RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION N0. 1352 - BARBARA J. CRAVER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1352, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1352 was submitted by Barbara J. Craver for property which is located in part of the NE'-, of Section 36, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 25.129 acres and 2.319 acres, more or less. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is based upon the following conditions: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. The following notes shall be placed on the Recorded Exemption Plat prior to recording: A. The number of animal units on the properties shall be maintained in compliance with the Weld County Zoning Ordinance requirements. 4. Prior to recording the Recorded Exemption Plat, the applicant shall submit evidence to the Department of Planning Services' staff that a properly completed report has been filed with the Division of Water Resources affirming that the old well on the property was plugged and abandoned. 5. Within 30 days of approval by the Board of County Commissioners, the mobile home on the proposed larger lot shall be brought into compliance with the Weld County Zoning Ordinance. 6. Prior to recording the Recorded Exemption Plat, the well-sharing agreement shall be approved by the Weld County Attorney's Office. Swanson Weld County Planning Department 915 10th Street Greeley, CO 80631 Re: Craver Recorded Exemption, RE-1352 NE1/4 Sec. 36, T1N, R67W, 6TH PM Dear Ms. Swanson: We have reviewed the above referenced proposal to split a 27.448 acre parcel into two lots of 25.12 and 2.32 acres. The proposed water supply is to be from an existing well , Permit Number 138214-A, which is located on the 2.32 acre lot. A previous late registration, Permit Number 138214, was issued for a 30-foot deep well constructed in 1903 which was replaced by the well constructed under Permit Number 138214. The application form for Permit Number 138214-A stated that the well had historically served 2 single-family dwellings and 1,000 pigs. Condition 2 of Permit Number 138214-A stated that the well was permitted to serve one single-family dwelling. The condition should have said the well was permitted to serve two single-family dwellings. Since this oversight has been brought to our attention, we will amend the permit to allow it to serve two single-family dwellings. Condition 1 of the permit required .the original well to be abandoned according to the "Rules and Regulations for Water Well and Pump Installation Contractors, " and that a report be completed and submitted affirming that the old well was plugged and abandoned. We have not received the required report. We cannot consider the well permit to be complete until we obtain the properly completed report. We understand that it is the applicant's intent to continue some level of pig raising on the smaller parcel . We have no objection to the proposal based on a shared well as long as the pig raising does not become a commercial operation. Although we do not have the legal expertise to review the well sharing agreement, we do offer the following comments: 1 . Craver. The parcel of land on which this request is being made is described as part of the northeast 1/4 of Section 36, T1N, R67W of the 6th P.M. , Weld County, Colorado. The property is located east of Weld County Road 23 1/2, south of Weld County Road 2 3/4. The request is to divide a 27.448 acre parcel of land, which is the total contiguous land holdings of the applicant, into two lots of 25.129 acres and 2.319 acres, more or less. The two houses on the property are currently sharing a well. The applicant proposes continuing the use of the shared well and has submitted a proposed agreement. Sewage disposal is provided by septic systems. A legal description for the proposed 2.319 acre parcel was created in 1987 through the Subdivision Exemption process for financing purposes only. The applicant has applied for this recorded exemption to allow the sale of the proposed larger parcel in lieu of foreclosure. If approved, each lot would contain one home. The City of Brighton,the Adams County Planning Department and the Weld County Health Department have reviewed the application materials and have no objections to the request. The Division of Water Resources has also reviewed the application materials and has recommended approval if the applicant complies with certain conditions. The staff has concerns whether adequate water will be available for the potential uses of this property. The proposed water supply is to be from an existing well , Permit Number 138214-A, which is located on the 2.32 acre lot. A previous late registration, Permit Number 138214, was issued for a 30-foot deep well constructed in 1903 which was replaced by the well constructed under Permit Number 138214. The application form for Permit Number 138214-A stated that the well had historically served 2 single-family dwellings and 1,000 pigs. Condition 2 of Permit Number 138214-A stated that the well was permitted to serve one single-family dwelling. The condition should have said the well was permitted to serve two single-family dwellings. Since this oversight has been brought to our attention, we will amend the permit to allow it to serve • two single-family dwellings. Condition 1 of the permit required .the original well to be abandoned according to the "Rules and Regulations for Water Well and Pump Installation Contractors," and that a report be completed and submitted affirming that the old well was plugged and abandoned. We have not received the required report. We cannot consider the well permit to be complete until we obtain the properly completed report. We understand that it is the applicant's intent to continue some level of pig raising on the smaller parcel . We have no objection to the proposal based on a shared well as long as the pig raising does not become a commercial operation. Although we do not have the legal expertise to review the well sharing agreement, we do offer the following comments: I. The legal description is: S.W. 1/4 of the N.E. 1/4 Section 36 Township, 1 N Range 67 W of the 6th P.M. The well permit number is 138214-A. This property has two dwellings on it and the well is shared, it has been this way, as far as I can tell , since 1980. The original permit (copy enclosed) was submitted asking for a well for 2 single family dwellings, and 1000 pigs. However, under your condition for approval , it is stamped for 1 dwelling. I am writing this for the seller of the above described property because we are trying to get a legal recorded exemption approved through Weld County. The property has already been approved for a subdivision exemption in 1988, and the shared well situation was addressed at that time and approved. The new purchasers are going to apply for a new well permit to drill a deeper well and they understand that it may be restriced to Household use only, so they would like to use the original well for lawn and garden. The county says that they are not comfortable with this because they're not sure this original well was dedicated for 2 dwellings. They feel one deep well restricted to household use only is not adequate for one dwelling. Again, Weld County had originally approved this property for a Subdivision exemption with the well being used for both residences. When I called records at State Water Resources, it was indicated to me that the condition for approval was probably "a mistake, " (after they had read the permit application) . The records suggested I should write you a letter about this so that you could clarify this, and we could proceed with the recorded exemption. I do not feel that Weld County has any reason to turn this down for an recorded exemption because of the well situation. A subdivision exemption has already been granted for loan purposes, and is almost exactly the same as an recorded exemption except they cannot be sold and deeded separately as I am sure you know. We have had a well users agreement already prepared by an attorney reflecting the shared use of the original well by both parties (copy enclosed). This is a very simple issue that has been clouded. A letter from you to Weld County addressing this matter would be greatly appreciated. If I can assist you in any way or clarify any of these events for you, I would be happy to do so.
