They will also help clarify the Health Department' s
responsibility for connection of required sewage disposal systems.
The Chairperson asked if there was anyone in the audience who wished to speak for
or against this application.
Bud Clemons moved for forward proposed amendments to Sections 20 and 30 of the
Weld County Building Code Ordinance to the Board of County Commissioners with the
Planning Commission's recommendation for approval. Bill O'Hare seconded the
motion.

Moved by Bud Clemons that the following resolution be introduced for passage by
the Weld County Planning Commission. Be it resolved by the Weld County Planning
Commission the proposed amendments to Sections 20 and 30 of the Weld County
Building Code Ordinance be approved.
The Weld County Building Trades Advisory Committee reviewed the proposed
amendments and recommended approval.
