RE; APPROVE AMENDMENT TO INTERGOVERNMENTAL AGREEMENT AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 11, 1993, the Board approved an
Intergovernmental Agreement for Administration of City of Greeley Municipal Court
Approved Public Service between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Useful
Public Service Program, and the City of Greeley, Colorado, and
WHEREAS, an amendment to said agreement has been presented to the Board,
with terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said
amendment, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Amendment to Intergovernmental Agreement for
Administration of City of Greeley Municipal Court Approved Public Service between
the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Useful Public Service Program, and
the City of Greeley, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 14th day of March, A.D. , 1994.

AMENDMENT TO INTERGOVERNMENTAL AGREEMENT
FOR
ADMINISTRATION OF CITY OF GREELEY
MUNICIPAL COURT APPROVED PUBLIC SERVICE
THIS AMENDMENT TO INTERGOVERNMENTAL AGREEMENT is made and
signed on the /Lt& day of , Mfr j1 0 2 , 1994, by and between the
City of Greeley, Colorado, with its principle place of business at
1000 Tenth Street, Greeley, Colorado 80631, by and through its City
Council, hereinafter referred to as "Greeley, " and the County of
Weld, State of Colorado, the County government with its principle
place of business being the Centennial Center, 915 Tenth Street,
Greeley, Colorado 80631, by and through the Board of County
Commissioners of Weld County, hereinafter referred to as "Weld
County. "
WITNESSETH:
WHEREAS, on the 11th day of August, 1993, an Intergovernmental
Agreement for Administration of City of Greeley Municipal Court
Approved Public Service was signed by the parties hereto, and
WHEREAS, said Intergovernmental Agreement now needs to be
amended to include additional duties as set forth below.
NOW, THEREFORE, Weld County, through its Useful Public
Services Program, agrees to process, in addition to Underage
Drinking Offenses, other municipal offenses which carry the
possibility of jail time under Greeley City ordinances, as a
sentencing alternative for the City of Greeley Municipal Court.
Weld County agrees to process these offenders under the following
conditions :
1 . Defendants must have the mental and physical ability to
perform the Court ordered hours .
2 . Defendants must have the financial ability to pay the
assessed program fee of $60 . 00 .
3 . The Greeley Municipal Court should use appropriate
discretion in referring potentially violent offenders .
4 . The Court shall reconsider the sentencing of defendants
who are determined by the Useful Public Service Program
staff to not be suitable candidates for Useful Public
Service.

A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF GRIQ.� NTER
INTO AN AMENDMENT TO AN INTERGOVERNMENTAL AGREEMEN O#1 1T'AgELD
COUNTY FOR ADMINISTRATION OF CITY OF GREELEY MUNICIPAL COURT
APPROVED PUBLIC SERVICE.
WHEREAS, the City and County entered into an Intergovernmental
Agreement for administration of City of Greeley Municipal Court
Approved Public Service on the 11th day of August, 1993; and
WHEREAS, the parties are now desirous of amending said
agreement to include additional misdemeanor offenses, and
specifications of eligibility of participants who would participate
in the program; and
WHEREAS, the parties are required pursuant to paragraph 6 (b)
of the original agreement to reduce said modification to writing.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GREELEY, COLORADO AS FOLLOWS:
1. The Mayor is hereby authorized to enter into the attached
amendment to the Intergovernmental Agreement with Weld County,
attached hereto as Exhibit A.
2. This resolution shall become effective immediately upon
its passage.
